SPACE STUDIOS
Parent, Guardian and Dancer Waiver and Terms of Enrolment
By creating an account, enrolling a dancer, booking a class, joining a SPACE Studios team, attending a SPACE Studios class, workshop, rehearsal, event or training session, or allowing a dancer to participate at SPACE Studios, the parent or legal guardian confirms that they have read, understood and agreed to the following terms.
This agreement applies to all SPACE Studios dancers, including dancers participating in open classes, recreational classes, advanced training, elite training teams, rehearsals, workshops, intensives, performances and other SPACE Studios activities.
1. Parent and Guardian Responsibility
The parent or legal guardian confirms that they are authorised to register the dancer and provide information on their behalf.
The parent or legal guardian is responsible for ensuring that all information provided to SPACE Studios is accurate and kept up to date, including emergency contact information, medical information, allergies, injuries and any other information that may affect the dancer's ability to safely participate.
Parents and guardians must inform SPACE Studios of any relevant medical condition, injury, physical limitation, medication, allergy or other circumstance that may affect a dancer's participation.
Parents and guardians are responsible for reading and understanding SPACE Studios policies, communications, payment requirements, class requirements and behavioural expectations.
2. Assumption of Risk and Participation
Dance and physical training involve inherent risks, including but not limited to falls, collisions, muscle strains, sprains, fractures, other physical injuries, fatigue and aggravation of existing injuries or conditions.
The parent or legal guardian acknowledges that participation in dance and physical training involves these risks and gives permission for the dancer to participate in SPACE Studios activities.
Dancers are expected to take reasonable responsibility for their own safety and wellbeing while participating.
Dancers must communicate with their teacher or coach if they are experiencing pain, illness, injury, dizziness, discomfort or any other condition that may affect their ability to safely participate.
SPACE Studios teachers, coaches and directors will take reasonable care to provide appropriate instruction and maintain a safe training environment. However, SPACE Studios cannot guarantee that injury or illness will not occur.
3. Fitness and Medical Clearance
The parent or legal guardian confirms that, to the best of their knowledge, the dancer is physically able to participate in the activities for which they are enrolled.
SPACE Studios may request medical clearance before allowing a dancer to return to training following an injury, illness or other medical concern where SPACE Studios considers this reasonably necessary for the dancer's safety.
SPACE Studios reserves the right to modify, restrict or stop a dancer's participation where a teacher, coach or director reasonably considers that continuing may place the dancer or others at risk.
4. Injuries and Incidents
If a dancer becomes injured or unwell during a SPACE Studios activity, SPACE Studios staff may provide reasonable first aid within their level of training and may contact the parent or emergency contact.
In an emergency, the parent or legal guardian authorises SPACE Studios staff to seek appropriate medical or emergency assistance for the dancer where reasonably necessary.
The parent or legal guardian understands that they remain responsible for any medical, ambulance, treatment or related costs associated with the dancer.
5. Personal Responsibility and Belongings
Dancers are responsible for looking after their own personal belongings while attending SPACE Studios.
SPACE Studios is not responsible for lost, stolen or damaged personal property.
Dancers are expected to follow all reasonable instructions given by SPACE Studios teachers, coaches and directors and to behave in a way that protects their own safety and the safety of others.
6. Attendance
Regular attendance is an important part of dance training, particularly for dancers participating in elite training teams.
Parents and dancers are responsible for ensuring that they arrive on time and attend the classes, rehearsals, training sessions and other commitments for which they are enrolled.
Where a dancer is unable to attend due to illness, injury, holiday, personal circumstances or any other reason, the parent or guardian should notify SPACE Studios as soon as reasonably possible.
Absence from a class does not cancel the dancer's enrolment or the parent's payment obligation.
7. Term Fees and Payment
SPACE Studios term fees cover the dancer's place in the enrolled class or programme for the applicable term.
Term fees are payable in accordance with the payment terms and due dates provided by SPACE Studios.
A dancer's place in a class or team is not guaranteed until the required enrolment and payment arrangements have been completed.
Parents and guardians are responsible for ensuring that all fees are paid on time.
Where a payment plan has been agreed, the parent or guardian agrees to make all scheduled payments by the agreed due dates.
8. No Refunds After the Term Has Begun
Once a term has commenced, term fees are non refundable where a dancer chooses to withdraw or is unable to attend.
This includes absences or withdrawal due to:
• illness or sickness
• injury
• holidays or travel
• change of personal circumstances
• loss of interest
• timetable conflicts
• failure to attend
• choosing to leave a class or team
• other personal reasons
A dancer's place in a class or team is reserved for the enrolled term and fees remain payable regardless of attendance.
Where exceptional circumstances arise, SPACE Studios may consider a credit or alternative arrangement at its sole discretion. Any such arrangement is discretionary and does not create an ongoing entitlement to a credit or refund.
Nothing in this section is intended to exclude or limit any rights that cannot legally be excluded under New Zealand law.
9. Overdue Fees
Fees must be kept up to date.
If an account becomes overdue, SPACE Studios may contact the parent or guardian regarding payment and may restrict the dancer's participation until the account has been brought up to date.
SPACE Studios reserves the right to terminate an enrolment where fees remain overdue.
Where an enrolment is terminated because of overdue fees or another breach of these terms, no refund will be provided for unused classes or remaining term fees, except where required by law.
10. Behaviour and Respect
SPACE Studios is committed to providing a positive, inclusive, respectful and safe environment for dancers, teachers, coaches, directors and families.
All dancers, parents and guardians are expected to treat SPACE Studios staff, directors, teachers, coaches, other dancers and families with respect.
The following behaviour is not acceptable:
• bullying or harassment
• intimidation or threatening behaviour
• discrimination
• verbal or physical aggression
• deliberately disruptive behaviour
• disrespectful or abusive communication
• inappropriate behaviour towards teachers, coaches or directors
• inappropriate behaviour towards other dancers
• damaging SPACE Studios property
• refusing to follow reasonable instructions
• behaviour that negatively affects the safety, wellbeing or enjoyment of others
Parents and guardians are responsible for supporting and reinforcing these expectations with their dancer.
11. SPACE Studios Right to Terminate Enrolment
SPACE Studios reserves the right to terminate a dancer's enrolment where SPACE Studios reasonably considers that the dancer or their parent or guardian has:
• behaved in an unkind, disrespectful, threatening or inappropriate manner towards a teacher, coach or director
• behaved in an unkind, disrespectful, threatening or inappropriate manner towards another dancer or family
• repeatedly disrupted classes or training
• failed to follow SPACE Studios rules, policies or reasonable instructions
• breached the terms of this agreement
• caused damage to SPACE Studios property
• failed to maintain required payments or has overdue fees
• engaged in behaviour that SPACE Studios considers may compromise the safety, wellbeing or enjoyment of others
SPACE Studios may terminate an enrolment immediately where the circumstances are serious or where immediate action is considered necessary to protect the safety or wellbeing of others.
Where an enrolment is terminated due to unacceptable behaviour, a breach of these terms or overdue fees, no refund will be provided for the remaining term, except where required by law.
This policy exists to help ensure that SPACE Studios remains a positive, respectful and safe environment for everyone.
12. Class and Studio Rules
Dancers must follow all SPACE Studios class and studio rules and any reasonable instructions given by teachers, coaches and directors.
These rules may include requirements relating to appropriate clothing, footwear, punctuality, behaviour, use of equipment, studio facilities, phones, food and drink, waiting areas, supervision and general studio conduct.
SPACE Studios may update or introduce reasonable rules where necessary to maintain safety, organisation and the quality of the training environment.
13. Elite Training Teams
Dancers selected for SPACE Studios elite training teams acknowledge that team participation requires commitment, attendance, effort, teamwork and respectful behaviour.
Team dancers and their parents or guardians are expected to meet all team commitments communicated by SPACE Studios, including scheduled training, rehearsals, performances, competitions, workshops and other required activities.
Additional team fees, competition costs, costume costs, travel costs, registration fees or other expenses may apply where communicated separately.
Failure to meet team expectations may result in the dancer being removed from a team where SPACE Studios considers this necessary.
Removal from a team does not automatically entitle the dancer to a refund of fees already paid.
14. Training Environment
SPACE Studios may use exercises, choreography, conditioning, stretching and other forms of physical training appropriate to the dancer's class or programme.
Dancers are expected to work within their own physical capabilities and communicate with their teacher or coach when they are unable to safely complete an exercise.
Dancers must not deliberately perform movements or behaviours that place themselves or others at unnecessary risk.
15. Photography, Video and Promotion
SPACE Studios may photograph or record dancers during classes, rehearsals, performances, workshops, competitions and other SPACE Studios activities for legitimate studio purposes, including documenting training and performances and promoting SPACE Studios.
Where required, SPACE Studios will seek appropriate consent for the use of identifiable images or recordings of dancers in promotional material.
Parents or guardians may contact SPACE Studios if they have concerns regarding the use of a dancer's image.
16. Emergency Contact
The parent or guardian authorises SPACE Studios to contact the emergency contacts provided on the dancer's account where reasonably necessary.
Parents and guardians are responsible for ensuring that emergency contact information remains current.
17. Studio Property and Facilities
Dancers and families must take reasonable care of SPACE Studios premises, equipment and property.
Any deliberate or negligent damage caused by a dancer may result in the parent or guardian being responsible for reasonable repair or replacement costs, where legally permitted.
18. Changes to Classes or Programmes
SPACE Studios may make reasonable changes to class times, teachers, rooms, programmes or training arrangements where necessary due to operational requirements, teacher availability, health and safety considerations or other circumstances.
SPACE Studios will provide reasonable notice where practicable.
19. Communication
Parents and guardians are responsible for checking communications sent by SPACE Studios, including emails, parent portal messages, text messages and other official studio communications.
Important information regarding classes, payments, schedules, rehearsals, events and changes may be communicated through these channels.
20. Parent and Guardian Conduct
Parents and guardians are expected to support SPACE Studios staff and maintain respectful communication.
Concerns or complaints should be raised directly with SPACE Studios management rather than with teachers, coaches, dancers or other families during classes or training.
Aggressive, abusive, threatening or disrespectful communication towards SPACE Studios staff, teachers, coaches or directors will not be tolerated.
SPACE Studios may take appropriate action, including termination of the dancer's enrolment, where a parent's or guardian's conduct negatively affects the safety, wellbeing or environment of the studio.
21. Acknowledgement and Agreement
By agreeing to these terms, the parent or legal guardian confirms that they:
• have read and understood this agreement
• understand that dance and physical training involve inherent risks
• understand that the dancer is responsible for communicating pain, injury, illness or discomfort to their teacher or coach
• understand SPACE Studios' payment and attendance requirements
• understand that term fees are non refundable once the term has commenced, subject to rights that cannot legally be excluded
• agree to keep all fees up to date
• agree that the dancer and their family will follow SPACE Studios rules and behavioural expectations
• understand that SPACE Studios may terminate an enrolment where these terms are breached or where behaviour compromises the safety, wellbeing or enjoyment of others
• confirm that all information provided to SPACE Studios is accurate
• agree to communicate respectfully with SPACE Studios staff, teachers, coaches, directors, dancers and families
• consent to the dancer participating in SPACE Studios classes, training, rehearsals, performances and related activities
By selecting the agreement checkbox, the parent or legal guardian confirms that they have read, understood and agree to these terms on behalf of themselves and the dancer they are registering.
Parent or Guardian Agreement
I confirm that I am the parent or legal guardian of the dancer being registered, that I have read and understood the SPACE Studios Parent, Guardian and Dancer Waiver and Terms of Enrolment, and that I agree to these terms on behalf of myself and the dancer.
I understand that I am responsible for ensuring that all information provided is accurate, that fees are paid when due, and that both the dancer and I follow SPACE Studios rules, expectations and policies.
