It Factor Dance Academy
Waiver and Release of Liability:
1. Assumption of Risk
I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to, physical injury, illness (including pandemics), property damage, accidents, and natural disasters. These risks may arise from my own actions or inactions, the actions or inactions of others, or from the condition of the facilities or equipment used.
I certify that I am physically fit, have sufficiently prepared or trained for participation, and have not been advised against participation by a qualified medical professional. I further certify that I do not have any health-related conditions or problems that would prevent my safe participation in these Activities.
2. Waiver and Release
I hereby voluntarily release, waive, discharge, and hold harmless It Factor Dance Academy, its owners, directors, officers, managers, employees, contractors, volunteers, agents, representatives, and any sponsors or venue hosts from any and all liability, claims, demands, causes of action, or expenses (including attorneys’ fees) arising out of or related to any loss, damage, injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the releasees or otherwise, while participating in or traveling to or from any of the Activities.
It Factor Dance Academy is not liable for any lost or stolen items at any time or location.
3. Indemnification
I agree to indemnify, defend, and hold harmless the releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the Activities and to reimburse them for any such expenses incurred.
4. Severability and Broad Construction
I expressly agree that this waiver and release of liability is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect.
5. Acknowledgment of Understanding
I have read this waiver of liability, assumption of risk, and indemnity agreement, and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
I accept this on behalf of myself or my minor child(ren) who is under the age of 18.
