RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT FOR FLORIDA TEAM CHEER GATORS
1. ASSUMPTION OF RISK I, the undersigned participant (or parent/guardian if participant is under 18), understand that cheerleading, tumbling, stunting, and related activities involve inherent risks, including but not limited to falls, collisions, improper landings, and physical exertion, which could result in serious injury, paralysis, or even death. I voluntarily choose to participate (or allow my child to participate) in activities at Florida Team Cheer, fully assuming all risks, whether known or unknown.
2. RELEASE AND WAIVER OF LIABILITY To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Florida Team Cheer, its owners, officers, employees, coaches, agents, insurers, and representatives (collectively “Released Parties”) from any and all claims, liabilities, damages, or causes of action arising from injury, illness, death, or loss of personal property occurring during or in connection with participation in activities at Florida Team Cheer, regardless of whether such injury results from the negligence of the Released Parties.
3. INDEMNIFICATION I agree to indemnify and hold harmless the Released Parties from any and all liabilities, losses, damages, costs, and expenses (including attorney’s fees) arising from my (or my child's) participation in activities at Florida Team Cheer.
4. MEDICAL AUTHORIZATION I authorize Florida Team Cheer staff to seek emergency medical care for me (or my child) in the event of an accident or injury. I understand that I am responsible for all medical expenses incurred.
5. AGREEMENT TO FOLLOW RULES I acknowledge that Florida Team Cheer has safety rules and guidelines designed to protect participants. I agree (or agree on behalf of my child) to follow all the rules and instructions given by coaches and staff. Failure to do so may result in the removal from activities without a refund.
6. SEVERABILITY If any portion of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
7. GOVERNING LAW This agreement shall be governed by the laws of the state of Florida.
I HAVE READ AND UNDERSTAND THIS AGREEMENT, AND I VOLUNTARILY SIGN IT, KNOWING THAT IT LIMITS MY LEGAL RIGHTS.
