I am over 18 and/or I am the legal guardian of the person(s) I intend to register for class.

Infectious diseases, including but not limited to COVID-19, have been recognized by health authorities as serious public health risks. COVID-19 in particular has been declared a worldwide pandemic by the World Health Organization. It is highly contagious and believed to spread primarily through person-to-person contact. As a result, federal, state, and local governments and health agencies have recommended preventative measures, including social distancing and limitations on group gatherings.

Pointe In Fusion, Inc. / D.B.A. Dance Contempra has put in place preventative measures intended to reduce the spread of infectious diseases. However, the Studio cannot guarantee that you or your child(ren) will not be exposed to or infected by COVID-19 or any other contagious illness while on the premises or participating in Studio activities. Attendance at the Studio could increase the risk of contracting an infectious disease.

By registering for or attending any Studio activity, I acknowledge the contagious nature of infectious diseases, including but not limited to COVID-19, and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by such illnesses as a result of participation. I understand that such exposure or infection may result in personal injury, illness, permanent disability, or death, and that the risk may result from the actions, omissions, or negligence of myself or others, including but not limited to Studio staff, volunteers, other participants, and their families.

I voluntarily assume all such risks and accept full responsibility for any resulting injury, illness, damage, loss, claim, or expense of any kind that I or my child(ren) may experience or incur in connection with attendance at the Studio or participation in Studio activities. On behalf of myself and my child(ren), I hereby release, covenant not to sue, discharge, and hold harmless the Studio, its employees, agents, and representatives, from any and all claims, liabilities, actions, damages, costs, or expenses of any kind arising from or related to exposure to or infection by any infectious disease, whether occurring before, during, or after participation in any Studio activity. This release includes any claims based on the actions, omissions, or negligence of the Studio, its staff, or representatives.

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

IN CONSIDERATION of being permitted to utilize the facilities, services and programs of Dance Contempra (or for my children to participate) for any purpose, including, but not limited to observation or use of facilities or equipment, or participation in any off-site program affiliated with Dance Contempra, the purchaser, for himself or herself and such participating children and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has, or immediately upon entering or participating will, inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that such entry into Dance Contempra for observation or use of any facilities or equipment or participation in such affiliated program constitutes an acknowledgment that such premises and all facilities and equipment thereon and such affiliated program have been inspected and carefully considered and that the purchaser finds and accepts same as being safe and reasonably suited for the purpose of such observation, use or participation by the purchaser and such children.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER Dance Contempra FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY OFF-SITE PROGRAM AFFILIATED WITH Dance Contempra, THE purchaser HEREBY AGREES TO THE FOLLOWING:

1. THE purchaser, ON HIS OR HER BEHALF AND BEHALF OF SUCH CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES AND CONVENANTS NOT TO SUE Dance Contempra, its directors, officers, employees, and agents (hereinafter referred to as “releases”) from all liability to the purchaser or such children and all his personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the purchaser, whether caused by the negligence of the releases or otherwise while the purchaser or such children is in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with Dance Contempra.

2. THE purchaser HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage or cost they may incur due to the presence of the purchaser or such children in, upon or about Dance Contempra premises or in any way observing or using any facilities or equipment of the Dance Contempra or participating in any program affiliated with Dance Contempra whether caused by the negligence of the releases or otherwise.

3. THE purchaser HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the purchaser or such children due to negligence of releases or otherwise while in, about or upon the premises of Dance Contempra and/or while using the premises or any facilities or equipment thereon or participating in any program affiliated with Dance Contempra. THE purchaser further expressly agrees that the foregoing RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

4. The purchaser will allow Dance Contempra to use photographs for ads, articles, promotions, etc.

5. The purchaser must give written notice if they will NOT be able to participate in the Spring Recital and understand that failure to do so will result in responsibility for payment of costumes ordered for the show.

6. The Purchaser will give 30 days' notice before dropping a class. Schedule changes must be handled with the front desk, NOT with the instructor.

7. I acknowledge that I have been informed that this program is not a licensed child care facility. I also understand that the Georgia Department of Early Care and Learning does not require licensing and that this program is exempt from state licensure requirements.

THE PURCHASER HAS READ AND VOLUNTARILY ELECTRONICALLY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
