APPENDIX WAIVERS & RELEASES
These forms have been reviewed by legal counsel for use in California.
Liability Waiver, Release & Assumption of Risk
In consideration of being permitted to participate in dance classes, rehearsals, and
performances (the “Activities”) at Dance with Miss Lindsay (“DWML”), I acknowledge and agree
to the following on behalf of myself and/or my minor child:
1. Assumption of Risk: I understand that dance and related physical activity carry inherent
risks of injury, including but not limited to sprains, strains, fractures, and other physical
injury. I voluntarily assume all risks associated with participation in the Activities.
2. Release of Liability: To the fullest extent permitted by law, I release, waive, discharge,
and covenant not to sue DWML, its owner, instructors, staff, and assistants from any and
all liability, claims, demands, or causes of action arising out of ordinary negligence in
connection with participation in the Activities.
3. Medical Treatment: In the event of injury or illness, I authorize DWML staff to seek
emergency medical treatment for my child if I cannot be reached, and I agree to be
responsible for any costs incurred.
4. Acknowledgment: I have read this waiver, understand its terms, and sign it voluntarily
and without any inducement.
Governing Law and Severability
This Agreement shall be governed by, construed, and enforced in accordance with the laws of
the State of California. If any section or term of this Agreement is held invalid or unenforceable
by a court of competent jurisdiction, the remaining provisions shall continue in full legal force
and effect.
Acknowledgment of Understanding
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS
AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I AM AWARE THAT I AM GIVING UP
SUBSTANTIAL LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE THE STUDIO FOR
ORDINARY NEGLIGENCE. I SIGN IT FREELY AND VOLUNTARILY.
PHOTO & VIDEO RELEASE
I understand that DWML may take photographs and/or video of my child during classes,
rehearsals, and performances, and I agree to the following:
1. I grant DWML permission to photograph and/or video my child during the Activities.
2. I grant DWML permission to use such photographs and/or video on the studio’s website,
social media accounts (including Instagram, TikTok, and Facebook), and promotional or
marketing materials.
3. I understand I may decline this permission at any time by notifying DWML in writing, and
that declining will not affect my child’s ability to participate in classes.
4. I understand that all choreography, routines, and creative works taught or created at
DWML are the intellectual property of the studio and may not be recorded, reproduced,
taught elsewhere, or performed publicly without written permission from DWML.
CREATIVE RIGHTS
All movement, choreography, and material used for performance are the intellectual property and creative work of the instructor, and dance creations of the dance studio. Use of choreography, without verbal or written permission by DANCE WITH MISS LINDSAY is prohibited. This includes any performance, videotaping, distribution, online posting, and/or photography used for advertisement.
Electronic Signature Agreement. By selecting the "I Accept" checkbox, I am signing this agreement electronically. I agree this electronic signature is the legal equivalent of my manual signature on this agreement.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
