THE FENYX PROJECT: Studio Rental Agreement, Liability Waiver & Release
By reserving and using studio space at The Fenyx Project, I acknowledge that I have read, understand, and agree to the following terms and conditions.
1. Assumption of Risk:
I understand that participation in dance, fitness, rehearsals, athletic activities, and other physical activities involves inherent risks, including but not limited to slips, falls, collisions, strains, sprains, fractures, illness, and other injuries. I voluntarily assume all risks associated with my use of The Fenyx Project facilities.
2. Release of Liability:
To the fullest extent permitted by Texas law, I release, waive, and discharge The Fenyx Project, its owners, board members, employees, instructors, volunteers, and representatives from any liability for injury, illness, death, property damage, or loss arising out of my use of the facility, except where caused by gross negligence or willful misconduct.
3. Responsibility for Guests:
The individual making the reservation is responsible for the conduct, safety, and actions of all participants and guests attending the rental. The renter agrees to ensure everyone follows all studio policies.
4. Rental Time:
Rental time includes setup, event or rehearsal time, and cleanup. Renters must vacate the studio at the end of their reserved time. Additional time used without approval may result in additional rental charges.
5. Property Damage:
The renter accepts full financial responsibility for any damage to the facility, Marley flooring, hardwood flooring, mirrors, sound equipment, furniture, or any other studio property caused during the rental period beyond normal wear and tear.
6. Clean-Up:
The studio must be returned to the condition in which it was received. Renters agree to remove all personal belongings, dispose of trash, return equipment to its original location, and leave the space clean. Excessive cleaning may result in additional fees.
7. Studio Rules:
The following are prohibited unless approved in writing by The Fenyx Project:
Smoking or vaping
Alcohol or illegal drugs
Open flames, candles, fireworks, or pyrotechnics
Glitter, confetti, powder, or similar materials
Any activity that may damage the Marley or hardwood floors
Water is permitted. Food and other beverages require prior approval.
8. Supervision of Minors:
An adult must supervise all minors at all times. Children may not be left unattended anywhere on the premises.
9. Personal Property:
The Fenyx Project is not responsible for lost, stolen, or damaged personal property.
10. Insurance:
Commercial renters, instructors, businesses, or organizations may be required to provide proof of liability insurance before the rental date.
11. Cancellation & Refund Policy:
All studio rental reservations are final. Once a reservation has been confirmed and payment has been received, no refunds, credits, or transfers will be issued for cancellations, schedule changes, or no-shows.
If The Fenyx Project must cancel a reservation due to an unforeseen facility issue or emergency, the renter will be offered the option to reschedule or receive a full refund.
12. Right to Refuse Service:
The Fenyx Project reserves the right to deny or terminate any rental without refund if the renter or guests violate studio policies, create unsafe conditions, damage property, engage in illegal activity, or interfere with the operation of the facility.
13. Agreement:
By signing electronically, I certify/acknowledge that:
1. I am at least 18 years of age or am the parent/legal guardian of a participating minor.
2. I have read and understand this agreement.
3. I voluntarily agree to all terms and conditions.
4. I accept financial responsibility for myself and all individuals included in my reservation.
5. I understand that all studio rental bookings are final and non-refundable once my reservation is confirmed.
6. I understand my rental time includes setup and cleanup.
7. I understand I am financially responsible for any damage caused during my rental.
8. I agree to follow all studio rules and ensure all guests comply with this agreement.
9. I understand that failure to comply with studio policies may result in immediate termination of my rental without a refund.
