**TERMS AND CONDITIONS OF ENROLLMENT**
PAYMENT/ENROLLMENT AGREEMENT - I/We agree to make full tuition payments through the end of Session 4 (May), unless notification of intent to cancel is made two weeks prior of the new session starting. I understand that this is to be done by completing the Drop-Class Form. I also agree to pay a $10 late fee if full payment is not made or if payment doesn’t clear BEFORE the start of the 6th week of each session.
CERTIFICATION OF AUTHORITY - I/We, the undersigned, hereby warrant that I/we are the custodial parent(s) and/or lawful guardian(s) of the above-named minor child and have lawful authority to make and execute this agreement for myself/ourselves and for and in behalf of the above-named minor child.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISK - I/We hereby acknowledge that I/We are aware that the above-named will be engaging in physical exercise and activities involving various gymnastics and acrobatic equipment and facilities, coordination events, fitness training, and sports which could cause inherent risks including, but not limited to injury, exposure to COVID-19, partial or total paralysis, and death. Such injury(s) may be caused by above-named’s actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or negligence; and that there may be other risks either not known to me or not readily foreseeable at this time: and I fully accept and assume all such risks and all responsibility for losses, cost, and damages incurred.
WAIVER AND RELEASE - I/We hereby waive any and all liability and claims, past, present, or future, known or unknown or any kind or nature, for personal injury (including death) or exposure to COVID-19 arising out of or connected with the hereinabove-named minor’s participation at AirBound Tumbling and Cheer, LLC’s facilities (or elsewhere under AirBound Tumbling and Cheer, LLC control or supervision), I/We hereby release AirBound Tumbling and Cheer, LLC, it’s officers, directors, agents, and employees from any and all such claims and liability.
INDEMNIFICATION - I/We hereby covenant and agree to hold harmless and indemnify AirBound Tumbling and Cheer, LLC, it’s officers, directors, agents, and employees hereof made by or on behalf of any person or legal entity, including court costs, expert witness fees, and reasonable fees.
ACKNOWLDEGMENT OF NO PHYSICAL EVALUATION - AirBound Tumbling and Cheer, LLC will make no evaluation or recommendation as to whether or not the hereinabove-named minor is physically fit of any exercise activity, and that if such minor has any physical condition that may impact upon his/her ability to engage in these activities, and/or which condition may be aggravated or exacerbated by these activities, It is my/our responsibility to obtain a physician’s statement describing any limitation to participate in the programs, activities, and /or to make use of the equipment and facilities. I/We acknowledge that it is always advisable to consult with a physician prior to allowing said minor to undertake any physical exercise program.
RULES AND REGULATIONS - All students, parents, relatives and guardians agree to abide by the rules and regulations set by AirBound Tumbling and Cheer, LLC for the health, safety and welfare of the students. AirBound Tumbling and Cheer, LLC reserves the right to dismiss any student whose conduct or influence is deemed unsatisfactory without refund.
INSURANCE NOTIFICATION - Student is required to have personal insurance coverage, which covers cost for accidents or injuries. In addition, in case of medical emergency, I hereby give permission to AirBound Tumbling and Cheer, LLC, via my signature to secure proper medical treatment for the student listed above.
**COVID-19 RELEASE**
COVID-19 has affected our lives, especially this industry. Moving forward, we will be taking some precautionary steps. If registering for our classes this fall, you and your athlete must be willing to comply with the following new polices:
1) Each athlete is allowed ONE adult spectator. (As a mother, I understand this is difficult, but I want to keep everyone safe and healthy...as best as I can!)
2) The spectator agrees to use hand sanitizer upon entering the building.
3) Do not bring your child to class if you or your child is sick.
4) Please make sure your child washes their hands with soap and water before class.
5) Each child MUST be picked up promptly following their class. We have allotted 5 mins for transitions so that there are not too many people in the facility at once. When your child is finished we ask that you leave immediately.
By clicking below, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by participating in athletics and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at AirBound Tumbling and Cheer, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, AirBound Tumbling and Cheer, LLC employees, volunteers, and program participants and their families.
​I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at AirBound Tumbling and Cheer, LLC facility or events. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless AirBound Tumbling and Cheer, LLC, its employees, agents, and representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of AirBound Tumbling and Cheer, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any AirBound Tumbling and Cheer, LLC classes or events.
By signing below I (Student (if 18 years of age), Parent or Guardian) irrevocably state that I fully understand the terms and conditions set forth above by AirBound Tumbling and Cheer, LLC and agree with the terms and conditions stated in this agreement.ÂÂ
