I am the parent or legal guardian of the participating minor student(s), or I am an adult participant. I voluntarily authorize participation in dance, tumbling, conditioning, stretching, rehearsals, performances, competitions, camps, workshops and other activities offered or supervised by Under the Spotlight Dance Company (“USDC”).
ACKNOWLEDGMENT OF RISK
I understand that dance, tumbling and related physical activities involve inherent risks. These may include, but are not limited to, falls, collisions, overuse injuries, sprains, strains, fractures, concussions and other serious injuries. These risks may result from physical exertion, equipment, flooring, choreography, tumbling skills, interaction with other participants, travel, performance conditions or other circumstances that cannot always be predicted or prevented.
I understand that instructors may provide verbal instruction, demonstrations, corrections and appropriate physical spotting or hands-on adjustments when reasonably necessary for safety, alignment or instruction.
I certify that the participant is physically able to participate. I agree to disclose relevant injuries, medical conditions, allergies, limitations or changes in health that could affect safe participation. I understand that USDC instructors and staff are not medical professionals and cannot diagnose, treat or determine whether a participant is medically fit to return following an injury or illness.
A participant may be asked to observe, modify activity or discontinue participation when staff reasonably believe continued participation may be unsafe. USDC may require written medical clearance before allowing a participant to return following an injury, surgery, concussion or significant medical event.
ASSUMPTION OF RISK AND RELEASE
To the fullest extent permitted by applicable law, I knowingly and voluntarily assume the ordinary and inherent risks associated with participation in USDC activities.
In consideration for being permitted to participate, I release and hold harmless Under the Spotlight Dance Company, its owner, instructors, employees, assistants, volunteers, landlords, host facilities and authorized representatives from claims arising from the ordinary and inherent risks of participation, except to the extent a claim cannot legally be waived.
Nothing in this agreement is intended to release any party from liability that cannot lawfully be released, including liability resulting from willful or wanton misconduct.
MEDICAL AUTHORIZATION
If I cannot be reached during a medical emergency, I authorize USDC staff to contact emergency services and obtain reasonably necessary emergency care for the participant. I understand that USDC cannot guarantee that a particular physician or facility will be used.
I accept financial responsibility for medical treatment, transportation and related expenses not covered by insurance. This authorization does not require USDC staff to provide treatment beyond their training.
ILLNESS AND COMMUNICABLE DISEASE
Participants should not attend when experiencing fever, vomiting, diarrhea, a contagious illness or another condition that could endanger the participant or others. USDC may ask a participant to leave or remain home when illness is suspected. Missed classes resulting from illness are subject to the studio’s regular attendance and tuition policies.
PERSONAL PROPERTY
USDC is not responsible for lost, stolen, misplaced or damaged personal belongings. Participants should label dancewear, shoes, water bottles and other property and avoid bringing unnecessary valuables.
ACKNOWLEDGMENT
I have read this agreement, understand its contents and voluntarily accept it for myself and every participating minor child listed on my USDC family account. I understand that this agreement contains an assumption of risk and release of certain legal rights.
