WAIVER AND RELEASE OF LIABILITY

By enrolling in and/or participating in classes, rehearsals, performances, camps, workshops, competitions, and other activities offered by MK Dance Academy, the participant and/or parent or legal guardian acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that participation in dance and related physical activities involves inherent risks, including but not limited to falls, collisions, muscle strains, sprains, fractures, illness, communicable diseases, property damage, and other injuries that may result from participation. I voluntarily assume all risks associated with participation in activities offered by MK Dance Academy.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I release, waive, discharge, and hold harmless MK Dance Academy and its owners, instructors, employees, contractors, agents, volunteers, and representatives from any and all claims, liabilities, demands, damages, costs, or causes of action arising out of or related to participation in any MK Dance Academy activity, including claims arising from ordinary negligence.

MEDICAL INFORMATION AND TREATMENT

I agree to inform MK Dance Academy of any medical conditions, allergies, injuries, physical limitations, or other health concerns that may affect participation. In the event of an emergency, I authorize MK Dance Academy to obtain emergency medical treatment for myself or my child if I cannot be reached. I understand that I am solely responsible for any medical expenses incurred.

PARENT/GUARDIAN CONSENT

If the participant is under the age of 18, I certify that I am the parent or legal guardian of the participant and have the authority to enter into this agreement on their behalf. I understand and agree to all terms contained herein.

PHOTO AND VIDEO RELEASE

I grant MK Dance Academy permission to photograph and/or record video of myself or my child during classes, rehearsals, performances, competitions, and studio events. I understand that these images and recordings may be used for promotional, educational, and marketing purposes, including social media, websites, print materials, and other studio publications, without compensation.

By registering for classes, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Waiver and Release of Liability.

PHOTO AND VIDEO RELEASE

I grant MK Dance Academy permission to photograph and/or record video of myself or my child during classes, rehearsals, performances, competitions, and studio events. I understand that these images and recordings may be used for promotional, educational, and marketing purposes, including social media, websites, print materials, and other studio publications, without compensation.

If I do not wish for myself or my child to be photographed or recorded, I understand that it is my responsibility to notify MK Dance Academy in writing and update my media permissions within the Parent Portal. Failure to provide written notice and update Parent Portal settings will be considered consent for the use of photographs and video recordings as described above.

PRIVACY POLICY

MK Dance Academy is committed to protecting the privacy and security of our students and families. By registering for classes, participating in studio activities, or providing personal information to MK Dance Academy, you acknowledge and agree to the following:

• We collect and maintain personal information necessary for enrollment, billing, communication, class placement, emergency contact purposes, and the operation of studio programs and events.

• Personal information may include names, addresses, phone numbers, email addresses, emergency contacts, payment information, and other information voluntarily provided by parents or participants.

• We take reasonable measures to protect personal information from unauthorized access, disclosure, alteration, or destruction.

• MK Dance Academy does not sell, rent, or share personal information with third parties except as necessary to process payments, operate studio management software, respond to emergencies, or comply with legal obligations.

• Photographs and videos are governed by the studio's Photo and Video Release policy. Families who wish to opt out of photo and video usage must notify the studio in writing and update their media permissions in the Parent Portal.

• Families may update or correct their contact information and communication preferences through the Parent Portal or by contacting the studio.

• Families may opt out of promotional emails and newsletters at any time; however, enrollment-related communications, billing notices, schedule updates, and other important studio communications may still be sent as necessary.

• Electronic Communications: By enrolling at MK Dance Academy, you consent to receive communications via email, text message, phone call, and the Parent Portal regarding studio operations, billing, schedules, events, and other important information.

MK Dance Academy reserves the right to update this Privacy Policy as needed. Continued participation in studio activities constitutes acceptance of any updated policies.

By registering for classes or participating in MK Dance Academy activities, you acknowledge that you have read, understand, and agree to this Privacy Policy.

REGISTRATION FEE

A non-refundable registration fee of $40 is due upon registration for the first dancer. Additional dancers from the same family will incur a $40 registration fee per dancer, with a maximum family registration fee of $80. Registration for the Fall/Spring season is valid from mid-August through mid-May.

TUITION

Enrollment at MK Dance Academy is for the full dance season, which runs from mid-August through mid-May. Annual tuition is based on 36 weeks of instruction and is divided into 10 equal monthly installments for your convenience. Tuition is non-refundable, non-transferable, and will not be prorated for missed classes, holidays, partial attendance, or withdrawal from the program. Monthly tuition remains the same regardless of the number of class days in a given month. Returned checks due to insufficient funds will incur a $35 fee.

MONTHLY INSTALLMENTS

Tuition is automatically billed on the 25th of each month for the upcoming month's classes. Tuition may be paid by cash, check, credit card, or debit card. All families are required to maintain a valid payment method on file. Accounts with unpaid balances after the 1st of the month may incur late fees and/or result in restricted class participation.

CARD PROCESSING FEES

To help offset rising credit card processing costs while keeping tuition rates as affordable as possible, certain credit card transactions may be subject to a processing surcharge. Tuition and account charges paid through Dance Studio Pro may incur a surcharge of up to 1.5% on eligible credit card transactions. In-person credit card purchases, including studio merchandise and other retail items, may incur a surcharge of up to 4%. Debit card, cash, and check payments are not subject to a surcharge. Any applicable surcharge will be disclosed at the time of payment.

REFERRAL CREDIT

Current active students will receive a $20 account credit for each new student they refer who registers and enrolls in classes at MK Dance Academy.

END OF SEASON SHOWCASE

Our annual Showcase is typically held in May and includes a mandatory dress rehearsal prior to the performance. Showcase dates, venue information, rehearsal schedules, and ticket sales details will be announced during the season.

COSTUMES

Showcase costumes are billed at $110 per costume. A $55 costume deposit is due August 1 along with August tuition. The remaining $55 balance is due during the first week of classes in January.

Costumes will not be distributed until all costume balances have been paid in full.

If a dancer withdraws from the program and written notice is provided prior to November 1, the costume deposit will be fully refunded. If written notice is received on or after November 1, the costume deposit will be refunded less a $15 per costume restocking fee.

LATE FEES

Any account with a declined payment that remains unpaid after the 1st of the month will automatically incur a $35 late fee.

FAILED PAYMENT POLICY

If a scheduled payment is declined, the account holder is responsible for updating payment information promptly. Any fees assessed by the family's financial institution are the responsibility of the account holder.

DROP A CLASS / WITHDRAWAL

Written notice of withdrawal must be received by the 5th day of the month preceding the month in which classes will be discontinued. For example, to withdraw effective December 1, notice must be received by November 5.

Accounts that do not provide notice by the required deadline will be responsible for the following month's tuition. Tuition payments are non-refundable and non-transferable. Costume refunds are subject to the Costume Policy outlined above.

MAKEUP CLASSES

Students who miss class due to illness or injury may attend a makeup class with studio approval. Makeup classes must be completed within 30 days of the missed class and are subject to class availability. Missed classes do not qualify for tuition credits, refunds, or prorated tuition. Please contact the studio for assistance in scheduling a makeup class.
