1. CODE OF CONDUCT

Jody Marshall Dance Company (‘JMDC’) is committed to providing safe, exciting and educational classes for each of our students. Along with excellent technique, enjoyment and artistic expression, we believe that ethics – moral principles, standard practices, and etiquette are crucial elements of dance education. In order to provide a safe and uplifting environment for everyone, we ask that instructors, parents and students follow the studio’s code of conduct. It takes everyone’s cooperation to create a positive learning experience. Thank you in advance for working together.


a) Conduct in class
To facilitate a positive and enriching learning environment for all, students are required to:

• Show respect to their instructors and other students, this means:
o Refrain from offering advice to other students or teachers in class or on the dance floor unless directly asked
o Try to attend all classes punctually. As a courtesy, apologise when interrupting a class
o Advise teachers (in advance where possible) if you will be absent from class by using the Dance Studio Pro parent portal
o Seek permission from an instructor prior to leaving a class
o Leave your mobile phone outside of the dance class or in allocated areas, unless you require it for filming during private lessons
o Be respectful and quiet when other classes are taking place
o When representing JMDC in public forums, including online forums, be mindful that your language, conversations and behaviour will reflect on the studio, and moderate accordingly
o Treat teachers and other students respectfully – bullying will not be tolerated
• Revise and practice when preparing for performances/exams
• Ensure to enrol in the required classes, if preparing for an exam or performance

b) Dress code/personal hygiene
To ensure a comfortable class atmosphere, students are required to:
• Present to class in a neat and tidy manner and adhere to the JMDC Dress Code (which can be found in hard copy at the Balcatta studio, on the JMDC Notes and Information Page, and also on the DanceStudio-Pro parent portal).
• Use deodorant. Students who perspire excessively should keep a personal hand towel on hand and/or change of clothing.
• Remove any watches, whether electronic or not and jewellery, prior to entering class.

c) Respect for JMDC premises
To ensure JMDC remains a clean and pleasant learning environment for all, students and parents are asked to adhere to the following rules:
• Respect the studio property and premises – please clean up if you make a mess
• Do not enter the JMDC canteen unless supervised by an instructor or canteen volunteer

d) Parent / Guardian conduct

To facilitate a positive and enriching learning environment for all, parents/guardians are required to:

• Show respect to staff, students and other parents, this means:
o Refrain from offering advice to other students, teachers or parents unless directly asked
o Not speaking negatively to or about students, staff or other parents either verbally or in a written forum
o Not contacting teachers directly regarding any issues and concerns, instead emailing scluplau@gmail.com for it to be dealt with
o Adhering to expectations outlined in competition commitment forms

e) Mental Health and Wellbeing
JMDC recognises that there are a variety of mental health issues and illnesses that affects a student’s ability to come to, remain at the studio and participate in dance. JMDC have a responsibility to ensure that appropriate steps are taken to minimise and eliminate health and safety risks in the studio including psychological risks. This responsibility includes ensuring a culture that promotes and supports a positive approach to psychological, physical, social, emotional, cultural, organisational and professional wellbeing.
JMDC encourages parents to discuss mental health with management and report any symptoms as soon as possible so that these can be managed promptly. Management will effectively communicate with teachers regarding concerns, changes, recognising, supporting, and working on resolving matters.

f) Bullying & Harassment
Bullying and harassment within the studio, whether by management, staff, students or parents will not be tolerated. Regardless of whether bullying or harassment occurs via physical, verbal or non-verbal conduct, the experience can adversely affect the psychological and physical health of a person. The risk bullying and harassment can be minimised, so far as is reasonably practicable, by creating and promoting a positive physical environment and culture where everyone is treated fairly and with respect. JMDC will ensure that effective control measures are implemented to address and resolve issues early, thereby minimising the risk of bullying or harassment.
JMDC has a separate Anti-Bullying Policy available outlining studio expectations. This policy applies to all teachers and students of JMDC, whether volunteer or paid. JMDC expects that everyone has respectful interactions with one another, to provide a working environment that is cohesive and comfortable. JMDC will not tolerate any bullying in the studio.

g) Grounds for dismissal
JMDC reserves the right to terminate or suspend the provision of dance instruction to any students on the following grounds:
• Use of illicit drugs, alcohol or tobacco/vape products on the studio grounds – by a student or family member
• Any illicit activity on JMDC premises
• Failure to pay for dance fees, despite repeated contact from JMDC requesting payment
• Disruptive, rude, aggressive or inappropriate conduct/behaviour on studio grounds, in competition forums or in JMDC Facebook groups – including toward any member of JMDC staff, students and families

2. COMMUNICATIONS

JMDC sends communications out to students and families regularly via email, text message and social media. It is each student/family’s responsibility to ensure they are up to date with the most recent communication. To facilitate this, please ensure you:

a) Join the following Facebook groups:

• JMDC Competition Students – For Solo/Duo/Trio students only

b) Log-in to the JMDC DanceStudio Pro Parent Portal, accessed via this URL:

3. MEDICAL INFORMATION AND MEDICATION
Upon enrolment, parents/caregivers complete an ‘Enrolment Form’. They are required to provide any medical conditions, medication required and an emergency contact person other than the main parent/caregiver contact.
If a student has Type 1 Diabetes, Asthma, Anaphylaxis or any other serious allergies, parents/caregivers will be required to provide a ‘Management Plan’ for their condition. A copy will remain at the DanceAUS Group head office and a second copy will be issued to the class teacher for on site management.
On site medication is to be provided to the teacher in a clearly marked bag with the student name on it.
Medical information is only accessible by our head office team and the student’s specific teacher only.

4. LOST PROPERTY

Lost property will be available at the Balcatta studio for one month (30 days), after which it will be removed from the studio. JMDC does not accept any liability for the loss of personal items. Please keep valuable items at home.

5. CLASS ENROLMENT AND CANCELLATION

a) Classes

By enrolling at JMDC, you acknowledge the following:
• You understand and accept the attached Liability Waiver
• There will be no guaranteed supervision of students, other than when the dancers are in the classroom with their teachers. However, young children who are dropped off to the studio via the ‘Kiss n Ride’ process will be supervised in the foyer by parent volunteers and JMDC admin staff during drop off and pick up times only.
• Class numbers are restricted, and classes are filled on a first come first served basis.
• The duration of different classes differs, and you will be advised of the duration of your class at enrolment.
• The duration of classes may need to change. If so, every effort will be made to contact parents on any changes.
• If a student misses four consecutive classes, that student will be automatically removed from the attendance list. Reenrolment will be at JMDC’s discretion and a $5.00 administration fee will apply.
• If a student misses four or more classes during the term of exam or competition work, that student may not be able to sit the exam or compete in performances.
• Permission to compete in solos, duos, trios and troupes is at the teacher’s discretion. A certain level or experience may be required to perform in troupe items.
• You must dance and compete in your relevant age group and will only dance “up” in an older age group or troupe if invited.
• Some classes have prerequisites, please see separate prerequisites documents for more details. Classes cannot be attended without meeting the required prerequisites.
• Competition students have added expectations and prerequisites – in committing to competition work separate documents listed below will be read, signed and returned to the studio in acknowledgement
• Some classes attract smaller numbers. If your chosen class does not have enough students, it will be cancelled, and you will be informed as soon as possible.
• If a student misses a class, whether it’s due to sickness, holidays or a prior commitment, JMDC unfortunately cannot offer makeup classes or transfer credit to another Term.
o Exceptions to this rule may be made if a student is unable to attend classes for an extended period of time due to an injury (a medical certificate may be required) or unforeseen circumstance.
o If a student wishes to seek an exception to this rule, JMDC requires a written explanation sent to jmdcinvoicing@outlook.com as well as scluplau@gmail.com. Once a decision has been made you will receive an email reply and no further discussion will be entered into.
o Any exceptions are at the sole discretion of JMDC owners.

b) Enrolment
Upon enrolment I acknowledge that I will follow all relevant corresponding health advice as directed by the Western Australian Government when in attendance at Jody Marshall Dance Company. This may include but is not limited to the wearing of masks and signing in using the relevant app every time you enter the building.

Enrolment allows access to group classes as specified by JMDC. This access changes from term to term. Enrolment does not cover other events/classes such as private lessons, stage rehearsals, dress rehearsals, mock exams, added competition rehearsals, performances, concerts etc.

To ensure the smooth operation of classes, and adequate instructor allocations for class numbers, the following must be adhered to:

• Enrolments for term classes must be completed at the beginning of each calendar year
• Registrations must be completed for each individual dancer
• Enrolment of new students will always be at JMDC’s discretion, and may be limited due to class numbers and work being taught in individual classes.

c) Cancellation

• Cancellation of enrolment must be made in writing to jmdcinvoicing@outlook.com prior to the commencement of the next term. Failure to do so may result in further charges being issued.
• We understand that circumstances change and you may change your mind about particular classes. If this occurs, please contact us within seven days of your invoice being issued and before payment is made.
o JMDC may reissue you a new invoice and offer a class credit if you have not commenced classes.
o Unfortunately, if you have already commenced classes for the term, we cannot offer a credit or a refund. Please contact JMDC invoicing to discuss your particular circumstances.

6. PAYMENT

a) Trial/Casual class payments

a. Trial classes can be attended for a fee of $20.
b. Casual classes can be taken in some senior classes at the cost of $20 per class. Please refer to JMDC’s Facebook and Instagram pages for information about casual classes.

b) Term payments

• Invoices are issued for each term (8–11-week block), and there are 4 Terms each year. Each term usually has a two-week break. Please note, these term times may be disrupted by Government requirements due to unforeseen events.
• Invoices are emailed at the commencement or up to 4 weeks prior to the commencement of term.
• Full payment of invoice is due within 14 days of issue of invoice unless other payment option has been chosen and approved (proposed payment option must be made in writing to jmdcinvoicing@outlook.com).
• If changes are needed to be made to the invoice these must be made in writing to jmdcinvoicing@outlook.com within 7 days of issue of invoice.
• Discounts to term fees are issued depending on:
o How many classes are attended in a week
o How many students from the same family are attending
o Age of students
Capping amounts are set amounts that don’t change due to term lengths.
• Late payment can incur a 10% late payment fee.
• Non-payment may mean the inability to continue attending classes, competition classes or to reenrol the following term or year, as well as withholding costumes or tickets until accounts have been paid in full.
• If, after attempts are made by the studio to collect fees but they have not been received in part or full, JMDC reserve the right to pass on any relevant information to external debt collectors.

7. PANDEMICS/UNFORESEEN EVENTS

a) Cancelled classes

• In the rare event that a class is cancelled every endeavour will be made for a makeup class to be given however if this cannot be done or the student cannot attend the makeup class, refunds and credits do not need to be issued - the decision will be at JMDC’s discretion.

b) Online/ZOOM classes

• JMDC reserves the right to transfer any class or program to 100% ZOOM/online instruction if they see fit for reasons beyond its control, including, but not limited to, concerns or restrictions relating to pandemics. In the event of any such transfer, no monies will be refunded and no discounts or transfers of tuition will be given.
• By registering for classes, families agree to provide a designated area for their child(ren) to take classes remotely from their home if the decision is made to transfer any class or program to ZOOM/online instruction.
• In addition, families understand and agree to accept a modified schedule via ZOOM if this situation arises. The modified ZOOM schedule will be well thought-out, and in the best interest of the students and staff.
• In the event of ZOOM/online classes occurring, discounts to term fees may be issued, at JMDC’s discretion, depending on:
o How many classes are attended in a week
o How many students from the same family are attending
o Age of students

8. PRIVACY

The privacy of your personal information (whether provided electronically or offline), is very important to JMDC.

a) Collection and use
When you register for classes at JMDC we collect contact information such as guardian names, addresses, phone numbers, emergency contacts, e-mail address, student names, birthdays, medical conditions, correspondence, proof of vaccination and your comments. This information is required to be collected and used to manage studio business and will not be accessed, used or sold for any other purpose, except as described below.

b) Third party access
JMDC administrative staff have access to your personal information for the sole purpose of managing the studio business. JMDC staff will not share your information with third parties unless:
1. required to do so by law or to comply with legal process; or
2. to protect the rights, property, or personal safety of the public.

If you have any questions about our privacy policy or if you wish to update or remove any of your personal information from our records, please contact JMDC invoicing.


9. IMAGE RELEASE

Jody Marshall Dance Company may take images (photographs and/or videos) of enrolled students and families that may be used to document activities of Jody Marshall Dance Company. These images may be used in promotional materials, social media accounts and websites of Jody Marshall Dance Company. All images are for the exclusive use of Jody Marshall Dance Company and are property of same. If any parent or guardian does not want their or their child's image used, or does not want their child tagged in images, they must notify and inform JMDC in writing at the time of registration.

10. COMPLAINTS & COMPLIMENTS

As a studio we are always looking for ways to improve, grow, acknowledge our staff and deal with inappropriate behaviour.
We ask that all compliments, complaints and feedback please be forwarded via email only to Sheridan Luplau scluplau@gmail.com Sheridan will endeavour to respond within 48 hours by phone or email depending on each individual email. She will advise on what action will be taken, if necessary.



Attachment A: LIABILITY WAIVER
By registering to attend any JMDC classes you agree to this Liability Waiver

1. I understand that JMDC does not guarantee supervision of students except when they are in class.

2. I agree to keep any and all communication with JMDC staff private, I will not share correspondence to others by any means including but not limited to screenshots, text, social media or private message forums.

3. I/my child am/is participating in classes, offered by JMDC whether online or in person. I recognise that dance classes require physical exertion that may be strenuous and cause physical injury, and I am fully aware of the risks involved.

4. I acknowledge that participating in dance classes and related activities may involve emotional and psychological challenges, including but not limited to performance anxiety, stress, and self-esteem issues. I voluntarily assume all risks associated including risks to mental health and emotional well-being.

5. I understand that it is my responsibility to consult with a physician prior to and regarding my/my child’s participation in the classes. I represent and warrant that I/my child am/is physically and mentally ‘fit’ and capable and I have no medical or mental condition that would prevent my participation in the classes.

6. I understand that it is my responsibility to advise the studio and instructors of pregnancy, injury or any conditions so the instructor can provide suitable modifications where required.
I will obtain and provide by email any medical certificates, professional injury management and or recovery plans and medical clearance documents as requested by any staff, instructors, or the owner of JMDC and consent to a copy of these records to be kept on file.

7. I agree that Jody Luplau and JMDC instructors reserve the right to limit or deny participation in classes and performances at any time during illness and injury recovery or if medical clearance cannot be obtained.
I acknowledge that under these circumstances, claims of discrimination cannot be made.

8. I agree that by enrolling and partaking in these services and in the use of the property, it is at my/my child’s own risk and hereby release and discharge the Principal, its officers, employees, contractors and agents from all claims and demands of any kind whatsoever and from any liability including, without limitation, liability for negligence which may arise in respect of any accident, damage, destruction, debt, or injury to the service provider, its employees, agents, or permitted subcontractors or to any property of the contractor, its employees, agents, or permitted subcontractors which occurs in relation to the provision of Services, save where such liability arises from any wilful or negligent act or omission of the Principal, its employees or agents.

9. I agree to indemnify and keep indemnified the Principal, its officers, employees, contractors, volunteers, and agents against all claims, actions, demands, proceedings, liabilities, damages, costs and expenses whatsoever and howsoever arising, paid, suffered, or incurred by the Principal, its officers, employees, or agents, directly or indirectly as a result of or in connection with partaking in the Services.

10. I authorise JMDC, through its staff and personnel, to obtain, consent to and authorise emergency medical care or treatment in the event that such care is necessary or appropriate in the opinion of the staff and personnel for the benefit of a student due to accident, injury or illness. JMDC will only exercise such consent and authorisation for medical care or treatment in the absence of a student’s parent/guardian and only if it is unable to reach a student’s parent/guardian within a reasonable period of time given the circumstances of the emergency. Parents/guardians will be responsible for making payment of all costs of any such medical care or treatment directly to the hospital, physician or facility providing such care.
