Assumption of Risk: I understand that participation in dance classes, rehearsals, performances, camps, and related physical activities at Boutique Dance Academy (“BDA”) involves inherent risks. These risks may include, but are not limited to, physical injury, illness, strain, or, in rare cases, serious injury or death. By enrolling, I voluntarily assume all risks associated with participation for myself and all participants associated with this account, whether known or unknown, and accept full responsibility for any resulting outcomes.
Definition of Participants: For the purposes of this agreement, “participant” or “participants” refers to myself and all participants associated with this account, including any minor child or children enrolled now or in the future.
Release of Liability: I hereby release, waive, and discharge Boutique Dance Academy, including its owners, directors, employees, instructors, agents, assistants, volunteers, and representatives, from any and all liability, claims, demands, or causes of action arising out of or related to participation in any BDA activities. This includes injuries occurring during classes, rehearsals, performances, or use of the studio, injuries resulting from physical activity, equipment use, or instruction, loss, damage, or theft of personal property, and any incident occurring on or off the premises in connection with BDA activities. I understand that this release applies to the fullest extent permitted by law.
Transportation and Off-Site Activities: If I permit participants associated with this account to engage in off-site activities or to be transported by a BDA staff member or representative, I acknowledge and accept all associated risks and release BDA from any liability arising from such participation or transportation.
Media Release and Post Withdrawal Use: I grant Boutique Dance Academy permission to photograph and record video of myself and or participants associated with this account during classes, rehearsals, performances, and studio related activities. I understand that media may be used for promotional, marketing, and educational purposes, including social media, website content, print materials, advertising, and video production. After withdrawal from BDA, previously captured or published materials will not be removed, altered, or recalled. Upon written request, BDA will refrain from using newly captured images of participants associated with this account in future marketing or promotional materials.
Student Health, Conduct, and Participation Responsibility: I acknowledge that it is my responsibility to ensure that participants associated with this account are physically capable of participating in dance activities, that any injuries, limitations, or medical concerns are communicated to instructors, and that all studio rules, safety guidelines, and instructor direction are followed. I understand that failure to follow instructions or safety guidelines may increase risk and may result in removal from class at the discretion of BDA staff.
Enrollment, Tuition, and Withdrawal Acknowledgment: I understand and agree that enrollment at BDA is for participation in an ongoing instructional program and not for the purchase of individual classes. Tuition provides access to scheduled classes and program offerings during the billing period and is based on the program's overall structure and value rather than on individual class attendance. Missed classes, absences, or scheduling conflicts do not reduce or alter tuition. While BDA may offer make-up classes as a courtesy, based on availability, they are not guaranteed. I understand that I may withdraw participants associated with this account at any time in accordance with Colorado state law, and that withdrawal requests are preferred in writing via email or text. Once a participant attends at least one class in a billing period, I acknowledge that services for that period have been initiated and substantially delivered through program access, and participants may continue attending available classes through the remainder of the billing period. I understand that any refunds will be handled in accordance with BDA’s official policies and applicable state law, and that refunds are not based on individual class attendance, missed classes, or voluntary non-participation.
Payment Authorization and AutoPay Requirement: I understand and agree that a valid payment method must be kept on file at all times and that all accounts are enrolled in automatic billing. Tuition is billed on the first day of each calendar month of participation and will continue on a recurring monthly basis until proper notice of withdrawal is received in accordance with BDA policies. I authorize BDA to charge the payment method on file for all applicable tuition, fees, and services as they become due in accordance with BDA’s billing schedule and policies. It is my responsibility to ensure that payment information is current and valid. Payments made by ACH bank draft do not incur an additional fee, while credit card payments are subject to a 1.5 percent convenience fee. I understand that failed or declined payments may result in late fees, temporary suspension from classes, and loss of access to studio programs until the account is brought current. Any exceptions to the automatic billing requirement may be granted at BDA’s discretion on a case-by-case basis and are not guaranteed and may be revoked at any time.
Account Standing and Participation: I understand that maintaining a current account is required for continued participation. If my account becomes past due, access to classes and programs may be suspended, participation in performances or special events may be restricted, and enrollment status may be impacted until the account is brought current.
Parent or Guardian Certification: If signing on behalf of a minor, I certify that I am the parent or legal guardian of the participants associated with this account and that I have the legal authority to enroll, make decisions, and enter into this agreement on behalf of all participants associated with this account. I accept full responsibility for their participation and compliance.
Acknowledgment and Agreement: By signing below or accepting electronically, I confirm that I have read and understand this waiver and policy acknowledgment, that I agree to be legally bound by this agreement, that I agree to all terms stated above, that I voluntarily accept all risks associated with participation, and that this agreement applies to all current and future participation while enrolled at BDA.
