PARTICIPANT WAIVER: By registering for a class, and in consideration of acceptance of enrollment, you hereby for yourself, your heirs, executors and administrators, waive and release any and all rights and claims for damages you or your child may have against Ballet Wooster and its representatives, successors and assigns for any and all injuries suffered by yourself or your child during any activity sponsored by the groups. You do hereby grant and give these groups the right to use your or your child's photograph or image with or without your or your child's name, both single and in conjunction with other persons or objects, for any and all purposes including, but not limited to private or public presentations, advertising, publicity and promotion relating thereto.
ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19: Ballet Wooster cannot guarantee that you or your child will not become infected with COVID-19. Further, attending classes at Ballet Wooster could increase your risk and your child's risk of contracting COVID-19. Further, if I choose to wait in the waiting area at the studio, I understand and assume the risk that doing so may involve a risk of contracting COVID-19 both for myself, and for any children or minors in my care who are present with me in the waiting room area. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child and I may be exposed to or infected by COVID-19 by attending Ballet Wooster and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Ballet Wooster may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Ballet Wooster employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child may experience or incur in connection with my child's attendance at Ballet Wooster or participation in programs. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Ballet Wooster, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Ballet Wooster, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Ballet Wooster program.
PAYMENT: I understand that by submitting this form I agree to submit payment according to Ballet Wooster for the total amount of all classes for each student registering minus any discounts. All tuition fees and performance fees must be paid before the first class of the season. If tuition is not received before the first day of class, I understand that my spot may be forfeited. Payment plans may be available at the discretion of the Artistic Director and Board of Directors.
Students with unpaid balances will not be able to register for classes until all previous semesters have been paid in full. In addition, any student with an outstanding balance will not be invited to perform in annual or biannual studio productions. A community role may be offered, if available. Communications regarding unpaid balances may come from the Board of Directors, and by registering for classes, you are agreeing to receive messages about your balance.
SIGNATURE: By my electronic signature below, I agree that I have read all the terms, conditions, waivers, and assumptions of risks herein set forth. I agree to read the Ballet Wooster Handbook and abide by all rules, regulations, attendance policies, dress codes, and more. I understand and agree to be bound by those terms, conditions, waivers, and assumptions of risk on behalf of myself, my child(ren), and my heirs and assigns.
