EDGE DANCE PARTICIPATION AGREEMENT
ASSUMPTION OF RISK, RELEASE OF LIABILITY, MEDICAL AUTHORIZATION, PHOTO RELEASE, AND PARENTAL CONSENT

1. ACKNOWLEDGMENT OF RISKS
I understand that participation in dance instruction and related activities involves inherent risks that cannot be eliminated regardless of the care taken by the Studio.
These activities include, but are not limited to:
dance classes;
rehearsals;
performances;
recitals;
competitions;
conventions;
auditions;
workshops;
camps;
private lessons;
conditioning and stretching;
tumbling, acrobatics, lifts, and partnering;
choreography;
travel to and from events;
and all other activities sponsored, conducted, or supervised by the Studio.
I understand that participation may result in injuries including, but not limited to:
muscle strains;
sprains;
fractures;
dislocations;
torn ligaments;
concussions;
head injuries;
neck injuries;
back injuries;
cuts and bruises;
illnesses;
permanent disability; and
death.
I further understand that injuries may result from, among other things:
slips or falls;
contact with other participants;
instructor demonstrations;
dance floors;
props;
costumes;
equipment;
physical exertion;
repetitive movements;
travel;
and the ordinary negligence of other participants or Released Parties.
2. ASSUMPTION OF RISK
I knowingly and voluntarily choose to participate (or permit my child to participate) in Studio activities.
I fully understand and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, arising from participation in Studio activities, including the risk of serious injury, permanent disability, illness, property damage, or death.
3. RELEASE OF LIABILITY
To the fullest extent permitted by Utah law, I hereby release, waive, discharge, and covenant not to sue:
EDGE DANCE, its owners, members, managers, officers, directors, employees, instructors, choreographers, volunteers, independent contractors, agents, representatives, affiliates, successors, assigns, landlords, and event hosts (collectively, the "Released Parties")
from any and all claims, demands, causes of action, liabilities, damages, costs, expenses, or losses arising out of or related to participation in Studio activities.
This Release specifically includes claims arising from the ordinary negligence of the Released Parties.
This Release does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct where such claims cannot legally be waived.
4. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, judgments, costs, attorney fees, or liabilities arising out of:
my actions;
my child's actions;
violation of Studio policies;
or breach of this Agreement.
5. PHYSICAL CONDITION
I represent that:
I (or my child) am physically capable of safely participating;
I have disclosed any medical conditions that may affect participation;
participation is voluntary; and
I understand that I may discontinue participation at any time.
I understand the Studio is entitled to rely upon these representations.
6. MEDICAL AUTHORIZATION
If the participant is a minor, I authorize the Studio to obtain emergency medical care if I cannot be immediately reached.
I authorize:
emergency medical treatment;
emergency transportation by ambulance;
hospitalization;
surgery;
x-rays;
anesthesia;
medications;
diagnostic testing;
and any treatment reasonably deemed necessary by licensed medical professionals.
I understand I am solely responsible for all medical expenses incurred.
7. MEDICAL INSURANCE

8. COMMUNICABLE ILLNESSES
I understand that participation may expose the participant to communicable illnesses, including influenza, COVID-19, RSV, or other contagious diseases.
I voluntarily assume those risks.
9. STUDIO RULES
I agree that the participant will comply with all:
Studio policies;
instructor directions;
safety rules;
competition rules;
facility rules;
and codes of conduct.
The Studio reserves the right to remove any participant whose conduct is unsafe, disruptive, abusive, or inappropriate.
Removal may occur without refund.
10. PERSONAL PROPERTY
The Studio is not responsible for lost, stolen, or damaged:
clothing;
dance shoes;
costumes;
jewelry;
electronics;
vehicles;
or other personal property.
11. PHOTO, VIDEO, AND MEDIA RELEASE
I grant the Studio permission to photograph, videotape, livestream, and otherwise record the participant.
I grant the Studio a perpetual, worldwide, royalty-free license to use the participant's:
photograph;
image;
likeness;
voice;
name;
and performance
for lawful Studio purposes including:
advertising;
social media;
websites;
brochures;
promotional materials;
recital programs;
competitions;
fundraising;
and other Studio publications.
No compensation shall be owed for such use.
I waive any right to inspect or approve the finished product.
12. NO GUARANTEE
I understand the Studio makes no guarantees regarding:
advancement;
casting;
competition placement;
scholarships;
awards;
physical improvement;
or future opportunities.
13. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Utah.
Any legal proceeding arising from this Agreement shall be brought exclusively in a state court located in the county where the Studio's principal office is located.
14. SEVERABILITY
If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT
This Agreement constitutes the complete understanding between the parties concerning the subject matter herein.
No oral representations modify this Agreement.
16. ACKNOWLEDGMENT
I certify that:
I have carefully read this Agreement.
I fully understand its contents.
I understand I am giving up substantial legal rights, including the right to sue.
I have had the opportunity to ask questions before signing.
I sign this Agreement voluntarily and without coercion.
If signing on behalf of a minor, I represent that I am the parent or legal guardian authorized to execute this Agreement.
