The Foundation Dance Complex
Waiver and Release of Liability
By agreeing to this waiver during registration, I acknowledge and agree to the following terms:
1. Assumption of Risk and Waiver of Liability
I understand that participation in dance, fitness, tumbling/acrobatics, and related physical activities involves inherent risks, including but not limited to falls, collisions, physical exertion, equipment use, and other risks that may result in injury, illness, permanent disability, or death.
I voluntarily assume all such risks, whether known or unknown, for myself or my child and hereby release, waive, and discharge The Foundation Dance Complex, including its owners, directors, employees, instructors, independent contractors, volunteers, and affiliates, from any and all liability, claims, or demands arising from participation in any classes, rehearsals, performances, events, or activities, whether held on or off studio premises.
This release includes claims arising from negligence to the fullest extent permitted by law.
2. Indemnification Agreement
I agree to indemnify, defend, and hold harmless The Foundation Dance Complex and its representatives from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to participation by myself or my child, including claims brought by third parties.
3. Medical Authorization and Health Acknowledgment
I certify that I (or my child) am physically fit to participate and have no medical condition that would prevent safe involvement in studio activities.
In the event of a medical emergency, I authorize The Foundation Dance Complex to seek emergency medical treatment. I understand and agree that I am financially responsible for any medical services rendered.
4. Communicable Illness Acknowledgment
I understand that participation in group activities may increase the risk of exposure to communicable illnesses, including but not limited to COVID-19 or other viruses. I voluntarily assume this risk and agree not to hold The Foundation Dance Complex liable for any illness or related complications.
5. Facility and Equipment Use
I understand that use of studio facilities, flooring, and equipment (including but not limited to dance floors, Marley, props, and sound equipment) carries inherent risks. I agree to follow all instructions provided by staff and accept full responsibility for any injury or damage resulting from misuse or failure to follow directions.
6. Media Release
I grant permission to The Foundation Dance Complex to use photographs, video, and/or audio recordings of myself or my child for marketing, promotional, and educational purposes in any media format. I understand that names may or may not be used and that no compensation will be provided.
7. Tuition, Billing, and AutoPay Authorization
I understand and agree that enrollment at The Foundation Dance Complex requires a valid payment method on file and enrollment in automatic billing (AutoPay) through the studio’s management system.
I authorize The Foundation Dance Complex to charge all tuition, fees, and applicable charges to my payment method on file via GoStudioPro.
I acknowledge and agree that:
Tuition is billed on a recurring basis and is due regardless of attendance, including missed classes, holidays, or personal scheduling conflicts, unless otherwise stated in writing.
Payments will be processed automatically on scheduled billing dates. It is my responsibility to maintain valid and current payment information.
Declined or failed payments may result in additional fees and/or suspension of participation until the account is brought current.
The Foundation Dance Complex reserves the right to charge my account for additional fees, including but not limited to costume fees, competition fees, merchandise, events, or other authorized purchases.
Accounts that remain unpaid may be sent to collections, and I agree to be responsible for any associated costs, including reasonable attorney’s fees.
All tuition, fees, and purchases are non-refundable and non-transferable unless otherwise stated in writing.
I understand that withdrawal from classes requires written notice in accordance with studio policy, and failure to provide proper notice may result in continued billing.
8. Studio Policies
I agree to adhere to all policies set forth by The Foundation Dance Complex, including but not limited to dress code, attendance, class conduct, and health and safety protocols.
9. Release for Off-Site Activities and Events
I acknowledge that participation in performances, competitions, conventions, or events outside of the studio carries additional risks, including transportation-related risks.
I release The Foundation Dance Complex from any and all liability related to participation in such off-site activities.
10. Physical Contact and Instructional Corrections
I understand that dance instruction may involve appropriate physical contact between instructors and students for the purpose of correction, alignment, injury prevention, and safety.
I acknowledge and agree that:
Instructors may use hands-on guidance to adjust posture, alignment, placement, or movement.
All physical contact will be professional, appropriate, and solely for instructional purposes.
The Foundation Dance Complex maintains a safe, respectful, and professional environment at all times.
I understand that if I or my child are uncomfortable with physical corrections, I may notify the studio in writing, and reasonable accommodations will be made when possible.
11. Charter School Participation and Third-Party Funding
I understand that if I am participating through a charter school, educational vendor program, or any third-party funding source, I remain personally responsible for all tuition, fees, and charges.
I acknowledge and agree that:
The Foundation Dance Complex is not responsible for denied, delayed, or incomplete payments from any charter school or third-party program.
If a third party fails to pay for any reason, I (the parent/guardian) am fully responsible for the outstanding balance.
Participation may be suspended if payment is not received in a timely manner.
All studio policies apply equally to charter school participants.
Charter participation does not alter or limit this waiver in any way.
12. Severability Clause
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of California.
14. Consent and Acknowledgement
By completing registration, I confirm that I have read, understood, and voluntarily agreed to all terms of this waiver.
If registering a minor, I certify that I am the legal parent or guardian and have the authority to provide this consent.
