This Privacy Policy describes the information Desert Air Athletics, LLC (“Desert Air,” “we,” or “us”) collects about athletes and families, how we use it, who we share it with, and how long we keep it. The current version and its effective date are posted in the parent portal.
1. Account Information. We collect the athlete’s name and date of birth, the parent’s name, relationship, and address, email addresses and telephone numbers, emergency contacts, and attendance records.
2. Health Information. We collect allergies, medications, conditions, prior injuries and surgeries, physical limitations, injury and incident reports, and concussion records and clearances. We use this information to train the athlete safely, because skill progressions, spotting decisions, and emergency response depend on it. We are not a health care provider and the Health Insurance Portability and Accountability Act does not apply to us, but we treat this information as sensitive.
3. Payment Information. We collect the billing name and address, the last four digits of the card or bank account, and transaction history. We do not store full card or bank account numbers, which are held in tokenized form by our payment processor.
4. Cameras and Recordings. We record video of the training floor, lobby, and building exterior for safety and incident documentation. The system records video only and does not record audio, and there are no cameras in restrooms or changing areas. Coaches record athletes during training so that technique can be reviewed with the athlete and family. We also photograph and record at the facility and at events and may use that material to promote Desert Air. You may opt out of promotional use at any time in your account.
5. Communication Preferences. We record whether you have opted in to promotional email and to text messages. Billing and safety notices are sent to every family while enrolled and are not optional.
6. How We Share Information. We do not sell your information, and we do not sell or license images of athletes to any third party for that party’s own use. We share information with our service providers, which are Studio Pro for registration, scheduling, waivers, and billing, Stripe for payment processing, Venmo for certain open gym and drop-in payments, and Google for email. Studio Pro stores accepted agreements together with the date, time, account, and version accepted. We also share information with emergency responders and medical personnel in an emergency, with our insurance carrier, brokers, and attorneys and with courts or law enforcement where required in connection with an incident or claim, and internally with our coaches only as needed to train an athlete safely, such as an allergy, a prior injury, or a concussion history.
7. How Long We Keep Information. We retain accepted agreements, incident reports, concussion clearances, and incident-related video until the athlete turns twenty-five (25), until four (4) years after the athlete’s last day of participation, or until any known claim is resolved, whichever is latest. Routine security footage is retained for approximately thirty (30) days on a rolling basis and then automatically overwritten. Payment authorizations are retained for two (2) years after the account closes, and transaction records for seven (7) years. We keep athlete records this long because a minor’s deadline to bring a claim generally does not begin to run until the minor turns eighteen (18), and a case filed then can take years. These records protect both of us by documenting what happened and what care was given.
8. How We Protect Information. Payment credentials are tokenized and held by our processor rather than by us. Account systems are password protected with access limited to owners and to staff who need it. Paper health records are kept secured, and access to video is restricted. Staff are instructed not to discuss athlete health information beyond what their work requires. No electronic system is completely secure. We will notify affected families if we learn of a breach involving their information, and we will give any notice required by Utah law.
9. Children’s Information. Most of the information we hold concerns minors and is provided to us by a parent or legal guardian. We do not collect information directly from children, and our website is not directed to children.
10. Your Choices. You may opt out of promotional use of photographs and video at any time in your account or by emailing us. We will stop using the image in new material and will make reasonable efforts to remove it from our website and social media, but we cannot retrieve printed material already distributed, content that others have already shared, or copies cached by search engines and social platforms. Promotional email and text messages are optional and you may change them at any time, while billing and safety notices are not optional while you are enrolled. You may view and update your information in your account or by emailing us. We will honor a deletion request except where we are required to keep records or reasonably need them for the purposes described in Section 7, and we will tell you what we are keeping and why.
11. Changes to This Policy. We will announce a material change by email. The current version and its effective date are always posted in the parent portal.
