Great Lakes Cheerleading: Participant Waiver & Policies
This document outlines the agreement between Great Lakes Cheerleading (GLC) and the Participant (which includes parents/guardians for children under 18) for involvement in our programs and activities. By signing this agreement, you acknowledge and agree to its terms.
Key Definitions
GLC: Refers to DALEXJ Pty Ltd, trading as Great Lakes Cheerleading, and includes its owners, volunteers, directors, officers, employees, trainers, instructors, agents, and representatives.
Participant: Means an individual 18 years or older, or a parent/legal guardian for a child under 18 years of age, engaging in Activities.
Activities: Encompasses cheerleading, tumbling, stunting, dance, strength and conditioning, gymnastics, fitness classes, team or individual competitions, performances, observation of activities, use of GLC facilities and equipment, and all related programs, clinics, seminars, and services provided by GLC.
Injury: Means all forms of physical, mental, and emotional injury related to Activities, including but not limited to death, breaks, strains, lacerations, dislocations, concussions, heart failure, heat illness, dehydration, trauma, anxiety, and fears.
Fees: Refers to the financial obligations for participation, as detailed in Schedule 1.
Your Agreement & Fees
This agreement is effective and binding upon you (the Participant), your heirs, and representatives in the event of death or incapacity.
GLC agrees to provide Activities according to this agreement. As a Participant, you must ensure all Fees are paid as outlined in Schedule 1.
Understanding the Risks
You understand that participating in Activities has inherent dangers and risks, including the potential for serious Injury or death. These risks can arise from any Activity or from the condition of GLC's facilities or equipment. While GLC takes steps to reduce risks, it is not possible to make Activities completely safe.
Specific risks associated with Activities include, but are not limited to:
Falls and Impacts: Injuries resulting from slipping, falling, or impacting against the floor, walls, equipment, or other participants during tumbling, stunting, jumps, and dance.
Physical Stress: Strains, sprains, fractures, dislocations, concussions, and other musculoskeletal injuries. Also, overexertion, dehydration, and heat illness related to intense physical activity.
Equipment: Injuries related to equipment failure (despite regular maintenance) or interaction with various equipment like mats, spring floors, and stunt apparatus.
Spotting: Injuries related to being spotted or spotting other participants.
Third-Party Actions: Injuries caused by actions of other persons conducting or assisting with Activities.
You are aware of the detailed Risk Warning and Disclaimer document provided in Schedule 2 of this agreement.
Your Responsibilities
By participating, you acknowledge and agree that:
Activities require a moderate to high level of effort and are designed to challenge your cardiovascular endurance, strength, flexibility, speed, power, coordination, agility, balance, and accuracy.
You have accurately represented your (or your child's) current level of fitness, health, medical history, and any use of medication to GLC.
You are personally responsible for your (or your child's) preparation, rest, and recovery before and after Activities.
You (or your child) will learn and obey all rules and regulations of GLC and follow instructions and directions from GLC staff during Activities.
Assumption of Risk, Release & Indemnity
Assumption of Risk: You acknowledge that participating in Activities involves inherent dangers and risks of Injury, including serious injury or death. Despite GLC taking reasonable steps to minimise risks and conduct Activities with due care and skill, Activities cannot be made completely safe. You voluntarily accept and assume all inherent risks associated with your (or your child's) participation.
Release: To the fullest extent permitted by Australian law, you release GLC from any liability for Injury, loss, or damage you (or your child) may suffer as a result of participating in Activities, except where such liability cannot be excluded by law (e.g., certain consumer guarantees relating to services provided without due care and skill). This includes, but is not limited to, liability for negligence, breach of contract, or breach of any statutory or other duty of care on the part of GLC.
Indemnity: You agree to indemnify GLC (hold harmless and protect) against any claims, costs (including reasonable legal fees), or expenses they may incur from:
Any property damage or Injury to any third party resulting from your (or your child's) participation in Activities.
Any medical costs, emergency transportation, or litigation resulting from your (or your child's) participation in Activities.
Medical Treatment & Media Consent
You (or your child) may stop participating at any time. GLC staff may also direct you (or your child) to stop if there are noticeable signs of distress.
You consent to receive first aid and medical treatment by GLC staff or authorised personnel in the event of an accident, Injury, or illness during Activities.
You consent to GLC videotaping, audiotaping, or photographing you (or your child) for instructional and promotional purposes without remuneration or further notice.
SCHEDULE 1: Fees
Fees, payment terms, and invoices will be emailed to the primary email address provided by the Participant.
SCHEDULE 2: Risk Warning and Disclaimer
General Risk Warning
Using GLC facilities, participating in or watching GLC activities are subject to risks. These include death, serious injury or illness due to:
Slipping or falling, while jumping, skipping, running, walking, lifting, and impacting against the floor, walls, equipment, other athletes, or any permanent or temporary fixtures or equipment.
Activities on or near objects such as stands, racks, weight bars, pull up bars, walls, ropes, cargo nets, medicine balls, and plyo boxes.
Falling persons or objects such as weights, dumbbells, bars, medicine balls, ropes or by any objects dropped by other persons conducting activities or assisting others.
Failure of the equipment, racks, stands, bars, attachments, anchors, ropes and harnesses.
Damage to, or loss of, your personal property.
