Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center ("DMPAC"), respects the privacy of our students and families. We are committed to protecting the personal information entrusted to us and maintaining appropriate safeguards to secure that information.

DMPAC does not sell, rent, or trade personal information to third parties.

Information We Collect

When you register for classes, events, camps, workshops, or other programs, we may collect information including:

-Parent/guardian names
-Mailing addresses
-Phone numbers
-Email addresses
-Emergency contact information
-Student names and birthdates
-Medical information voluntarily provided by parents or guardians
-Payment and billing information
-Class registrations and attendance records
-Additional information submitted through registration forms, surveys, or communications with DMPAC

Required fields are identified within registration forms and are necessary to provide studio services and maintain accurate records.

How We Use Your Information

Information collected by DMPAC may be used to:

Parent Portal and Account Security

Families are provided access to a Parent Portal account. Parents and guardians are responsible for maintaining the confidentiality of their login credentials and for keeping account information current and accurate.

Only authorized DMPAC staff members have access to personal information as necessary to perform their job responsibilities.

Photography and Media

DMPAC may photograph or record classes, performances, competitions, special events, and studio activities. The use of photographs, videos, or other media is governed by the family's media preferences maintained through their DMPAC account settings and any applicable media release agreements.

Sharing of Information

DMPAC may share information only when necessary to:

-Operate studio services and programs
-Process payments through authorized payment processors
-Provide services through trusted third-party software providers
-Comply with legal obligations, court orders, or lawful requests
-Protect the rights, safety, property, or security of DMPAC, its students, families, staff, or the public

DMPAC does not sell personal information to outside organizations.

Data Security

DMPAC takes reasonable administrative, technical, and physical measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. While no system can guarantee absolute security, we strive to safeguard information using industry-standard practices.

Children's Privacy

Information regarding minors is collected only through a parent or legal guardian for legitimate studio purposes.

Updates to This Policy

DMPAC reserves the right to update this Privacy Policy as needed. Any revisions will be made available through the Parent Portal, website, or other studio communication channels.

Liability Waiver, Assumption of Risk & Release of Liability

I, the undersigned parent or legal guardian ("Primary Contact") of the participant identified on this registration form, understand and acknowledge that participation in dance classes, rehearsals, performances, conditioning activities, camps, workshops, competitions, and other related activities offered by Dance Magic Studios, Inc., doing business as Dance Magic Performing Arts Center ("DMPAC"), involves inherent risks. These risks may include, but are not limited to, falls, collisions, strains, sprains, fractures, illness, property damage, and other injuries that may result from participation in physical activity.

I acknowledge that participation in DMPAC activities is voluntary and that I knowingly and willingly assume all risks, both known and unknown, associated with my child's participation.

Release and Waiver of Liability

In consideration of my child being permitted to participate in DMPAC activities, I, on behalf of myself, my child, my heirs, assigns, and representatives, hereby release, waive, discharge, and hold harmless Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center (DMPAC), its owners, officers, directors, employees, instructors, independent contractors, volunteers, agents, landlords, and any facilities utilized for DMPAC activities from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to participation in DMPAC activities, including those resulting from ordinary negligence, to the fullest extent permitted by Indiana law.

This release applies to activities occurring both on-site and off-site, including classes, rehearsals, performances, competitions, camps, workshops, special events, travel-related activities organized by DMPAC, and the use of any facility associated with DMPAC.

Assumption of Risk

I understand and acknowledge that dance and related physical activities involve risks that cannot be eliminated regardless of the care taken to avoid injuries. Such risks include, but are not limited to:

-Falls, slips, trips, and collisions
-Muscle strains, sprains, and tears
-Broken bones and dislocations
-Concussions and head injuries
-Exposure to illness or communicable diseases
-Injuries resulting from physical exertion or use of equipment

I knowingly and voluntarily assume all such risks on behalf of myself and my child.

Medical Authorization

I certify that my child is physically able to participate in dance and related physical activities. I agree to disclose any known medical conditions, injuries, allergies, medications, or limitations that may affect participation.

In the event of an injury, illness, or medical emergency, I authorize DMPAC staff, representatives, or emergency personnel to seek emergency medical treatment for my child if I cannot be reached in a timely manner. I understand that I am solely responsible for any costs associated with such treatment, including ambulance, hospital, physician, therapy, medication, or other medical expenses.

Responsibility for Conduct and Property Damage

I agree that my child will abide by all studio, facility, and program rules. I understand that DMPAC reserves the right to remove any participant whose behavior is unsafe, disruptive, inappropriate, or detrimental to the learning environment.

I accept responsibility for any damage to property caused by myself or my child through intentional misconduct, reckless behavior, or failure to follow established rules and procedures.

Indemnification

I agree to indemnify, defend, and hold harmless Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center (DMPAC), its owners, officers, directors, employees, instructors, contractors, volunteers, and agents from and against any claims, liabilities, damages, costs, or expenses, including reasonable attorney fees, arising from the actions or conduct of my child while participating in DMPAC activities.

Photography and Media Release

Unless otherwise indicated through my DMPAC account settings, I grant permission for photographs, video recordings, audio recordings, and other media containing my child's image or likeness to be used by Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center ("DMPAC"), for promotional, educational, social media, website, advertising, and marketing purposes without compensation.

I understand that my photo and media preferences are managed through my DMPAC Parent Portal account and that it is my responsibility to keep those preferences current and accurate.

To update your photo and media preferences, log in to your Parent Portal and navigate to More/Info > Waivers & Policies > Photo Opt-Out.

Acknowledgment

I have carefully read this Liability Waiver, Assumption of Risk, and Release of Liability. I understand its contents and acknowledge that by signing this document, I am giving up certain legal rights on behalf of myself and my child.

I certify that I am the parent or legal guardian of the participant and have the authority to execute this agreement.

DMPAC Financial Responsibility Agreement

I, the Primary Contact for the student(s) listed on this registration, acknowledge and agree that I am financially responsible for all tuition, registration fees, costume fees, competition fees, convention fees, private lessons, choreography fees, merchandise purchases, and any other charges associated with participation in programs offered by Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center ("DMPAC").

Primary Contact Responsibility

By completing this registration, I understand that DMPAC will look solely to the Primary Contact listed on the account for payment of all financial obligations.

I acknowledge that any financial arrangements made between parents, guardians, family members, or other parties are private agreements and do not alter my responsibility to DMPAC.

DMPAC will not invoice, collect from, or discuss account balances with any person other than the Primary Contact unless:

A separate Payment Agreement Form has been completed and approved by DMPAC; or
Official court documentation is provided that specifically outlines financial responsibility and authorizes communication regarding the account.

Requests for a Payment Agreement Form may be submitted to dancemagicpac@gmail.com.

Payment Policies
-Tuition and all applicable fees are due on the first (1st) day of each month.
-Payments may be made through the Parent Portal or check.
-A late fee of $25 will be assessed to accounts with an unpaid balance after the 10th day of the month.
-DMPAC reserves the right to suspend participation in classes, rehearsals, performances, competitions, conventions, or other studio activities until an account is brought current.

Withdrawal Policy

If I choose to withdraw myself or my child from any class, program, or activity, I understand that notification must be submitted in writing via email to dancemagicpac@gmail.com.

Withdrawal requests are not considered effective until written notice has been received and acknowledged by DMPAC.

Class Cancellation Policy

DMPAC reserves the right to cancel, combine, reschedule, or modify classes, programs, events, or activities due to insufficient enrollment, staffing needs, facility issues, or other operational considerations.

If DMPAC cancels a class or program and no reasonable alternative is offered, a refund or account credit may be issued at DMPAC's discretion.

Delinquent Accounts

Accounts that remain unpaid for sixty (60) days may result in suspension from classes, rehearsals, performances, competitions, conventions, and other DMPAC activities until the balance is paid in full.

Accounts that remain unpaid for ninety (90) days may be referred to collections, legal action, or Hamilton County Small Claims Court. The account holder agrees to be responsible for any collection costs, court costs, attorney fees, filing fees, interest, and other expenses permitted by law.

Refund Policy

I understand and agree that the following payments are non-refundable once incurred or paid:

-Tuition
-Registration fees
-Costume fees
-Competition fees
-Convention fees
-Choreography fees
-Private lesson fees
-Performance fees
-Merchandise purchases
-Fundraising fees and assessments

No refunds, credits, or transfers will be issued for missed classes, rehearsals, performances, competitions, conventions, or voluntary withdrawal from a program unless otherwise required by law.

Acknowledgment

By signing below, I acknowledge that I have read, understand, and agree to comply with the DMPAC Financial Responsibility Agreement. I understand that enrollment constitutes a financial commitment and that I am responsible for all charges incurred on my account.

DMPAC Code of Conduct Agreement

Participation in programs offered by Dance Magic Studios, Inc., d/b/a Dance Magic Performing Arts Center ("DMPAC"), is a privilege. To maintain a positive, respectful, and safe environment for all students, families, and staff, all participants and their families agree to the following:

Financial Obligations

I understand that all tuition, fees, and account balances must remain current.

I acknowledge that late payments may result in late fees, suspension of participation privileges, exclusion from classes, rehearsals, performances, competitions, or other studio activities.

I understand that overdue accounts may be referred to a collection agency or legal process, and I agree to be responsible for any associated collection costs, fees, and expenses permitted by law.

Communication Protocol

I agree to direct all studio-related questions, concerns, scheduling matters, or conflicts to the Studio office or owner/Director.

I understand that DMPAC teachers and staff should not be contacted directly by phone, text message, email, social media, or in person regarding studio business unless specifically authorized by the Studio Owner/Director.

I understand that meetings with the Director should be scheduled through email or other approved studio communication channels.

I agree to observe a 24-hour waiting period before addressing concerns when emotions are elevated, allowing for respectful, productive, and solution-focused conversations.

This provision does not apply to situations involving the immediate health, safety, or well-being of a student.

Respect & Behavior Expectations

I agree to conduct myself in a respectful and professional manner when interacting with DMPAC staff, students, families, volunteers, judges, event personnel, and affiliated organizations.

I understand that bullying, harassment, intimidation, discrimination, retaliation, or defamation—including physical, verbal, emotional, written, electronic, or social media conduct—will not be tolerated.

I acknowledge that inappropriate behavior by either a student or family member may result in disciplinary action, suspension, or dismissal from DMPAC.

I understand that the Studio Owner/Director retains sole discretion in determining appropriate corrective action.

Studio Etiquette & Facility Expectations

To maintain a safe and welcoming environment:

-Children may not be left unsupervised in the lobby unless they are actively attending classes and transitioning between scheduled activities.
-Siblings and non-participating children must remain under the direct supervision of a parent or guardian at all times.
-Running, roughhousing, horseplay, or unsafe behavior is prohibited.
-Climbing on furniture, walls, railings, or studio fixtures is prohibited.
-Standing on toilets, playing in restrooms, or misuse of restroom facilities is prohibited.
-Mirrors, trophies, awards, displays, photographs, and studio property should be treated with care and respect.
-Food is not permitted inside studio rooms and should not be consumed during class time unless specifically authorized by DMPAC.
-Families are expected to help maintain a clean, safe, and respectful environment for all participants.

Dismissal & Withdrawal Policy

I understand that participation in DMPAC programs is a privilege and that the Studio Owner/Director reserves the right to suspend or dismiss any student or family at any time if it is determined to be in the best interest of the studio community.

I understand and agree that no refunds will be issued for tuition, registration fees, costume fees, competition fees, convention fees, private lessons, choreography fees, fundraising earnings, or any other payments previously made if a dancer is dismissed or voluntarily withdraws from the program.

For Company dancers, I understand that any fundraising profits, credits, or earned balances will be forfeited upon dismissal or voluntary withdrawal unless otherwise required by law.

I understand that if a dancer voluntarily withdraws from the Company Program during the season, they will not be permitted to rejoin the Company Program for the remainder of that season.

Future participation in the Company Program following a withdrawal or dismissal will be at the sole discretion of the Studio Owner/Director.

This provision does not apply to students enrolled exclusively in recreational classes unless otherwise stated in a program-specific agreement.

Acknowledgment

By signing below, I acknowledge that I have read, understand, and agree to comply with the DMPAC Code of Conduct Agreement. I understand that failure to comply with these expectations may result in disciplinary action, suspension, or dismissal from DMPAC programs.
