Waiver/Release: Please Read This Carefully!
This Registration Form includes a release of liability and waiver of legal rights and deprives you of the right to sue The Grand Academy of Ballet (and other parties). Do not sign this Registration Form unless you have read and understood it in its entirety.
That I am making this waiver in consideration of The Grand Academy of Ballet providing my child with dance lessons, instruction, studio usage privileges, rehearsals, performances and other related activities (collectively, Activities), at The Grand Academy of Ballet premises or elsewhere.
The above-named child or student is in good health and proper physical condition to participate in Activities wherever they may occur. I agree that it is my sole responsibility to determine whether you as the participating student or your child is sufficiently healthy enough to participate in activities at any time.
Participating in Activities involves a risk of injury and dangers, which include, without limitation, the potential for serious bodily injury, permanent disability, paralysis, death; loss or damage to property; accidents, illness, contact or collision with others; equipment failure, and other unknown risks and dangers (collectively, Risks). These Risks may be caused in whole or in part by my or my child's actions or inaction, or the actions or inaction of others. I hereby expressly assume all such risks and responsibility for any damages, liabilities, losses or expenses incurred as a result of or in connection with my and my child's participation in Activities.
I and my child agree to be familiar with and abide by the rules, policies, and procedures of The Grand Academy of Ballet. I accept responsibility for my and my child's conduct and actions while participating in Activities, and the condition and adequacy of their equipment, and accept full responsibility for my / our behavior and any damage I or my child may cause to The Grand Academy of Ballet or others facilities.
I hereby forever release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless The Grand Academy of Ballet and its officers, directors, owners, employees, agents, representatives, affiliated entities, subsidiaries, parent companies, and contractors (collectively, Released Parties) with respect to any liability, claim, demand, cause of action, damage, loss or expense (including court costs and attorneys fees) of any kind or nature (collectively, Liability) which may arise out of, result from, or relate to my or my child's participation in Activities, including claims for Liability caused in whole or in part by the negligence of the Released Parties. I further agree that if despite this waiver, I or anyone on my behalf, makes a claim for liability against any of the Release Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liability which may be incurred as a result of such claim.
The Grand Academy of Ballet may not carry liability insurance for injuries or loss of property in connection with Activities. I have read this Waiver / Release carefully, understand its terms and conditions, acknowledge that I am giving up substantial legal rights by signing this Waiver / Release, acknowledge that I have signed this Waiver / Release freely and voluntarily, without inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions, and provisions of this Waiver / Release. This Waiver / Release constitutes the complete understanding between the parties regarding these issues and no oral representation, statements or inducements have been made apart from this Waiver / Release. If any provision of this Waiver / Release is held to be unlawful, void, or for any reasons unenforceable, then that provision shall be deemed separable from this Waiver / Release and shall not affect the validity and enforce ability of any remaining provisions.
Image/Photographic Release: I authorize and agree that The Grand Academy of Ballet may take and use photographs, videos or likenesses of the undersigned or the child identified in this Registration Form for The Grand Academy of Ballet record keeping, advertising, social media and/or public relations projects and that I/we have no rights to the same and will not be compensated for the same. I hereby waive any right to inspect or approve the finished photograph(s) and/or video(s) prior to any publication or other use.
