DANCE CLASS LIABILITY WAIVER AND CONTRACT
This Dance Class Liability Waiver and Contract ("Agreement") is entered into between Nachdi Jawani: Bovaird ("Studio") and the undersigned client ("Client"). By acknowledging this Agreement, the Client agrees to the terms and conditions outlined below.
1. LIABILITY WAIVER:
1.1 The Client acknowledges that participation in dance classes involves a certain degree of risk.
1.2 The Client releases Nachdi Jawani: Bovaird, its instructors, and staff from any liability for injuries or damages sustained during or arising out of dance classes, events, or activities organized by the Studio.
1.3 The Client assumes full responsibility for any injuries, damages, or losses that may occur, and agrees not to hold the Studio responsible for any such occurrences.
2. MISSED/MAKEUP CLASSES:
2.1 The Client is responsible for attending scheduled classes.
2.2 In the event of a missed class, the Client may request a makeup class, subject to availability and Studio approval.
2.3 Makeup classes must be scheduled within one month of the missed class and are not guaranteed.
2.4 The client understands there is no monetary credit or consolidation for any classes missed by the Client that were scheduled and run by the Studio.
3. PAYMENT TERMS:
3.1 The Client is required to set up a preauthorized payment method, referred to as ‘Auto-Pay’ in the Studio’s online payment portal. Payment’s will be processed in the first week of every month.
3.1 Tuition fees are due monthly and must be paid in full by the 15th of every month.
3.2 Late payments are subject to a $10 late fee if paid after the 15th of the month.
3.3 Tuition fees are non-refundable.
3.4 The Client may be required to pay a registration fee, as specified by the Studio.
3.5 In the case of new admissions, the Client agrees to pay a $20 registration fee.
4. MEDIA RELEASE:
4.1 The Client hereby grants Nachdi Jawani: Bovaird permission to record, photograph, and publish media, including but not limited to videos, photographs, and audio recordings, featuring the Client during dance classes, events, or performances organized by the Studio.
4.2 The Studio may use such media for promotional, advertising, or educational purposes, including but not limited to social media, websites, and printed materials.
5. NOTICE OF WITHDRAWAL:
5.1 The Client agrees to provide a minimum of 30 days’ notice to the Studio if they decide to discontinue classes.
5.2 If the Client fails to provide the required notice and tuition has already been paid, the Client agrees to forfeit the payment for that month and is obligated to make the payment for any pending fees.
6. AGREEMENT DURATION:
6.1 This Agreement is effective as of the date of acknowledgement and remains in effect until terminated by either party with a proper written notice via email or text.
7. CLIENT'S ACKNOWLEDGMENT:
By acknowledging this waiver, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Dance Class Liability Waiver and Contract, including the Notice of Withdrawal section.
