PARTICIPANT WAIVER, RELEASE & AGREEMENT

Welcome to Kootenay DanceWorks.

Kootenay DanceWorks is operated by Renée Salsiccioli as a sole proprietorship. In this agreement, “Kootenay DanceWorks” and “KDW” refer to Kootenay DanceWorks and its sole proprietor, Renée Salsiccioli.

Please read the following carefully before enrolling yourself or your child in our programs. By accepting this agreement, you acknowledge that you have read, understood and agree to the terms below for yourself or, where applicable, on behalf of your participating child.

ASSUMPTION OF RISK

I understand that dance and physical movement are physical activities and that participation in classes, conditioning, stretching, rehearsals, workshops, productions, performances, festivals and other Kootenay DanceWorks activities involves inherent and ordinary risks.

These risks may include, but are not limited to, physical exertion, fatigue, slips, trips, falls, collisions, contact with other participants, equipment or surroundings, muscle strains, sprains, fractures and other minor or serious injuries associated with physical activity.

I also understand that accidental injuries may occur while participating in or attending KDW activities, including while entering, exiting or moving through studios, theatres, backstage areas, dressing rooms, hallways, waiting areas and other facilities used for KDW activities.

I voluntarily accept the inherent and ordinary risks associated with participation in Kootenay DanceWorks programs and activities.

PARTICIPANT RESPONSIBILITY

Participants are expected to follow the reasonable instructions and safety guidelines provided by Kootenay DanceWorks teachers and staff and to use studio and venue facilities and equipment appropriately.

Parents/guardians and adult participants are responsible for informing Kootenay DanceWorks of any injury, severe allergy, physical limitation, medical condition or other relevant information that may reasonably affect safe participation.

Parents/guardians are responsible for ensuring that information relevant to their child's safe participation is accurate and kept reasonably current.

PHYSICAL CONTACT & HANDS-ON INSTRUCTION

I understand that dance instruction may involve appropriate physical contact between instructors and participants as part of teaching and safe participation.

Kootenay DanceWorks instructors may use appropriate hands-on guidance to assist with posture, placement, alignment, muscle engagement, movement correction, stretching, partnering, or safety and spotting where appropriate.

Participants are encouraged to communicate with their instructor if they are uncomfortable with physical contact or require an alternative approach to a correction or exercise.

HEALTH & ILLNESS

Parents/guardians and adult participants are responsible for determining whether they or their child are well enough to participate in Kootenay DanceWorks activities.

Participants should not attend classes, rehearsals, performances or other KDW activities when illness may affect their ability to participate safely or may reasonably pose a risk to other participants or staff.

Parents/guardians and adult participants are responsible for advising Kootenay DanceWorks of relevant health or medical information that staff may reasonably need to know to support safe participation.

If a participant becomes ill, injured or is otherwise unable to participate safely during a KDW activity, a parent/guardian or emergency contact may be contacted and asked to pick up the participant.

WAIVER & RELEASE OF LIABILITY

I understand and voluntarily accept the inherent and ordinary risks associated with participation in Kootenay DanceWorks activities.

To the extent permitted by law, I release and hold harmless Kootenay DanceWorks and Renée Salsiccioli, as sole proprietor, together with KDW instructors, employees, contractors, substitutes, guest teachers and representatives, from claims for injury, loss or damage arising from the inherent and ordinary risks associated with participation in Kootenay DanceWorks activities.

Nothing in this agreement is intended to exclude or limit any responsibility or duty that cannot lawfully be excluded or limited.

ACTIVITIES & LOCATIONS COVERED

This agreement applies to participation in Kootenay DanceWorks classes, conditioning, rehearsals, workshops, productions, performances, dance festivals, community events, in-studio performances, parent observation days and other KDW-organized or sanctioned activities.

Activities may take place at the regular Kootenay DanceWorks studio or at theatres, festivals, other studios, community facilities and other off-site venues.

Participants are expected to follow applicable KDW guidelines as well as the reasonable rules and safety requirements of any facility, festival or organization hosting an activity.

EMERGENCY MEDICAL ASSISTANCE

In the event of an injury, illness or medical emergency, I authorize Kootenay DanceWorks staff to contact 911 or emergency medical services when reasonably deemed necessary.

Kootenay DanceWorks will make reasonable efforts to contact the participant's parent/guardian or emergency contact as soon as reasonably possible.

I understand that parents/guardians and adult participants are responsible for ambulance, hospital, medical and other costs associated with emergency assistance or treatment.

DROP-OFF, PICKUP & SUPERVISION

For minor participants, parents/guardians are responsible for arranging safe and timely transportation to and from classes, rehearsals, workshops, performances, festivals and other KDW activities.

Parents/guardians are responsible for ensuring that their child is appropriately supervised until the scheduled beginning of an activity and for arranging prompt pickup following the scheduled end of the activity.

If someone other than the child's parent/guardian or usual authorized pickup person will be responsible for picking up the child, the parent/guardian is responsible for notifying Kootenay DanceWorks in advance of the alternate pickup arrangement.

Kootenay DanceWorks does not provide transportation or childcare outside scheduled program times. Parents/guardians remain responsible for making appropriate transportation and pickup arrangements for their child.

If a parent/guardian is unexpectedly delayed, they are responsible for contacting Kootenay DanceWorks as soon as reasonably possible.

Kootenay DanceWorks may require additional pickup arrangements for younger participants or in circumstances where staff reasonably consider them necessary for the participant's safety.

PERSONAL PROPERTY

Participants are responsible for their own belongings.

To the extent permitted by law, Kootenay DanceWorks is not responsible for personal property that is lost, stolen, misplaced or damaged during classes, rehearsals, performances, festivals or other KDW activities.

OFF-SITE ACTIVITIES & VENUES

I understand that participation in Kootenay DanceWorks may include activities at theatres, festivals, community events, other studios and other off-site locations.

Unless Kootenay DanceWorks specifically advises otherwise, parents/guardians remain responsible for arranging transportation to and from off-site activities and for ensuring timely drop-off and pickup.

Participation at an off-site venue may also be subject to the policies, procedures and safety requirements of that venue, festival or event organizer.

GOVERNING LAW & SEVERABILITY

This agreement is governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia.

If any provision of this agreement is determined to be invalid or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in effect.

ACKNOWLEDGMENT

I confirm that I have read and understood this Participant Waiver, Release & Agreement and voluntarily agree to its terms.

If I am accepting this agreement for a minor participant, I confirm that I am the participant's parent or legal guardian and am accepting this agreement on their behalf.

I understand that it is my responsibility to notify Kootenay DanceWorks if information relevant to the participant's safe participation changes during the season.

PHOTO, VIDEO & MEDIA CONSENT

Kootenay DanceWorks is operated by Renée Salsiccioli as a sole proprietorship. In this consent, “Kootenay DanceWorks” and “KDW” refer to Kootenay DanceWorks and its sole proprietor, Renée Salsiccioli.

By accepting this document, I—as an adult participant or as the parent/legal guardian of a minor participant—voluntarily give Kootenay DanceWorks permission to photograph, film and/or otherwise record the participant during KDW classes, rehearsals, performances, productions, workshops, festivals, community events and other studio-related activities.

SCOPE & PERMITTED USES

I give Kootenay DanceWorks permission to use authorized photographs and recordings for studio-related purposes, including but not limited to:

Digital Media: KDW's official website, email communications and social media platforms.
Marketing & Advertising: Print and digital advertising, flyers, posters, banners and promotional campaigns.
Studio Materials: Production programs, studio publications and educational, artistic or archival projects.
Publicity: Promotion of KDW classes, productions and events, including materials provided to local media for KDW-related publicity.
Commercial Products: Performance recordings, photo books, merchandise, publications or other studio-related materials or products that may be offered for purchase by dance families or the public.

Photographs and recordings may be cropped, edited, colour-corrected, formatted or otherwise adapted as reasonably required for presentation or publication.

Photographs and recordings may be created by Kootenay DanceWorks staff or by photographers, videographers or other media professionals authorized by KDW to photograph or record studio activities and events.

COMPENSATION & COMMERCIAL USE

I understand that Kootenay DanceWorks may receive revenue from the sale of recordings, publications, merchandise or other studio-related materials or products that include the participant's image, likeness or appearance.

I understand that neither the participant nor the participant's parent/guardian will be entitled to compensation, royalties or other payment arising from the authorized use of the participant's image, likeness or appearance.

PRIVACY & MINOR PARTICIPANT PROTECTION

Kootenay DanceWorks will not identify a minor participant by full name alongside their photograph or video in public promotional materials, on KDW's website or on social media without additional permission from the participant's parent or legal guardian.

I understand that photographs or recordings published online or through social media may be viewed, shared, downloaded or saved by others and that Kootenay DanceWorks cannot control their subsequent use or distribution by third parties.

PUBLIC EVENTS & THIRD-PARTY RECORDINGS

I understand that some Kootenay DanceWorks activities take place in public or semi-public settings, including theatres, festivals, community events and performances.

Kootenay DanceWorks cannot guarantee that participants will not appear incidentally in photographs or recordings made by audience members, event organizers, venues, media or other independent third parties where photography or recording is permitted.

This consent applies specifically to photography and recording undertaken or authorized by Kootenay DanceWorks and to KDW's subsequent use of those materials. It does not represent control by KDW over independent third parties.

WITHDRAWAL OF CONSENT

Providing this media consent is voluntary and is not a condition of enrolling or participating in Kootenay DanceWorks programs.

I may withdraw or modify this consent by providing reasonable written notice to Kootenay DanceWorks.

Withdrawal will apply to future photography, recording, use and disclosure by Kootenay DanceWorks in accordance with applicable privacy law.

I understand that withdrawal cannot necessarily remove or retrieve materials that were printed, published, distributed, sold or otherwise made public before consent was withdrawn. Kootenay DanceWorks also cannot control copies or materials subsequently shared, downloaded, saved or retained by independent third parties.

GOVERNING LAW

This consent is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia.

CONSENT & ACKNOWLEDGMENT

By accepting this Photo, Video & Media Consent, I confirm that:

I am 19 years of age or older and am either the adult participant or the parent/legal guardian of the minor participant; and
I have read and understood this consent, understand the purposes for which photographs and recordings may be collected and used, and voluntarily consent to the photography, recording and uses described above.

1. OUR COMMITMENT TO PRIVACY

Kootenay DanceWorks is operated by Renée Salsiccioli as a sole proprietorship. In this Privacy Policy, “Kootenay DanceWorks” and “KDW” refer to Kootenay DanceWorks and its sole proprietor, Renée Salsiccioli.

Kootenay DanceWorks respects the privacy of our students and families and is committed to protecting personal information in accordance with British Columbia's Personal Information Protection Act (PIPA) and other applicable privacy laws.

This Privacy Policy explains how KDW collects, uses, discloses, protects and retains personal information in connection with our programs and services.

By creating an account or registering for Kootenay DanceWorks programs, you acknowledge that you have been provided with and have had an opportunity to review this Privacy Policy.

2. INFORMATION WE COLLECT

Kootenay DanceWorks collects personal information reasonably necessary to administer our programs and provide services to students and families. This may include:

Contact & Family Information: Parent/guardian and participant names, mailing addresses, email addresses and telephone numbers.
Participant Information: Date of birth, age, registration, class placement and attendance information.
Health & Safety Information: Relevant medical conditions, allergies, injuries, physical limitations or other information voluntarily provided to KDW that may affect safe participation.
Financial Information: Billing, payment and transaction information necessary to administer family accounts and payments.
Emergency Contacts: Names, telephone numbers and relationships of designated emergency contacts.
Studio Communications: Information voluntarily provided through inquiries, emails and other communications, as well as administrative information relating to rehearsals, performances, productions, festivals and participant placement.

Kootenay DanceWorks aims to collect only personal information that is reasonably necessary and appropriate for the purposes for which it is collected.

3. HOW WE USE PERSONAL INFORMATION

Kootenay DanceWorks may use personal information to:

Register participants and manage classes and schedules.
Determine appropriate class placement and program eligibility.
Process and record payments, issue receipts and maintain family accounts.
Communicate schedules, closures, rehearsals, performances, events and other important studio information.
Contact parents/guardians or emergency contacts when reasonably necessary.
Support participant health and safety.
Administer rehearsals, productions, performances, festivals and other KDW activities.
Respond to questions, requests and communications.
Maintain appropriate business and accounting records.
Meet applicable legal, regulatory, insurance, tax and accounting requirements.

Kootenay DanceWorks will not collect, use or disclose personal information for purposes that a reasonable person would consider inappropriate in the circumstances.

4. SERVICE PROVIDERS & DATA PROCESSING

Kootenay DanceWorks uses third-party service providers to assist in operating the studio, including online registration and Parent Portal services, payment processing, accounting and other technology or business services.

Personal information may be processed, stored or accessed by these providers where reasonably necessary for them to provide services to KDW.

Some third-party service providers may process or store information outside British Columbia or Canada. Where this occurs, personal information may be subject to the laws of the jurisdiction in which it is processed or stored, including lawful access by courts, law enforcement or other authorities in that jurisdiction.

Kootenay DanceWorks does not sell or rent personal information.

Personal information may otherwise be disclosed with consent, where reasonably necessary to provide KDW services, or where disclosure is required or permitted by law.

5. PROTECTING PERSONAL INFORMATION

Kootenay DanceWorks takes reasonable administrative, physical and technological measures to protect personal information against unauthorized access, collection, use, disclosure, copying, modification, loss or disposal.

Access to personal information is limited to KDW staff, contractors and service providers who reasonably require it to perform their responsibilities or provide services to KDW.

If Kootenay DanceWorks becomes aware of a privacy or security breach involving personal information, KDW will take reasonable steps to assess, contain and respond to the incident and will make notifications where required by applicable law or where otherwise appropriate.

6. ACCURACY, ACCESS & CORRECTION

Kootenay DanceWorks makes reasonable efforts to ensure that personal information used to make decisions affecting participants is accurate and complete.

Parents/guardians and adult participants may request access to personal information about themselves or their child that is under KDW's control, subject to applicable legal limitations.

Individuals may also request correction of inaccurate or incomplete personal information.

Requests for access or correction should be made in writing to Kootenay DanceWorks' Privacy Officer with sufficient information to identify the individual and the information being requested or corrected.

Kootenay DanceWorks will respond to requests in accordance with applicable privacy law.

7. RETENTION & SECURE DISPOSAL

Kootenay DanceWorks retains personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected and to meet applicable business, accounting, insurance and legal requirements.

Where personal information has been used to make a decision that directly affects an individual, KDW will retain that information for at least the period required by applicable privacy law.

When personal information is no longer reasonably required, Kootenay DanceWorks will take reasonable steps to securely destroy, delete or anonymize it, as appropriate.

8. ONLINE SERVICES

Kootenay DanceWorks' website, registration platform, Parent Portal and other online services may use cookies or similar technologies for functionality, security and user experience.

Third-party platforms and service providers used by Kootenay DanceWorks may have their own privacy policies, terms and practices governing their services.

9. PHOTOGRAPHS, VIDEO & MEDIA

Photography, video recording and Kootenay DanceWorks' use of participant images are addressed separately through KDW's Photo, Video & Media Consent.

Media consent is voluntary and is not a condition of enrolling or participating in Kootenay DanceWorks programs.

10. PRIVACY OFFICER, QUESTIONS & COMPLAINTS

Renée Salsiccioli, Owner and Artistic Director, serves as the Privacy Officer responsible for overseeing Kootenay DanceWorks' privacy practices and compliance with applicable privacy legislation.

11. CHANGES TO THIS POLICY

Kootenay DanceWorks may update this Privacy Policy from time to time to reflect changes in our programs, services, business practices, technology or legal requirements.

The current version will be made available through the Kootenay DanceWorks Parent Portal, website or other appropriate means.

By creating an account or registering for Kootenay DanceWorks programs, I acknowledge that I have been provided with and have had an opportunity to review this Privacy Policy.

REGISTRATION, TUITION & WITHDRAWAL POLICY

Kootenay DanceWorks

PROGRAM COMMITMENT

Registration is a commitment to the full length of the program selected. Kootenay DanceWorks offers full-season programs, term programs and shorter sessional or specialty programs. Specific program dates and commitments are provided at registration.

For full-season and term programs, monthly billing is provided as a payment schedule for the convenience of families; it does not make registration a month-to-month or drop-in enrolment.

TUITION & DISCOUNTS

Full-season and term tuition is calculated based on a student's regular weekly training hours and divided into monthly instalments.

Caps & Discounts: Students undertaking extensive weekly training may qualify for a tuition cap. Eligible family discounts and Training Loyalty Benefits may also apply and will be reviewed and applied by Kootenay DanceWorks after registration. Discounts, tuition caps and other benefits may not be combined unless otherwise indicated.
Additional Expenses: Regular tuition covers instruction and does not include additional expenses that may apply to a dancer's participation, such as costumes, props, accessories, specialized dance attire or footwear, festival or competition entry fees, production or theatre fees, private lessons, choreography fees, specialty programs or other separately billed services. These expenses will be communicated separately where applicable.
PAYMENT DATES, METHODS & OVERDUE ACCOUNTS
Due Date: Monthly tuition instalments are due on the 1st day of each month.
Payment Methods: Kootenay DanceWorks accepts payment by e-transfer, PayPal or cash. Payment is considered received when it has been successfully received by Kootenay DanceWorks.
Late Fee: Accounts with tuition remaining unpaid at the end of the month may be subject to a $15 late administration fee.
Payment Difficulties: Families experiencing difficulty with a payment are encouraged to contact Kootenay DanceWorks as soon as possible so that appropriate arrangements can be discussed.
Overdue Accounts: Accounts that remain significantly overdue may result in temporary suspension of participation in classes, rehearsals or performances until payment arrangements have been made.
Outstanding Balances: Any unpaid tuition, fees or other amounts incurred prior to withdrawal remain payable.

REGISTRATION FEE

The annual registration fee is non-refundable once registration has been completed.

Registration fees may be waived for select short-term or specialty programs where indicated in the individual program description.

MISSED CLASSES & MAKE-UPS

There are no refunds, credits or tuition deductions for classes missed due to participant absence, illness, vacation or personal scheduling conflicts.

When space and level permit, participants may request to attend another appropriate KDW class as a make-up. Make-up classes require instructor approval, are subject to availability and are not guaranteed.

Non-attendance does not constitute withdrawal from a program. Written notice must be provided in accordance with the withdrawal policy below.

WITHDRAWAL FROM FULL-SEASON & TERM PROGRAMS

We understand that circumstances sometimes change.

Withdrawal from a full-season or term program requires written notice, including by email, to Kootenay DanceWorks.

Following written notice, one additional monthly tuition instalment is payable. Regular tuition obligations for the withdrawn class end after that final instalment.

Example: If written notice is provided during October, the November tuition instalment remains payable. No regular tuition for the withdrawn class will be due beginning December 1.

There is no additional cancellation fee when proper notice is provided.

Withdrawal does not refund or cancel expenses already incurred or committed on behalf of the participant. Costume orders, festival or competition entry fees, production or theatre fees, choreography fees, private lessons and other separately incurred expenses remain payable where applicable.

SHORT-TERM, SESSIONAL & SPECIALTY PROGRAMS

Registrations for Movement Labs, camps, workshops and other short-term, sessional or specialty programs are for the complete advertised session.

Unless different terms are stated in the individual program information, once a session has begun, tuition is non-refundable and cannot be prorated or credited for missed classes or voluntary withdrawal.

INJURY OR MEDICAL WITHDRAWAL

If a significant injury, illness or medical condition prevents continued participation, please notify Kootenay DanceWorks in writing as soon as reasonably possible.

Medical withdrawals will be considered individually, and supporting medical documentation may be requested.

Where a tuition adjustment, credit or refund is approved, it will be determined based on the circumstances and effective date of withdrawal.

STUDIO CLOSURES & SCHEDULE CHANGES

Kootenay DanceWorks may occasionally need to substitute instructors, combine classes, modify schedules or cancel or reschedule a class due to enrolment, instructor availability, facility issues, severe weather, power outages, public safety concerns or other circumstances beyond KDW's reasonable control.

Where reasonably possible, KDW will provide a substitute instructor, rescheduled class, alternative class or other appropriate accommodation.

Refunds or credits are generally not provided for an individual class cancelled because of severe weather, power outages, facility emergencies or other circumstances beyond KDW's reasonable control.

If Kootenay DanceWorks permanently cancels a program and cannot provide a reasonable alternative, tuition paid for the remaining undelivered portion of the program will be credited or refunded as appropriate.

CLASS PLACEMENT

Appropriate class placement is important to participant development, safety and the overall class environment.

Kootenay DanceWorks reserves the right to determine, recommend or adjust class placement when reasonably necessary based on factors such as age, experience, technical development, readiness, safety and overall class dynamics.

By completing registration with Kootenay DanceWorks, I confirm that I have read, understood and agree to the program commitments, payment schedules, tuition requirements, withdrawal conditions and refund policies set out above.
