STUDENT PARTICIPATION, LIABILITY WAIVER, and MEDIA RELEASE AGREEMENT:
This Student Participation, Liability Waiver, and Media Release Agreement (“Agreement”) is entered into by and between On Pointe Academy, LLC (“On Pointe”) and the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of the Student (“Student”).
Participation Authorization. Parent/Guardian hereby authorizes Student to participate in ballet classes, rehearsals, performances, camps, workshops, conditioning activities, stretching, choreography sessions, competitions, and related activities conducted, organized, or sponsored by On Pointe. Parent/Guardian acknowledges that participation in dance and athletic-related activities involves physical movement and exertion and may carry certain inherent risks, including but not limited to falls, strains, sprains, fractures, collisions, or other injuries.
Parent/Guardian further acknowledges that, within On Pointe’s safe, professional, and supervised instructional environment, instructors may provide appropriate physical guidance, positioning, spotting, posture correction, stretching assistance, or other hands-on instruction reasonably necessary for dance education, technique development, safety, and injury prevention. On Pointe expects all such interactions to be conducted in a professional, appropriate, and respectful manner consistent with accepted dance instructional practices and On Pointe’s standards for student safety and wellbeing.
Assumption of Risk and Liability Waiver. Parent/Guardian knowingly and voluntarily assumes all risks associated with Student’s participation in On Pointe activities, whether known or unknown, including risks arising from ordinary negligence. To the fullest extent permitted by applicable law, Parent/Guardian, individually and on behalf of Student, hereby releases, waives, discharges, and agrees to hold harmless On Pointe and its owners, directors, instructors, employees, staff, volunteers, affiliates, representatives, and agents from and against any and all claims, liabilities, demands, damages, injuries, losses, costs, or expenses arising out of or related to Student’s participation in On Pointe classes, activities, or events, except to the extent caused by gross negligence or willful misconduct of On Pointe.
Medical Authorization. Parent/Guardian acknowledges that Student is physically capable of participating in On Pointe activities and has no medical condition, restriction, injury, or other circumstance that would prevent safe participation or require special attention unless such condition or circumstance has been disclosed or otherwise communicated to On Pointe.
Parent/Guardian may disclose any relevant Student health information (i.e. allergies, conditions, diagnoses) in the medical section on Studio Pro and agrees to promptly notify On Pointe of any injury, medical restriction, illness, condition, or circumstance affecting Student’s ability to safely participate in On Pointe activities.
In the event of an emergency, Parent/Guardian authorizes On Pointe to obtain emergency medical treatment for Student if Parent/Guardian cannot be reached immediately.
Conduct and Safety. Parent/Guardian acknowledges that On Pointe maintains standards and expectations regarding conduct, behavior, dress code, attendance, professionalism, and safety. Student and Parent/Guardian agree to comply with all On Pointe policies, procedures, rules, and instructions communicated by On Pointe and its staff from time to time.
Parent/Guardian further acknowledges the importance of maintaining a respectful, positive, and supportive environment for all students, families, instructors, and On Pointe personnel. Parent/Guardian agrees to interact with On Pointe leadership, instructors, staff members, students, and other families in a professional, respectful, and appropriate manner at all times, including but not limited to during classes, rehearsals, performances, competitions, events, electronic communications, and social media activity.
Disruptive, abusive, threatening, harassing, intimidating, defamatory, or otherwise inappropriate behavior by a Parent/Guardian or Student, whether verbal, written, physical, or electronic, shall not be tolerated and may result in immediate disciplinary action, suspension, or removal from On Pointe with no refund and at On Pointe’s sole discretion.
On Pointe reserves the right to suspend or remove any student or family whose conduct is disruptive, unsafe, inappropriate, or inconsistent with the On Pointe’s standards, culture, mission, or environment.
Photography and Videography Policy. To maintain a safe, focused, and professional training environment, photography, video recording, audio recording, live streaming, and other forms of media capture are strictly prohibited within the studio, during classes, rehearsals, workshops, and other On Pointe activities unless prior written approval, authorization, or permission has been granted.
This policy is intended to protect the privacy and safety of all students, particularly minors, and to preserve the intellectual property, proprietary teaching methods, choreography, artistic works, and creative content developed or presented by OPA, its instructors, choreographers, staff, guest artists, and students.
Parents, guardians, students, and visitors agree not to photograph, record, reproduce, distribute, publish, post online, or otherwise share any images, videos, audio recordings, choreography, class content, or On Pointe activities without prior authorization from On Pointe. Any unauthorized capturing or distribution may result in a request to delete content and/or removal from the premises, suspension or termination of participation, and any other remedies available under applicable law.
Media and Photography Release. Parent/Guardian hereby grants On Pointe permission to photograph, video record, and capture Student’s likeness, image, voice, performance, and participation in On Pointe-related activities.
Parent/Guardian further grants On Pointe the unrestricted right to use, reproduce, publish, display, distribute, edit, and promote such photographs, videos, recordings, or other media for lawful business, promotional, advertising, marketing, educational, recital, website, and social media purposes.
Parent/Guardian understands and agrees that such materials may appear in print, digital, online, and social media formats and may be used indefinitely unless revoked in writing by Parent/Guardian. Parent/Guardian further releases and holds harmless On Pointe from any claims relating to the use of such media or likenesses as authorized herein.
If personal/familial circumstances prevent the photography/videography or publishing of a given student, the parent/guardian may notify On Pointe in writing to opt out of the Media and Photography Release portion of this agreement and a note can be made in the dancer’s account.
Personal Property. Parent/Guardian acknowledges that On Pointe is not responsible for any lost, stolen, or damaged personal property belonging to Student or Parent/Guardian, including but not limited to clothing, dancewear, shoes, bags, electronics, jewelry, or other personal items.
Payment. Parent/Guardian agrees that tuition and fees are non-refundable and commits to the complete training season September-June. Tuition for the season is divided into 10 installments. An additional pre-season month (August) is made available for dancers desiring more year-round, consistency of training. Participation in pre-season month is required for those in the Excellence Program and/or competing under On Pointe Academy. Pre-season month is strongly recommended but not required for others. Tuition is due on the 15th of the preceding month. Surcharges are applied to credit card transactions. Late payments will incur a $30 late fee which will be charged on the 18th.
Withdrawal. Written notice at least 30 days in advance is required for withdrawal from On Pointe Academy.
Absence and Make-Up Class Policy. Parent/Guardian agrees that absences are to be made up via approved make-up options and are subject to availability. Approved Make-Up Activities: 1) Taking a comparable class in the same level or a lower level and/or 2) writing a paper exploring a ballet performance or work, ballet art, or ballet history (one paragraph per absence).
General Provisions. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Parent/Guardian acknowledges that they have carefully read and understood this Agreement and voluntarily agree to its terms on behalf of themselves and Student.
