In consideration for receiving permission to participate with Tevakanui/Polynesian Entertainment LLC., I Hereby AGREE TO INDEMNIFY AND HOLD HARMLESS, RELEASE, WAIVE, DISCHARGE, and COVENANT not to sue, the staff of Tevakanui Polynesian Dance School and their committees, officers, Agents, Volunteers or employees (herein after referred to as Releasees) from any loss, liability, damage, or injury, including death, that may be sustained by myself, WHETHER CASUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise while participating in such activity, or while, in on, or upon premises located at the address where the activity/classes is being conducted including court costs and attorney fees. I realize that Tevakanui Polynesian Dance School and their committees does not maintain insurance covering any circumstance arising from the participation in this event or in any activity associated with facilitating that participation. As such, I am aware that I should review my own personal insurance portfolio.

IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT that I have read the foregoing Hold Harmless and Tuition Agreement, understand it and sign it voluntarily as my own free act and deed: no oral representatives, statements, or inducements, apart from the foregoing written agreement, have been made; I further acknowledge that I am at least 18 years of age and am legally, mentally and otherwise fully competent to enter into this agreement either under my own name or that I have every right to contract for the minor in the above regard.

As an active member of Tevakanui Polynesian Dance Studio, I understand that I will be required to follow all of the PolicIes set forth by TEVAKANUI. Some are listed below. (SUBJECT TO CHANGE AT ANYTIME)

TUITION and PAYMENTS
Tuition is paid in advance, due the first of each month. Auto payment will run on the 1st of the month. After the 15th of the month a $15 late fee will be accessed to the account.

Tuition is non-refundable and not transferable. Tuition is due each and every month regardless of attendance and months with holidays & event performances. There are no refunds, credits, or extensions given for any reason. Make up classes, when available, are for currently enrolled students only and must be taken within 2 weeks of a missed class.

Autopay is the preferred method of payment which can be by Credit Card or a Checking Account (ACH). We do accept (exact change) CASH. THERE IS A $10 ADDITIONAL FEE FOR NON AUTOPAY TUITION. CASH PAYMENTS MUST BE MADE TO THE ADMIN TO ENSURE CORRECT POSTING TO ACCOUNTS. All non-cash payments are made ONLINE in the Members Portal. If your preferred method of electronic payment changes, it is your sole responsibility to update payment accounts before tuition is due. Failure to do so may incur a late fee posting to your account.

All payments made through Dance Studio Pro Merchant Services / Strip are subject to additional fees for Credit Cards. A fee of $2 will be added for any failed ACH payment (Electronic Checking).

Dropping a class/ cancelling membership must be done before the 25th of the month through the online portal to ensure no further tuition or fees will be applied. Failure to do so will cause tuition and fees to be posted to your account which you will be responsible for.

If more than 2 months of tuition is left unpaid, Tevakanui may freeze or cancel a membership. Please communicate with a leader or the admin if arrangements need to be made.



ATTENDANCE
In-class attendance is mandatory for all performances (exceptions are for sickness or family emergencies). We do allow students to attend online if they temporarily can't attend class, but this does not replace the In-Class rule for performances.

Submitting an absence from class can be done through the online portal.

MEMBERSHIP
All members MUST be enrolled with a member account in our online Members Portal. Any dancer 18 and older must create their own account.

Each new member will pay a $30 registration fee the first year and then $30 membership fee per year (per family) in June, thereafter.

We have the right to cancel a membership at any time with valid cause not including, sex, race, age or ethnicity.

MEDIA AND PROMOTIONS
TEVAKANUI owns the rights to all media, videos, photographs taken during classes, performances and school events. These items may be used for promotions made by the school at its discretion.

CHOREOGRAPHY
TEVAKANUI owns the rights to all choreography taught by its school and instructors. All choreography may not be used for personal profit and must have explicit permission from TEVAKANUI to be used in public or on any platform.

EXCLUSIVITY
When it comes to enrollment, Tevakanui has one rule of exclusivity. We do not allow any of our members to be enrolled at another studio or group.

In other words: a Tevakanui member cannot take classes, perform or compete for more than 1 studio at a time (this does not apply to workshops and collaborations authorized by our staff).

With your Tevakanui membership, you are making a commitment to this journey and all the classes we have to offer. We do not expect to be the right dance family for everyone, but we do value loyalty.

There is also a protocol when it comes to ending membership. If you would like to change studios or stop membership, please notify our staff prior to your exit. This is implemented to encourage communication, transparency & an understanding as to how we can be better - if necessary.

*** Please note: these exclusivity rules apply to members only. If another family member of yours is enrolled at a different studio, it does not impact your membership with Tevakanui. (for example: it is okay if you are a Tevakanui member and your sister/mom/brother/etc. Represents a different studio/company)

*** Rare exceptions are taken into consideration, but first need to be discussed with our leaders. Ultimately, the decision is at their discretion.

All Policies can be found in our Handbook which is posted online in the Members Portal and are covered under agreement.

ALL POLICIES ARE SUBJECT TO CHANGE and ALL CHANGES ARE SUBJECT TO THIS AGREEMENT.
