Before registering and enrolling for classes, you must read and accept the following items below.
RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
In consideration of the minor participant being permitted to participate in any Sierra Performing Arts Center program, activity, or event identified below, and/or being permitted to enter any restricted area, defined as any area not open to the general public, the undersigned parent(s) and/or legal guardian(s) agree as follows: The undersigned shall instruct the minor participant to inspect the facilities and equipment before participating in any Sierra Performing Arts Center activity or event. If the participant believes that any condition is unsafe, the participant shall immediately notify the appropriate officials and refuse to participate. The undersigned further understands and agrees that, if any condition appears unsafe at any time, all necessary precautions shall be taken to avoid the unsafe area, and participation shall cease immediately. The undersigned fully understands, acknowledges, and accepts that participation in Sierra Performing Arts Center events and activities involves inherent risks and dangers that may result in bodily injury, partial or total disability, paralysis, death, property damage, and related social or economic losses. Such risks may arise from the action, inaction, or negligence of the participant or of others, including, but not limited to, the Releasees identified herein. The undersigned further acknowledges that other risks may exist that are not presently known or reasonably foreseeable. The undersigned knowingly and voluntarily assumes all such risks and accepts full responsibility for any resulting injury, disability, paralysis, death, loss, or damage, whether caused in whole or in part by the negligence of the Releasees or otherwise. The undersigned hereby releases, waives, discharges, and covenants not to sue Sierra Performing Arts Center; its owners, managers, promoters, premises lessees, premises and event inspectors, underwriters, consultants, directors, officers, agents, employees, and any other persons or entities providing recommendations, directions, or instructions relating to risk evaluation or loss control activities for Sierra Performing Arts Center facilities, programs, or events, collectively referred to as the “Releasees,” from any and all liability, claims, demands, actions, causes of action, losses, or damages arising out of or related to any injury, including death of the participant, or damage to property, arising out of or relating to the event(s), whether caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise. The undersigned acknowledges that the activities associated with the event(s) may be dangerous and may involve the risk of serious injury, death, and/or property damage. The undersigned further expressly acknowledges that any injuries sustained may be compounded or increased by negligent rescue operations or procedures of the Releasees. The undersigned agrees that this Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by the law of the state or province in which the event is conducted. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. On behalf of the participant and individually, the undersigned parent(s) and/or legal guardian(s) execute this Waiver and Release. If, notwithstanding this release, the participant asserts any claim against any Releasee, the undersigned parent(s) and/or legal guardian(s) agree to indemnify, reimburse, and hold harmless the Releasee from any amount paid to or on behalf of the participant, including any related losses or damages. The undersigned acknowledge that they have read this Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement in its entirety; fully understand its terms; understand that substantial rights are being relinquished by signing it; and sign it freely and voluntarily, without inducement, assurance, or guarantee. The undersigned intends this signature to constitute a complete and unconditional release of all liability to the greatest extent permitted by law.
Electronic Signature Agreement. I am signing this agreement electronically by selecting the "I Accept" checkbox. I agree that this electronic signature is the legal equivalent of my manual signature on this agreement.
