This Program Participation Agreement (the “PPA Agreement”) is dated as of the registration date by and between (“Parent/Guardian”) and the GREENBELT S.I.T.Y. STARS (“Team”), (collectively the “Parties”).
AUTHORITY TO REGISTER AND/OR TO ACT AS AGENT
I represent and warrant to the Greenbelt SITY Stars that I have full legal authority to complete this Jumper Registration. In addition, to the extent that I am registering on behalf of a third party (or third parties), I represent and warrant that I have been duly authorized to act as agent on behalf of such party (or parties) in performing such registration. I certify that I (i) am the parent or legal guardian of the child (“Participant(s)”) being allowed to participate in the youth sports program (the “Program”), as part of the Greenbelt SITY Stars (“GSS”) program administered by its associates, franchises, assigns and/or affiliates; (ii) am of legal age and am freely signing this Program Participation Agreement without any inducement or assurance of any nature; and (iii) have read this form and understand that, by signing this form, I agree that the terms of this Program Participation Agreement are binding on both me and the Participant. By proceeding with such registration, I agree that the terms of this Program Participation Agreement shall apply equally to me and to any third party (or parties) for whom I am acting as agent. Compliance with Children’s Online Privacy Protection Act (“COPPA”). I represent and warrant that, in compliance with COPPA, I am over eighteen (18) years of age, and that I am the parent or legal guardian of such child, and I do hereby consent to the collection of such child’s personal information by the Greenbelt SITY Stars.
COMMUNICATION
The team’s Communication will be done via SportsEngine. Parents and athletes need to manage their SportsEngine accounts to ensure they get the most out of their GSS experience during each sporting season. With their accounts properly configured, athletes and their families will receive communications according to their preferences.
CONCUSSIONS
State Law may require that the parent or guardian of a jumper participating in any athletic activity must be aware of the nature and risk of concussion. Information on concussions can be found at http://www.cdc.gov/concussion/.
CONDUCT
I understand that this is a youth sports team and conduct expectations apply to both the Parent(s) and the Participant(s). I agree to the conduct expectations of the team for both Parent and Participant as may be documented in the Program rules and policies, Team Handbook, on the Website or as modified from time to time by the Greenbelt SITY Stars. I further agree to any and all disciplinary action deemed necessary in the sole discretion of the Greenbelt SITY Stars up to and including team suspension or team expulsion. I understand that breach of conduct expectations is grounds for suspension or expulsion and that no refund will be given in the event my conduct does not reflect the expectations of the Greenbelt SITY Stars.
COVID-19 / COMMUNAL DISEASE
An inherent risk of exposure to COVID-19 or any other communal disease in any place where people are present. COVID-19 is an extremely contagious disease that can lead to sever illness and death. According to the Centers for Disease Control and Prevention, children, senior citizens and others with underlying medical conditions are especially vulnerable.
DAMAGE TO PROPERTY LIABILITY
I agree to pay for any damage caused by my child to the gym, to the team's equipment and uniforms, or to any person’s personal property.
DEFAMATION, SLANDER, LIBEL, STRIFE
Defamation, which is judicially defined to mean, the unprivileged oral or written publication of a false statement of fact that exposes the person about whom it is made to hatred, contempt, or ridicule or subjects that person to loss of the goodwill and confidence of others or so harms that person’s reputation as to deter others from associating with her or him. Cyber defamation is hereby defined as false communication that is published with the specific intent of harming the reputation of another individual, group, or business. Libel is the act of defaming another person through writings, such as newspapers, other publications, articles, blogs, or social media postings. Slander is the act of making a false oral statement about the character or professional standing of another person.
Defamation, Slander, and/or Libel of GSS or any of its representatives or members to intentionally cause damage to the reputation of the team and/or any of its representatives or members and the business being conducted will not be tolerated and is considered a separation offense which will lead to removal from the team under the GSS team policies.
Strife is defined as bitter conflict, discord, lack of agreement, or harmony. It is characterized by a resistance to cooperate with and get along with others. Strife is designed to separate people, cause bitter divisions, and destroy.
Actions causing strife within GSS for any of its representatives or members to intentionally cause division and/or damage to the reputation and/or morale of the team and the business being conducted will not be tolerated and is considered a separation offense which will lead to removal from the team under the GSS team policies.
DUAL PARTICIPATION/REPRESENTATION
All GSS jumpers are prohibited from training/competing/practicing with other jump teams/clubs/groups without the Head Coach’s knowledge and consent. For the camaraderie of the sport, the SITY Stars do fellowship, practice, train, and participate in workshops with other groups/clubs/teams. However, the skills, training methods, and manuals provided and used by GSS are considered proprietary information and cannot be made available to other clubs and/or teams. Improper use of GSS skills, training methods, and manuals to further a jumper’s private interest or that of another team, without the Head Coach’s knowledge is a conflict of interest so GSS jumpers are prohibited from representing/competing as jumpers on other teams while an active jumper of GSS (hereinafter defined as “dual-participation/representation”). Any jumper involved in dual participation/representation is deemed to be in direct conflict with the Greenbelt SITY Stars jump rope team and will be removed from the team immediately.
EMERGENCY MEDICAL TREATMENT
Permission is hereby granted for the Participant to receive any and all emergency medical/dental treatment and/or first aid, including authorizing any medical treatment facility/hospital to administer emergency treatment for any illness, injury, or accident resulting from participation in the Program.
FUNDRAISING
All team fundraisers for the operation of the team are required. A minimum value to be raised will be attached to each team fundraiser and will have to be paid if not raised.
All parents must provide a minimum of four (4) hours of volunteer service to each GSS Show Production, Recital, Banquet, Competition, Workshop, or a major event hosted by the team, sell the required number of show tickets per event, and donate one food item or pay said fee for the value of a donated items listed and the event tickets. A minimum of eight (8) events will be held per season.
INDEMNIFICATION
I agree to indemnify and hold the Greenbelt SITY Stars, each of their assigns, affiliates and associates, officers, and employees harmless from and against any and all damages, costs, claims, or demands, including reasonable attorneys’ fees, made by any third party due to or arising out of participation by Participant(s) and Parent(s) in the Program (including without limitation in connection with any medical treatment offered or given to Participant). I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, even if arising from their negligence, to the fullest extent permitted by law.
JUDGING REQUIREMENTS (Competition Team)
Parents with a jumper on the Regional and Elite teams are required to complete online judge training for the International Jump Rope Federation (IJRU) and the Amateur Athletic Union (AAU) and attend monthly training sessions with the Greenbelt SITY Stars to become certified judges in Speed, Power, and Freestyle. Certification must be completed by October 31 of the current season. Parents are required to judge at Local, Regional, and/or National and/or International competitions. There is required training for certification, a required uniform for each league, and additional travel fees will apply to attend out-of-state tournaments. There will be no exceptions. Jumper(s) will be removed from the Competitive teams until the certification is received.
Parents with a jumper on the Regional and Elite (National and International) teams are responsible for fulfilling the judging requirement of the competitive leagues which may include membership fees, judges training (cost), judging at local, regional, national, and international tournaments, and pay the expenses to certify and travel to and from the competition and house, if applicable.
Additionally, parents must be present, in uniform, and on time for all required judges meetings and events including GSS monthly in-person training in conjunction with meeting their judging duty at a competition/tournament.
LICENSE
Participant(s) and Parent(s) use of, and access to the GSS program materials is on a licensed basis. In that regard, GSS hereby grants to me, and I hereby accept, the non-exclusive right, license, and privilege to use (but not sublicense) the program materials. I agree to (a) constantly use best efforts in my use of the Program and Materials, to protect the good name and goodwill associated with the Program, Materials, and GSS; (b) not to attack the title of GSS in and to the Program Materials nor attack the validity of the license granted hereunder; (c) not harm, misuse or bring into disrepute the Program, Materials, and GSS, but to the contrary, will maintain the value and reputation thereof to the best of your ability; (d) at all times comply with all applicable government laws and regulations, and all voluntary industry standards relating or pertaining to the use of the Program and Materials and shall maintain appropriate customary high-quality standards. I shall also abide by GSS’ suggestions and specifications regarding quality control over the use of the Program Materials. I understand and agree that the license granted herein does not grant you any right, title, or interest, at law or in equity, in or to any of GSS’ trademarks, service marks, copyrights, copyrighted material, or any derivative uses thereof, or the name, likeness or image of GSS, or trade secrets or other rights or intellectual property of any kind, except as provided by said license. Further, such license applies only to those Program Materials designated herein. I shall not represent others or conduct myself in any manner that might indicate to others, that I possess any other legal or equitable rights in the Program, materials, trademarks, copyrighted materials, trade secrets, or other rights or intellectual property of any kind belonging to GSS other than by virtue of the license granted hereunder. GSS shall have the right to approve all uses of the Program Material or derivative uses thereof. GSS shall have and hereby reserves all rights and remedies which it has, or which are granted to it by operation of law, to enjoin the unlawful or unauthorized use of the Program Materials (any of which injunctive relief may be sought in the courts, and may be sought prior to or in lieu of termination), and to be compensated for damages for breach of this Program Participation Agreement.
OBLIGATION TO PAY TEAM FEES AND TRAINING TUITION
I have read the tuition and fees policies, and I agree to pay my child’s tuition, registration, equipment, and apparel package fee, competitive league fees, and other fees to the team when due.
Also, I understand that if the agreed-upon payment amount is not received by the agreed-upon schedule due on the 1st day of the session/registation or the 1st day of the month unless otherwise agreed, a $15 late fee will be incurred and my child will be suspended from practice, team events, outings, performances, competitions, etc. after the 3rd class/practice day of nonpayment and cannot return to team activities and/or training until the amount is paid.
PERMISSION TO PARTICIPATE
I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others and assume full responsibility for my participation.
I, the parent/guardian of the Participant, give permission for my child to participate in this Greenbelt SITY Stars’ program. I hereby certify that my child is physically capable of participating in fitness, strength, exercise, tumbling, dance activities included in the training practices of the Greenbelt SITY Stars. I also certify that my child is medically cleared by his/her physician (doctor) to participate in this physical activity. I understand that the team, its coaches, members and agents assume no responsibility for injuries incurred during the participation in those activities. The risk of injury from sports activities/programs can be significant, depending on the injury, and while rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and, I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation.
I understand and accept that GSS will do its utmost to protect my child and to provide the safest, fullest experience possible in its sole discretion. As in any athletic sports program, I realize that the possibility of injury exists and I authorize medical care and treatment for my child which may be necessary in the event of illness or injury during participation in team activities. I authorize the staff of GSS or their designee to take any measures for his/her safety.
We (myself and child) willingly agree to comply with the stated and customary terms and conditions for participation. We understand that non-compliance to the policies of the team will result in dismissal/removal from the team. If, however, we observe any unusual significant hazard during my presence or participation, we will remove myself from participation and bring such to the attention of the nearest official immediately.
PHOTOS/BROADCASTING RIGHTS
I understand that Program-related events may be photographed, videotaped or otherwise recorded by GSS Staff and that descriptions or accounts of such events may be written or otherwise documented, and I agree to let the Greenbelt SITY Stars use Parent or Participant’s name and/or likeness free of charge in any manner and in any media for promotional purposes (now known or hereafter developed) and for any marketing purpose without compensation to me or Participant and that the Greenbelt SITY Stars may use the information provided herein for marketing and promotion of the Greenbelt SITY Stars programs or events.
PROGRAM COMMITMENT AND TERMINATION
I understand that the commitment to the Greenbelt SITY Stars program is a one-year (season) commitment; however, GSS may terminate services and membership to the program immediately if: (1) I do not make the required payments; (2) in GSS' opinion, I am conducting myself in a manner which is disparaging or disruptive to the Greenbelt SITY Stars or the program; (3) I attempt to assert any ownership right in the Greenbelt SITY Stars’ Proprietary System; or (4) if I violate the confidentiality covenant stated above or breach any other provision of this Agreement. I agree to the fees and terms of the program and I understand that I have three (3) days after signing the agreements for a full refund, and after the three (3) business days is up, I will be responsible for the entire financial commitment. I understand that a space is reserved for me and preparations are made for my attendance in the entire one-year (season) program immediately upon registration and I agree to be fully in.
PROPRIETARY AND CONFIDENTIAL CONTENT AND INFORMATION
All materials, procedures, policies and standards, all teaching manuals, all teaching aids, all supplements and the like that have been or will be made available by the Greenbelt SITY Stars in connection with the GSS program, whether oral or written is the property of GSS. Participant(s) and Parent(s) recognize that the team’s training involves the use of information and training materials of a confidential nature which constitutes an asset of substantial value including methods, techniques, formats, marketing and promotional techniques, and procedures, specifications, information, the Operations Manual, the Training Manual, systems, costs and financial information, and knowledge of and experience in the operation of a jump rope team that is communicated to Participant(s) and Parent(s) otherwise acquired as the result of his or her position or association with the Team. Program content is for personal use only, and may not be sold, recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of the Greenbelt SITY Stars. Accordingly, Participant(s) and Parent(s) hereby covenant and agree that during the term of this Agreement and three (3) years after leaving the team that they will not, directly or indirectly, disclose to others any such confidential information or training materials or render any service to others including forming a new team and/or training group which would in any way involve the use divulging of GSS' training and operation information. I understand and agree that any violation of GSS’ policies regarding proprietary and confidential content and information shall result in the immediate termination of my enrollment without refund. We reserve the right to make any changes to the GSS program, including scheduled events, training procedures, course materials, curriculum facility, and staff. We will use our best efforts to notify you of these changes as soon as possible.
RELEASE OF LIABILITY
In return for the Participant being allowed to participate in the Program, I fully release, indemnify, and agree not to sue, the Greenbelt SITY Stars, the City of Greenbelt, their associates, assigns and/or affiliates and each of their respective employees, officers, directors, sub-contractors, sponsors, agents, affiliates, and subsidiaries, from or for, as applicable, all present and future claims that may be made by the Participant or me, my family, estate, heirs or assigns for property damage, personal injury, exposure to contagious disease or wrongful death arising as a result of the Participant’s participation in the Program, wherever, whenever, or however the same may occur. I understand and agree that the Greenbelt SITY Stars is not responsible for any injury, contagious disease exposure, or property damage arising out of the Program, even if caused by their ordinary negligence. I understand that participation in the Program involves certain risks, including, but not limited to, serious injury, contagious disease exposure, or permanent disability. I am voluntarily allowing Participants to participate in the Program with knowledge of the dangers involved and agree to accept all risks of such participation. I certify that the Participant is in excellent physical health and may participate in strenuous and hazardous physical activities, including all activities in the Program. I also agree to indemnify and hold harmless those listed above for all claims arising out of the Participant’s participation in the Program and all related activities. I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the Program is taking place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I fully release GSS, its staff, agents, and associates from any and all liability for any act, omission, or any other thing which results in injury or harm to the Participant and Parent(s). I understand and recognize the possibility of physical injury associated with the activities. I, hereby release, discharge, and/or otherwise indemnify GSS, its affiliated organizations and sponsors, their employees, and associated personnel, including the owners of the practice locations utilized for the program, against any claim by or on behalf of the registrant as a result of the participant and parent not complying with the policies, guidelines, and safety procedures of the program.
RELEASE OF LIABILITY FOR PERSONAL PROPERTY
I agree that the protection of my child’s personal property is his/her responsibility and release GSS, its employees, staff, associates, or any other person connected with the organization from any liability for theft or loss of my personal property.
RETURN & REFUND POLICY
ALL SALES ARE FINAL – No Refunds, No Exceptions. If for ANY reason you choose or otherwise cannot participate in the program for which you’ve registered, you will not receive a refund.
RIGHT TO RECORD AND REUSE YOU AND YOUR LIKENESS
You understand that we may record all parts of our GSS programs for which the Participant(s) and Parent(s) are recorded via video and/or audio recording and you hereby grant to us the irrevocable right (which may be licensed, transferred, granted or assigned to other parties as we see fit) to use, publish, reproduce, create derivative works of, distribute, publicly perform and publicly display, either digitally or in any other medium now known or later developed, the video or audio recordings of the program in any form, including without limitation, use as part of a composite or distorted in character or form, without restriction as to text, changes or alterations, whether or not in conjunction with your name or a fictitious name, in future programs and/or for illustration, promotion, advertising, marketing, or any other purpose whatsoever that is reasonably related to our business. You also irrevocably waive any right that you may have to inspect or approve of any of the deliverables or uses contemplated.
SEVERABILITY
I further expressly agree that this Program Participation Agreement is intended to be as broad and inclusive as is permitted by law and that if any provision of this Program Participation Agreement and Liability shall be unlawful, void, or for any reason unenforceable, then the provision shall be deemed severable from this Program Participation Agreement and Liability Waiver and shall not affect the validity and enforceability of any remaining provisions.
SOCIAL MEDIA
I understand that I must first get permission from GSS' Head Coach before posting photos and videos of members of the team on any personal social media network, website(s), brochures, and/or printed material other than those sites belonging to Greenbelt SITY Stars.
TEAM AUTHORITY
The Head Coach has full authority in managing the team and any dispute, complaint, or criticism involving coaches, jumpers, or parents of the team should be brought to the attention of the Head Coach. The Head Coach reserves the right to suspend/remove a jumper and/or parents from the team if the jumper and/or his/her parents are causing problems that cannot be resolved.
VOLUNTEER REQUIREMENTS
All parents (one per household) must provide a minimum of four (4) hours of volunteer service per month, along with a parent meeting each month. A $75 fee will apply to the jumper's account who does not comply with the required number of volunteer hours.
All parents must provide a minimum of four (4) hours of volunteer service to each GSS Event (show, competition, workshop, banquet, recital, etc.), sell the required number of event tickets per show, and donate one food item or pay said fee for the value of the donated items listed and the event tickets. A minimum of eight (8) events will be held per season.
IN WITNESS WHEREOF, the undersigned agrees to be bound by the terms and conditions of this Program Participation Agreement.
By registering my child(ren) with the Greenbelt SITY Stars, I agree to participate (or allow my child(ren) and family members to participate) in the Greenbelt SITY Stars jump rope program for one complete season and hereby release Greenbelt SITY Stars, its directors, officers, agents, coaches, and employees from liability for any injury that might occur to myself (or to my child(ren) and family members) while participating in the Greenbelt SITY Stars program, including travel to and from training sessions or other scheduled organization activities.
By agreeing to this policy, you are affirming that you have read the Program Participation Agreement, and agree to comply with the terms and conditions outlined throughout the text. It is understood that you have read and have been clearly informed of said policies and procedures. It is also assumed, with your signature that you are agreeing to your child’s participation in all team activities throughout the season. I understand that by signing below I am certifying that I am able to comply with all of the expectations and regulations of the team and that if I am not able to do so, I will notify the Head Coach as soon as possible. Noncompliance with the regulations will lead to either suspension or immediate removal from the team.
