By registering for classes, workshops, private lessons, events, or any activities offered by Pointe Dance ("Pointe"), I acknowledge that I have carefully read and agree to the following terms and conditions. The documents are provided for informational purposes and should be reviewed by a Washington attorney before implementation. That final legal review is relatively inexpensive and can ensure the language aligns with Washington law while preserving the professional brand you've worked so hard to build.
### Assumption of Risk
I understand that participation in dance, movement, fitness, wellness, rehearsals, performances, workshops, private instruction, and related activities involves inherent risks, including but not limited to falls, slips, collisions, strains, sprains, fractures, head injuries, muscle soreness, overexertion, and other serious bodily injuries.
I further acknowledge that Pointe Dance is currently operating with sealed, unfinished concrete flooring. While every effort has been made to provide a safe, clean, and well-maintained environment, I understand that this flooring surface may present additional physical demands and inherent risks associated with movement-based activities. I voluntarily choose to participate with full knowledge of these conditions.
I acknowledge that participation may also involve exposure to communicable illnesses, including but not limited to COVID-19, influenza, RSV, MRSA, and other contagious viruses or bacteria. Although Pointe Dance follows reasonable cleaning and sanitation practices, no environment can be guaranteed free from exposure.
I voluntarily assume all known and unknown risks associated with participation.

### Medical Fitness
I certify that I, or the participant I am registering, am physically able to participate in dance and movement activities.
I understand that it is my responsibility to consult a physician before participating if I have any medical condition, injury, illness, pregnancy, or physical limitation that may affect safe participation.
I agree to immediately notify Pointe Dance of any injury or condition that develops during participation.

### Release of Liability
To the fullest extent permitted by law, I release, waive, discharge, and agree to hold harmless Pointe Dance, its owners, directors, instructors, guest artists, employees, volunteers, independent contractors, landlords, affiliates, and representatives from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses arising from or related to participation in Pointe Dance activities, including those resulting from ordinary negligence.
This release includes, but is not limited to:
* Personal injury
* Illness or disease
* Property damage or theft
* Disability
* Emotional distress
* Wrongful death
* Losses occurring on or off Pointe Dance premises during Pointe-sponsored activities

### Emergency Medical Authorization
In the event of an accident or medical emergency, I authorize Pointe Dance staff to obtain emergency medical treatment deemed reasonably necessary.
I understand that every reasonable effort will be made to contact my designated emergency contact before treatment whenever possible.
I accept full financial responsibility for all medical expenses incurred and release Pointe Dance from any liability relating to emergency medical decisions made in good faith.

### Minor Participants
If registering a participant under the age of eighteen (18), I certify that I am the child's parent or legal guardian and have legal authority to execute this agreement on their behalf.
I understand that I am fully responsible for the minor participant's compliance with Pointe Dance policies and this agreement.

### Personal Property
Pointe Dance is not responsible for lost, stolen, or damaged personal belongings, including clothing, electronics, jewelry, dance shoes, or other personal items brought onto the premises.
Participants are encouraged to leave valuables at home.

### Photography & Video Release
I grant Pointe Dance the unrestricted right to photograph, record, livestream, and capture video or audio of myself or my child during classes, rehearsals, workshops, performances, community events, competitions, special events, and promotional activities.
I authorize Pointe Dance to use these images and recordings in perpetuity without compensation for purposes including but not limited to:
* Marketing and advertising
* Social media
* Website content
* Printed materials
* Digital publications
* News media
* Promotional campaigns
* Educational materials
I understand that Pointe Dance will make every reasonable effort to present participants respectfully and professionally, consistent with the studio's values.
For the privacy and safety of our community, Pointe Dance will not intentionally publish a participant's full name alongside photographs or videos without separate written permission.
This media authorization remains in effect unless revoked in writing. Revocation will apply only to future marketing materials and cannot require the removal of materials already published.

### Code of Conduct
Pointe Dance is committed to creating a welcoming, respectful, and inclusive environment where dancers of all ages feel safe to learn and grow.
Pointe Dance reserves the right to refuse service or remove any participant whose behavior is unsafe, disruptive, abusive, discriminatory, or otherwise inconsistent with the studio's mission and community standards. Tuition or pass fees may not be refunded in these circumstances.
### Studio Environment
Pointe Dance is an intimate, boutique dance studio with limited class sizes. Because of the close-knit nature of our community, participants understand that classes may include physical movement in proximity to others, partner exercises, and shared use of studio equipment. Participants agree to follow instructor guidance, wear appropriate footwear and attire, and immediately report any unsafe conditions or injuries.

### Acknowledgment
By completing my registration, purchasing a Pointe Pass or membership, attending classes, or signing below, I acknowledge that:
* I have read and understand this Participation Agreement, Liability Waiver, and Media Release.
* I understand that I am giving up certain legal rights, including the right to bring certain legal claims against Pointe Dance.
* I voluntarily agree to all terms and conditions contained herein.
* I understand this agreement is binding upon myself, my heirs, executors, administrators, and legal representatives.
