CAPA LIABILITY WAIVER, ASSUMPTION OF RISK, AND MEDIA RELEASE AGREEMENT
By enrolling in classes, camps, workshops, performances, competitions, rehearsals, private lessons, aerial arts, acrobatics, tumbling, conditioning programs, outreach events, or any other activity offered by Carrington & Crafton Academy of Performing Arts ("CAPA"), I acknowledge and agree to the following:
Assumption of Risk
I understand that participation in dance, acrobatics, tumbling, aerial arts, conditioning, fitness activities, performances, competitions, camps, workshops, and related activities involves inherent risks of injury. These risks include, but are not limited to, slips, falls, collisions, muscle strains, sprains, fractures, concussions, permanent disability, illness, and, in rare circumstances, death.
I voluntarily assume all known and unknown risks associated with participation in CAPA activities.
Release of Liability
To the fullest extent permitted by law, I release, waive, discharge, and agree not to bring any claim against Carrington & Crafton Academy of Performing Arts (CAPA), its owners, instructors, employees, contractors, assistants, volunteers, guest artists, representatives, and affiliates for any injury, loss, damage, expense, or claim arising out of participation in CAPA activities.
This release applies to all classes, rehearsals, performances, competitions, conventions, camps, workshops, outreach events, and activities conducted on or off CAPA premises.
Medical Authorization
In the event of an injury, illness, or emergency, I authorize CAPA personnel to obtain emergency medical treatment for the participant when reasonable efforts to contact a parent or guardian have been unsuccessful or when immediate action is necessary.
I understand that CAPA does not provide medical insurance and that all medical expenses are my sole responsibility.
Health Acknowledgment
I affirm that the participant is physically capable of participating in the activities for which they are enrolled. I agree to notify CAPA of any medical condition, injury, allergy, limitation, or circumstance that could affect participation.
Property Disclaimer
I understand that CAPA is not responsible for lost, stolen, or damaged personal property, including dancewear, costumes, shoes, electronics, jewelry, phones, bags, or other belongings.
Photography, Video, and Media Release
I grant CAPA permission to photograph, record, livestream, videotape, and otherwise capture the participant's image, voice, likeness, performance, and appearance during any CAPA-related activity.
I authorize CAPA to use such photographs, recordings, and media in print materials, websites, social media platforms, advertising, promotional materials, publications, marketing campaigns, and other lawful business purposes without compensation, notification, or further consent.
All photographs, recordings, and media produced by CAPA shall remain the sole property of CAPA.
Competition, Performance, and Travel Activities
I understand that participation in performances, competitions, conventions, outreach events, camps, workshops, and off-site activities may involve additional risks associated with transportation, unfamiliar venues, weather conditions, lodging, and public interaction. I voluntarily assume these risks.
Conduct and Dismissal
CAPA reserves the right to suspend or dismiss any participant or family whose conduct is disruptive, unsafe, abusive, threatening, harassing, defamatory, or otherwise detrimental to the studio environment.
Any dismissal from the studio does not relieve the family of any financial obligations owed under CAPA's Tuition and Payment Policies.
Indemnification
I agree to indemnify and hold harmless CAPA, its owners, instructors, employees, contractors, and representatives from any claims, damages, liabilities, costs, or expenses arising from the participant's actions or participation in CAPA activities.
Governing Law
This agreement shall be governed by the laws of the Commonwealth of Virginia.
Electronic Agreement
By checking the box indicating "I Agree," I acknowledge that I have read, understood, and voluntarily accepted the terms of this Liability Waiver, Assumption of Risk, and Media Release Agreement.
I understand that checking the agreement box constitutes my electronic signature and has the same legal effect as a handwritten signature.
If I am enrolling a minor participant, I certify that I am the parent or legal guardian authorized to enter into this agreement on the participant's behalf. I understand that participation in dance, acrobatics, tumbling, aerial arts, and performance activities carries inherent risks of injury, and I voluntarily accept those risks on behalf of myself and/or my child.

CAPA PAYMENT TERMS & FINANCIAL POLICIES
Enrollment Commitment
Enrollment at CAPA constitutes a commitment for the entire dance season. The dance season operates on a full-year basis, and monthly tuition payments are expected throughout the duration of the season regardless of student attendance, participation level, or withdrawal after the Add/Drop Deadline.
Add/Drop Deadline
Families may withdraw from classes without further financial obligation only if written notice is received prior to the Add/Drop Deadline of October 25th.
After October 25th, all enrollments become financially binding for the remainder of the dance season. No withdrawals, cancellations, schedule changes, or discontinuation of attendance will release a family from its tuition obligation.
Students who discontinue attendance, transfer to another activity, choose not to participate, move, become injured, or otherwise cease participation remain responsible for all tuition and fees associated with their enrollment for the remainder of the season.
Tuition Billing
Monthly tuition is posted on the 25th of the current month for the upcoming month's tuition cycle.
Payment is due upon posting and must be received by the tuition due date indicated on the family's account.
Tuition is a reservation of a student's place in class and is not based upon actual attendance.
Refund Policy
CAPA maintains a strict no-refund policy.
All tuition, registration fees, recital fees, costume fees, competition fees, intensive fees, camp fees, and other payments made to CAPA are non-refundable and non-transferable.
No refunds, credits, or account adjustments will be issued for:
• Missed classes
• Voluntary withdrawal
• Injury or illness
• Schedule conflicts
• Family vacations
• School activities
• Inclement weather closures
• Studio closures due to circumstances beyond CAPA's control
• Student dismissal or disciplinary action
Attendance & Missed Classes
No tuition credits, refunds, reductions, or make-up classes will be provided for missed classes.
CAPA does not prorate tuition for partial attendance, late enrollment, withdrawal, holidays, school breaks, inclement weather closures, or any other absence.
Studio Closures & Holidays
CAPA's tuition rates are based on the annual dance calendar and not on the number of classes held in any given month.
No credits, refunds, make-up classes, or tuition adjustments will be issued for scheduled holidays, breaks, or weather-related closures.
Late Payments
Any account balance not paid in full within one (1) day of the tuition due date will automatically incur a late fee.
Additional late fees will be assessed every fourteen (14) days thereafter until the account balance is paid in full.
CAPA reserves the right to suspend class participation, withhold costumes, recital participation, competition participation, awards, photographs, videos, or other studio privileges until all outstanding balances have been satisfied.
Returned Payments
Returned checks, declined credit card payments, ACH rejections, or other failed transactions may be assessed additional processing and administrative fees.
Payment Plans
Payment plans may be available upon request and solely at the discretion of CAPA management.
The approval of a payment plan does not waive any tuition obligation, fee, or contractual commitment.
Collection of Unpaid Balances
Families are responsible for all tuition and fees incurred during the term of enrollment.
CAPA reserves the right to pursue collection of unpaid balances through any lawful means available, including the use of collection agencies, legal action, and recovery of reasonable collection costs, attorney's fees, and court costs where permitted by law.
Acceptance of Terms
By enrolling a student at CAPA, the parent, guardian, or financially responsible party acknowledges that they have read, understood, and agreed to these Payment Terms and Financial Policies and accept full responsibility for all tuition and fees associated with enrollment.

CAPA TERMS & CONDITIONS AGREEMENT
Effective Date: July 1, 2026
By enrolling a student with Carrington & Crafton Academy of Performing Arts ("CAPA"), the parent, guardian, or adult student acknowledges and agrees to the following Terms and Conditions.
Enrollment Agreement
Enrollment at CAPA constitutes acceptance of all studio policies, procedures, rules, regulations, payment obligations, and participation requirements.
CAPA reserves the right to modify policies, schedules, class offerings, faculty assignments, performance requirements, fees, and studio procedures at any time as deemed necessary for the operation of the studio.
Class Placement
CAPA reserves the sole and exclusive right to determine all class placements.
Student placement decisions are based upon factors including, but not limited to, age, ability, maturity, attendance, technical proficiency, commitment, safety considerations, and overall program needs.
Class placement recommendations and decisions made by CAPA are final.
Attendance
Consistent attendance is expected for all enrolled students.
Excessive absences may negatively affect a student's progress, performance opportunities, recital participation, competition participation, advancement, class placement, or eligibility for certain programs.
CAPA reserves the right to remove students from performances, competitions, special events, or classes if attendance is deemed insufficient.
Recitals, Performances, and Special Events
Participation in performances, recitals, showcases, competitions, conventions, workshops, outreach events, camps, and other activities may require additional fees, rehearsals, costumes, uniforms, travel, or participation requirements.
CAPA reserves the right to determine eligibility and participation in all performances and special events.
Failure to meet attendance, behavioral, financial, rehearsal, costume, or participation requirements may result in removal from an event without refund.
Costumes, Uniforms, and Required Attire
Students may be required to purchase costumes, uniforms, shoes, dancewear, accessories, competition attire, performance attire, and other required items.
All costume, apparel, and performance-related purchases are final.
No refunds, exchanges, or credits will be provided once items have been ordered or purchased.
CAPA is not responsible for manufacturer delays, shipping delays, discontinued items, sizing issues, or circumstances beyond its control.
Faculty and Schedule Changes
CAPA reserves the right to substitute instructors, modify class times, combine classes, divide classes, change locations, alter programming, or cancel classes as necessary.
Such changes shall not constitute grounds for refunds, credits, cancellation of enrollment obligations, or release from financial commitments.
Weather and Emergency Closures
CAPA reserves the right to close for weather events, emergencies, public health concerns, facility issues, or other circumstances beyond its control.
No refunds, tuition adjustments, credits, or make-up classes are guaranteed for such closures.
Communication Responsibility
Families are responsible for reviewing all emails, newsletters, studio announcements, portal notifications, text messages, social media updates, and other communications distributed by CAPA.
Failure to read or receive studio communications does not exempt families from compliance with studio policies, deadlines, schedules, financial obligations, or participation requirements.
Behavior Expectations
Students, parents, guardians, family members, guests, and visitors are expected to conduct themselves in a respectful, cooperative, and professional manner.
Disruptive, abusive, threatening, harassing, intimidating, defamatory, discriminatory, or otherwise inappropriate conduct toward staff, students, volunteers, contractors, vendors, judges, audience members, or other families will not be tolerated.
CAPA reserves the right to suspend or permanently dismiss any student or family whose conduct is determined to be detrimental to the studio environment.
Any suspension or dismissal shall not relieve the family of financial obligations owed to CAPA.
Social Media and Public Statements
Families agree not to publish, post, distribute, or communicate false, misleading, defamatory, harassing, or damaging statements regarding CAPA, its owners, instructors, staff, students, contractors, or affiliates.
CAPA reserves all rights available under applicable law regarding the protection of its reputation, intellectual property, and business interests.
Intellectual Property
All choreography, class materials, curriculum, music edits, recordings, branding, logos, graphics, publications, instructional content, photographs, videos, marketing materials, and other proprietary materials developed or provided by CAPA remain the exclusive property of CAPA.
No CAPA materials may be copied, distributed, reproduced, recorded, taught, transmitted, published, or used for commercial purposes without prior written consent.
Photography and Videography
Photography and videography may be restricted during classes, rehearsals, performances, competitions, and studio events.
CAPA reserves the right to determine when and where photography or recording is permitted.
Financial Obligations
All tuition, fees, charges, costume expenses, competition fees, recital fees, camp fees, intensive fees, merchandise purchases, and other financial obligations are governed by CAPA's Payment Terms and Financial Policies.
Enrollment constitutes acceptance of all financial obligations associated with participation.
Medical and Emergency Matters
Parents and guardians are responsible for maintaining current emergency contact information and notifying CAPA of any medical conditions, allergies, injuries, restrictions, or circumstances that may affect participation.
CAPA may restrict or prohibit participation when it determines that participation may present a safety concern.
Limitation of Liability
Participation in CAPA activities is voluntary and subject to the terms of CAPA's Liability Waiver and Assumption of Risk Agreement.
Nothing in these Terms and Conditions shall be interpreted to expand CAPA's liability beyond that permitted by law.
Severability
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.
Governing Law
These Terms and Conditions shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
Electronic Acceptance
By checking the box indicating "I Agree" during registration, I acknowledge that I have read, understood, and agree to be bound by these Terms and Conditions.
I understand that electronic acceptance constitutes my legally binding agreement and has the same force and effect as a handwritten signature.
