In Movement Dance LLC – Participation Waiver, Release, and Agreement

1. Media Release and Compensation Acknowledgment
I, the undersigned participant or the parent/legal guardian of the participant (if under 18 years of age), hereby grant In Movement Dance LLC and its representatives, affiliates, and assigns the irrevocable right and permission to record, photograph, film, and otherwise capture the participant’s likeness and voice during classes, rehearsals, performances, events, and any studio-related activity. These materials may be used, without compensation, in promotional, advertising, educational, and commercial formats, including but not limited to websites, social media platforms, streaming services, and virtual class content. All rights, title, and interest to such materials shall remain the exclusive property of In Movement Dance LLC.

2. Confidentiality and Non-Disclosure Agreement
I understand and agree that all class content, choreography, teaching methodologies, and materials provided by In Movement Dance LLC, including those shared by staff, guest instructors, or collaborators, are proprietary and protected under intellectual property and trade secret laws. I agree not to record, reproduce, share, teach, or distribute any content, in whole or in part, without prior written consent from the studio’s owner. I further agree not to disclose any confidential or sensitive information obtained through participation.

3. Intellectual Property Rights
All original choreography, curriculum, training content, and creative work produced by In Movement Dance LLC or its affiliates is considered intellectual property and is protected under U.S. copyright and intellectual property laws. I acknowledge that I do not obtain any ownership rights through participation and agree not to perform, reproduce, or claim any such content without express written authorization.

4. Assumption of Risk and Waiver of Liability
I acknowledge and understand that participation in dance and related physical activities involves inherent risks, including but not limited to physical exertion, sprains, strains, fractures, and other injuries. I voluntarily assume full responsibility for all such risks. I hereby release, discharge, and agree to hold harmless In Movement Dance LLC, its owners, directors, instructors, staff, affiliates, volunteers, independent contractors, and the landlord (St. Garabed Armenian Apostolic Church), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained during participation, whether on studio premises or at external locations.

5. Consent to Emergency Medical Treatment
In the event of illness or injury, I authorize In Movement Dance LLC and its staff to secure emergency medical care, including ambulance transport, hospitalization, surgery, or other medical intervention, as deemed necessary. I understand and agree that I am financially responsible for any associated medical costs.

6. Insurance and Medical Fitness
I understand that In Movement Dance LLC does not provide medical or accident insurance. It is my responsibility to obtain and maintain appropriate personal health coverage. I certify that the participant is physically and medically fit to engage in dance activities.

7. Dispute Resolution Clause
In the event of any dispute arising out of or relating to this agreement or the participant's involvement with In Movement Dance LLC, both parties agree to submit the matter to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction where In Movement Dance LLC operates. The decision of the arbitrator shall be final and binding on all parties.

8. Data Protection and Privacy
I consent to the collection, use, and secure storage of personal and medical information as necessary for participation in studio activities. I acknowledge and accept In Movement Dance LLC's privacy policy and understand that my information will be used responsibly and not shared outside the organization except as required by law or in medical emergencies.

9. Amendments and Notification
In Movement Dance LLC reserves the right to amend this agreement and any related policies at its discretion. Any significant updates will be communicated in writing via email or posted notice at the studio and on official digital platforms. Continued participation constitutes acceptance of the revised terms.

10. Code of Conduct
I agree to adhere to all rules, regulations, and behavioral expectations established by In Movement Dance LLC. I will foster a respectful, inclusive, and safe environment for all participants, staff, and community members. Any violation may result in dismissal from the program without refund.

11. Limitation of Liability
To the fullest extent permitted by law, any liability of In Movement Dance LLC shall be limited to the amount of tuition or fees paid for the program during the 12-month period preceding the claim. This limitation does not apply to liability resulting from gross negligence or willful misconduct, where prohibited by law.

12. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Parental Responsibility (if participant is a minor)
I, the parent or legal guardian of the minor participant, accept full responsibility for the child’s behavior, safety, and adherence to studio policies. I confirm that I have the legal authority to sign this agreement on behalf of the minor and consent to all terms stated herein.
