1. Purpose
1.1. This policy sets out the commitment of The Sef Group Pty Ltd, trading as Bays All Stars, Kinetic Dance Force and Dance Unite Online (together, “the studio,” “we,” “us,” or “our”), to safeguarding all children and young people who take part in our classes, rehearsals, competitions, events, and online programs.
2. Commitment to Child Safety
2.1. Child safety is embedded in our everyday thinking and decision-making, not treated as a separate compliance exercise. It guides how we run classes, cast teams, manage competitions and travel, and communicate online.
2.2. All children who attend our studio, our events, or our online classes have a right to feel and be safe. We do not permit or tolerate child abuse, neglect or exploitation in any form.
2.3. Our priority is the welfare and safety of every dancer, tumbler and cheerleader who has contact with our teachers, coaches, choreographers, contractors and volunteers. We are committed to the cultural safety of First Nations children, children from culturally and linguistically diverse backgrounds, LGBTQIA+ children, children with disability, and their families.
2.4. This commitment extends to contractors and suppliers who provide services involving children on our behalf, including guest choreographers, photographers, videographers, costume fitters, and competition organisers. Where we engage such contractors, we expect them to demonstrate their own commitment to child safety.
3. Definitions
3.1. Child / young person: a person under the age of 18, consistent with the UN Convention on the Rights of the Child.
3.2. Child-related work: work or volunteering where contact with children is a normal and expected part of the role (not occasional or incidental) this includes all of our teaching, coaching, choreography, front-of-house, competition chaperone, and online tutoring roles.
3.3. Risk of significant harm: the NSW legal threshold that triggers a duty to report to the Department of Communities and Justice (DCJ). Note that in NSW this reporting duty specifically concerns children up to the age of 16, although our own commitment to safety in this policy applies to everyone under 18.
3.4. A full glossary of safeguarding terms (abuse, grooming, exploitation, cultural safety, etc.) is available on request from the Child Safety Officer.
4. Scope
4.1. This policy applies to everyone who works, teaches, coaches, choreographs, volunteers, or contracts for The Sef Group Pty Ltd under any of its trading names including the Director, employed and casual staff, contractors, guest teachers, volunteers (including parent helpers and team managers), and work experience participants.
4.2. It applies across all our operations and locations: our Double Bay studio, competition and event venues, rehearsal and travel arrangements (including interstate and overseas competition trips), and our online programs delivered through Dance Unite Online.
4.3. It applies to all interactions with children connected to a person’s role with us, including during class hours, outside normal hours, at competitions, during transport, in change rooms and costuming areas, and on digital platforms and social media.
4.4. Compliance with this policy is a condition of engagement with the studio, whether paid or voluntary. Breach may result in disciplinary action, termination of engagement, and/or reporting to external authorities including NSW Police or the Office of the Children’s Guardian.
5. Governance and Accountability
Bays All Stars is a small, owner-operated business. The following table sets out who is responsible for each aspect of child safety.
Policy development, approval and review - Sophia Franzini, Director (Child Safety Officer)
Recruitment, screening and Working with Children Checks - Sophia Franzini, Director
Staff/contractor induction, training and supervision - Sophia Franzini, Director, and any appointed Studio/Program Coordinator
Receiving and responding to concerns, complaints and disclosures - Sophia Franzini, Director (Child Safety Officer)
Risk assessment and management - Sophia Franzini, Director
External reporting, record-keeping and information sharing - Sophia Franzini, Director
5.2. Because the Director also holds the Child Safety Officer role, anyone with a concern about the Director’s own conduct should instead contact NSW Police (000 in an emergency), the Child Protection Helpline (132 111), or the Office of the Children’s Guardian directly. See Section 12.
5.3. As the studio grows, we will appoint a deputy Child Safety Officer so there is always more than one internal contact point for concerns.
6. National Principles and NSW Child Safe Standards
6.1. We follow the ten National Principles for Child Safe Organisations, which provide a nationally consistent approach to child safety and wellbeing (see childsafe.humanrights.gov.au).
6.2. As a provider of sport, recreation and performing arts activities for children in New South Wales, we are also subject to the NSW Child Safe Standards under the Children’s Guardian Act 2019 (NSW) and the Child Safe Scheme administered by the Office of the Children’s Guardian (OCG). Sport and recreation organisations providing services to children have been required to implement these standards since 1 February 2022, and the OCG has held powers to enforce compliance since 1 February 2023.
6.3. The NSW Child Safe Standards are:
(1) Child safety is embedded in leadership, governance and culture;
(2) Children participate in decisions affecting them and are taken seriously;
(3) Families and communities are informed and involved;
(4) Equity is upheld and diverse needs are taken into account;
(5) People working with children are suitable and supported;
(6) Processes to respond to complaints and concerns are child-focused;
(7) Staff and volunteers are equipped with the knowledge, skills and awareness to keep children safe;
(8) Physical and online environments minimise the opportunity for harm;
(9) Implementation of the Child Safe Standards is regularly reviewed;
(10) Policies and procedures document how the organisation is safe for children.
7. Recruitment and Screening
7.1. Everyone engaged in child-related work with us (employed, casual, contracted or volunteer) must hold and maintain a valid NSW Working with Children Check (WWCC) issued by the Office of the Children’s Guardian before starting, and for the duration of their engagement.
7.2. WWCCs are verified using the OCG’s free online Verification Tool before engagement, and re-verified periodically, in line with NSW requirements for organisations to keep verified records.
7.3. Recruitment for any role involving contact with children includes reference checks that specifically ask about past conduct with children, and interview questions relating to child safety.
8. Code of Conduct
8.1. Our separate Safeguarding Children and Young People Code of Conduct sets out the standards of behaviour expected of everyone who works or volunteers with us, including acceptable and unacceptable behaviours specific to a dance, acrobatics and cheerleading environment (for example, spotting and physical contact during skills training, costuming and change room supervision, and photography/video of routines). All staff, contractors and volunteers must read, understand and sign the Code of Conduct.
9. Training
9.1. All staff, contractors and volunteers complete a child safety induction before starting work, covering this policy, the Code of Conduct, and how to recognise and respond to concerns.
9.2. All staff complete training on recognising indicators of abuse and neglect, and on their reporting obligations, on commencement and periodically thereafter.
10. Physical and Online Environments
10.1. Studio and change rooms: change room and costuming supervision follows a “two-adult” or “in view” rule wherever practical, one-on-one, closed-door interactions between an adult and a child are avoided unless another adult is present or the interaction is clearly visible (e.g. through a window or open door).
10.2. Spotting and physical contact: acrobatics, tumbling and cheerleading skills training necessarily involves physical contact for spotting and technique correction. This contact must always be limited to what is required for the skill, explained to the dancer beforehand, appropriate to their age, and conducted in view of other staff, dancers or parents. Contact that is not required for a specific skill is not appropriate.
10.3. Private lessons: one-on-one coaching sessions require prior parental consent and must take place in a space visible to others (e.g. through a studio window or with the door open), or with another adult present.
10.4. Photography, video and social media: photos and videos of dancers are only taken, stored or shared with prior written parental consent, using studio-approved equipment and accounts, and in line with our Photography and Social Media Consent process. Personal devices are not used to photograph or film students except where expressly authorised.
10.5. Online classes and communication (Dance Unite Online): online classes are conducted through studio-approved platforms only, with a parent or another adult able to be present, and recordings/chat logs retained in line with our record-keeping obligations. Staff do not contact students directly through personal phone numbers, social media, or messaging apps. All communication with students under 18 is through studio channels or copies parents/carers.
10.6. Competitions and travel: transport and supervision arrangements for competitions, including interstate and overseas travel, are risk-assessed in advance, with clear supervision ratios and emergency contact procedures communicated to parents.
11. Risk Management
11.1. We conduct a child safety risk assessment of our studio, competition and travel arrangements, and online programs at least annually, and after any significant change to our operations (for example, a new venue, a new travel destination, or a new online program).
12. Complaints, Concerns and Disclosures
12.1. Full detail is set out in our separate Complaints Handling Procedure. In summary, if a disclosure or concern is raised, our staff will:
- Listen: without interrupting or promising confidentiality they can’t guarantee; Reassure — the child that they did the right thing and it is not their fault;
- Respect: the child’s privacy, sharing information only on a need-to-know basis; Report internally — to the Child Safety Officer as soon as possible; and
- Report externally, where required by law or where the child’s safety requires it.
12.2. If there is an immediate risk to a child’s safety, call NSW Police on 000.
12.3. For non-emergency concerns that a child may be at risk of significant harm, report to the NSW Child Protection Helpline on 132 111 (24 hours, 7 days).
13. Reporting Obligations
13.1. Under the Children and Young Persons (Care and Protection) Act 1998 (NSW), people in certain listed professions (for example teachers, doctors, nurses, police, and some children’s services roles) are mandatory reporters, legally required to report suspected risk of significant harm to a child under 16 to the Child Protection Helpline. Dance, acrobatics and cheerleading instructors are not automatically included in this list unless they also hold one of the listed roles.
13.2. Regardless of whether a particular staff member is a mandatory reporter, everyone engaged by the studio is required by this policy to report any concern, suspicion, disclosure or allegation of harm involving a child to the Child Safety Officer immediately, and to NSW Police or the Child Protection Helpline where the concern meets the threshold above.
13.3. Under the Crimes Act 1900 (NSW), it is a criminal offence for an adult not to report to police if they know, believe, or reasonably ought to know that a child abuse offence has been committed (section 316A). It is also an offence for a person in child-related work to fail to reduce or remove a known risk of a child becoming a victim of abuse (section 43B).
13.4. Reportable Conduct Scheme: certain organisations (“relevant entities” currently government departments, non-government schools, religious bodies, out-of-home care agencies and specified health services) have additional legal obligations under the Reportable Conduct Scheme, administered by the Office of the Children’s Guardian under the Children’s Guardian Act 2019 (NSW). Bays All Stars is not currently a relevant entity under this scheme; however, amendments to the Act commencing October 2026 are expected to broaden its scope. We will monitor OCG guidance and adopt any new obligations that apply to us, and in the meantime we apply the same standard of prompt internal notification and thorough investigation to any reportable-conduct-type allegation as a matter of best practice.
14. Allegations Against a Team Member
14.1. All allegations against staff, contractors or volunteers are taken seriously and handled in line with this policy and relevant legislation. The safety of children is paramount while any allegation is investigated. This may include temporarily varying or suspending a person’s duties pending the outcome.
15. Record Keeping and Privacy
15.1. Records relating to child safety concerns, disclosures, WWCC verification and training are kept securely, confidentially, and in line with the Privacy Act 1988 (Cth) and NSW record-keeping requirements, for the periods required by law.
