Treehouse Dance Project Enrollment Agreement, Liability Waiver & Release
For registered students, students taking a trial class, students taking virtual classes, those individuals or groups renting studio space, or those individuals participating in any activity located at or in connection with Treehouse Dance Project, LLC (collectively and individually referred to herein as 'Participant' ): As a Participant or the parent or guardian of a Participant, I hereby grant permission for Participant to participate in activities and or in connection with Treehouse Dance Project. I recognize and acknowledge that there are certain risks of personal injury, llness or death and/or property loss or damage and I agree to assume full risk of any such injuries, illness or damage and any costs and expenses associated therewith, which may be sustained as a result of participation in any activities at or in connection with Treehouse Dance Project, LLC . I hereby waive and release any and all claims against Treehouse Dance Project and its employees, owners, members, and investors including without limitation any claims arising from personal injury, illness (including without limitation death and exposure to contagious diseases), and property damage. I acknowledge the contagious nature of COVID-19 and any other contagious diseases or illnesses and viruses and voluntarily assume the risks that Participant may be exposed to or infected by such diseases by participation. I, for myself and my spouse (if applicable), and on behalf of Participant, hereby release and agree to hold harmless, indemnify and defend Treehouse Dance Project, its employees, owners, investors, and lessors, from and against any and all claims and liability, whether caused by the negligence of Treehouse Dance Project or otherwise with respect to any and all personal injury, including death and property damage, and including attorney fees and costs, whether arising from the negligence of Treehouse Dance Project or otherwise, to the fullest extent permitted by law.
We will do our best as instructors and fellow dancers to protect your dancers from harm and teach dance in a way that is sustainable and safe for dancers' bodies and minds. Our priority is to keep dancers safe in class and provide the tools for dancers to build safe and strong dancing bodies. We understand that accidents do happen when dancers put their bodies at risk through training and performance.
Treehouse Dance Project reserves the right to switch to virtual classes in the event it or public officials determine it is unsafe to conduct in-person classes. In such case, tuition will remain the same for the duration of the dance season.
The Participant or, if a minor, I as their parent(s) or guardian(s) agree to indemnify and to hold harmless Treehouse Dance Project and its instructors, from and against any and all liabilities, claims, events, damages, costs or expenses, whether in law or equity, known or unknown, incurred by Treehouse Dance Project and arising out of or in any way related, directly or indirectly, to participation in any activities at or in connection with Treehouse Dance Project.
As the parent or guardian, I hereby give permission to the rights of the Participant's image, likeness, and sound of their voice as recorded on audio or video tape without
payment or any other consideration. I understand that participants image may be edited, copied, exhibited, distributed, and published and I waive the right to royalties or other compensation arising or related to the use of such recording or image. I understand that this permission allows Treehouse Dance Project and its agents to use video or photographic recordings of the participant and they may be displayed via the internet or a public setting.
As instructors and mentors, we will prioritize dancer safety when displaying photos of children at Treehouse Dance Project on social media. Our goal is to share our community through marketing without inappropriate or harmful exposure of dancers. We prioritize appropriate representation of dancers online and through social media.
Medical Information/Emergencies
The undersigned permits Treehouse Dance Project, its employees and owners to seek medical treatment for the Participant in the event they are not able to reach a parent or guardian. I hereby declare the Participant to be in good physical and mental health.
Tuition Payments & Late Fees
I understand tuition fees are based on an annual tuition divided between 9 equal monthly payments, and that the first month's tuition is due at the time of registration. The tuition price per month is the same and not determined by the number of classes held in the month. The parent or guardian who registers the Participant is responsible for payments and requirements set forth by Treehouse Dance Project. I understand tuition payments are non-refundable and due on the tenth of every month. A $15.00 late fee will be added to accounts with a balance due 30 days after the tuition due date. A late fee will be applied every 30 days until the account is up to date. You will receive notice of unpaid fees prior to any collection action. If there no payment is received, your account will be sent to a collection agency. You will be responsible for the unpaid balance on your account in addition to any collection or attorney fees. I hereby authorize Treehouse Dance Project to send my account to collections in the event I have any unpaid tuition or other fees. You will be charged $30.00 for any returned checks.
In the event that more than one regularly scheduled class is cancelled within the duration of a season due to inclement weather or other unforeseen circumstances, Treehouse Dance Project will refund the Participant on an hourly basis of $12 per hour of class cancelled. If the Participant is absent from a regularly scheduled class for any reason, a refund or deduction of tuition will not be given. If the Participant sustains an injury, determining them unable to dance for the remainder of a season, any further tuition will be waived for the remainder of the season. All outstanding balances up to the date of injury must be paid. Any competition fees, costume fees, or one-time fees will not be refunded. If the Participant sustains a temporary injury (lasting no longer than 6-weeks), tuition will not be refunded, and the Participant may continue to attend class.
Each weekly class is allotted one cancellation within the duration of the regularly scheduled season. Cancellation may occur for inclement weather, teacher illness, or other unforeseen circumstances. For instance, if Ballet 1 is cancelled due to inclement weather, the class will not be refunded or rescheduled. If Ballet 1 is cancelled for a second occurrence, the refund policy will apply. Treehouse Dance Project will prioritize designating substitute teachers in the event of teacher illness before class cancellation would occur. Class cancellation will only occur if necessary, and Treehouse Dance Project will do everything in its power to continue to hold regularly scheduled classes.
To participate in the Holiday or Spring Recitals, Participants accounts must be paid in full.
There is an annual registration fee of $10.00 per student, maximum $20.00 per family, which is due at the time of registration and is non-refundable.
Important: A 3.5% surcharge is added to your tuition fee if paying via debit/credit card. This amount is billed separately from your tuition amount. Checking account ACH payments will include a 1.5% surcharge per transaction.
There are NO REFUNDS on paid tuition or deductions for classes missed. To withdraw from a class, a 30-day notice is required via email to treehousedanceproject@gmail.com
or in writing and delivered in person. If a student withdraws mid-month, tuition is due for that entire month, regardless of the day of withdrawal.
Electronic Signature Agreement.
By selecting the "I agree to terms and conditions" checkbox, I am signing this agreement electronically. I agree this electronic signature is the legal equivalent of my manual signature on this agreement.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
