The privacy of your personal information is very important to Westland Dance Co. Ltd. We will not sell, rent or trade your personal information to any third party. We will take special care to protect the privacy and security of your information. This policy explains our information practices and the way that Westland Dance Co. Ltd. collects and uses your information. This Privacy Policy covers the information you provide to us offline and at Westland Dance Co. Ltd. website.
HOW DOES WESTLAND DANCE CO. LTD. COLLECT AND USE MY INFORMATION?
When you register for classes at Westland Dance Co. Ltd., we collect contact information such as guardian names, addresses, phone numbers, emergency contacts, e-mail address and student information such as student names, birthdays, medical conditions, and your comments. Some of the information is required and is noted on the forms. This information is needed to manage studio business and will not be used or sold to any third party business for any other purpose, except as described below. Some optional information is requested to help us better understand our customers and is used only as needed for studio business. This information will not be used or sold for any other purposes, except as described below.
WHO HAS ACCESS TO MY INFORMATION?
When you register, you are required to enter an email address and a password. The combination of that e-mail account and password is used to ensure that only you have access to, and only you have the ability to modify your personal information through Westland Dance Co. Ltd.’s Parent portal. Westland Dance Co. Ltd.’s office personnel have access to your personal information only to manage the studio business.
Westland Dance Co. Ltd. will access your personal information and/or share it with third parties only for the following purposes: (i) as needed for studio business (including but not limited to merchandise, printed posters for events, year end programs, newspaper submissions, social media post and/or submissions, etc.); (ii) if required to do so by law or to comply with legal process; or (iii) to protect the rights, property, or personal safety of the public.

Release and Waiver of Liability-
PLEASE READ THIS CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR AND YOUR CHILD’S LEGAL RIGHTS.
This is a Release and Waiver of Liability (the “Release”) executed on this 1st day of June, 2023 by the “Participant”, in favor of Westland Dance Co. Ltd. (WDC), a Legal Corporation, and its contractors, employees and agents.
Participant desires to participate in certain dance classes and activities of Westland Dance Co. Ltd. and assures that Participant is in proper physical condition to take part in dance classes and activities at Westland Dance Co. ltd. Participants understand that there are risks of physical injury and/or illness associated with, arising out of, and inherent to dancing and activities associated therewith. In recognition of this acknowledged risk of injury and/or illness, and in consideration of being accepted into such dance classes or activities Participant hereby freely, voluntarily and without duress executes this release and waiver of liability under the following terms:
1. Release of Liability
Participant does hereby release and forever discharge and hold harmless Westland Dance Co. Ltd., its Owners, Contractors and employees for any and all claims or demands for damages, loss of services, costs and expenses in any way resulting from any and all injury and/or illness to Participant or property of Participant arising directly or indirectly out of Participant’s participation in any and all activities of Westland Dance Co. Ltd. including, but not limited to, dance classes, competitions, festivals, recitals, costumes, travel to and from competitions, festivals, and recitals and any and all activities associated or performed in conjunction with Westland Dance Co. Ltd..
Participant understands that this Release discharges Westland Dance Co. Ltd. from any liability or claim that the Participant may have against Westland Dance Co. with respect to any bodily injury, personal injury, illness, death, or property loss or damage that may result from Participant’s activities with Westland Dance Co. Ltd., whether caused by the negligence of Westland Dance Co. or its owners, employees, contractors or otherwise. Participant also understands that Westland Dance Co. Ltd. does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to, medical, health, or disability insurance in the event of injury and/or illness.
2. Indemnification
Participant agrees to indemnify and hold forever harmless Westland Dance Co. Ltd., its owners, employees and contractors from any and all injuries, illnesses, damages, costs and attorney’s fees whatsoever which may arise out of the Participant’s participation in any Westland Dance Co. Ltd. activity or presence on or off the premises of the dance studio.
3. Medical Treatment
By checking the box or signing below, participant consents and authorizes the employees, representatives and contractors of Westland Dance Co. Ltd. to obtain necessary medical treatment or hospitalization or such other care necessary for the health and welfare of Participant, and Participant agrees to be responsible for and pay the cost of such medical treatment or hospitalization.
In the event of a medical emergency, I authorize Westland Dance Co. Ltd. staff or representatives to administer basic first aid and to contact emergency services as needed. I understand that I am responsible for all medical expenses incurred.
I have alerted Westland Dance Co. Ltd of any and all medical conditions and allergies of my child. I understand it is especially important to alert Westland Dance Co. Ltd of any health conditions my child has.
By checking the box or signing below, participant hereby authorizes Westland Dance Co. Ltd., its employees and contractors to consent to x-ray examinations, anesthesia, medical or surgical diagnosis, and or treatment and hospital care to be rendered to Participant pursuant to the advice of a physician, surgeon or dentist licensed under the laws of Province of Alberta. Participant does hereby release and forever discharge Westland Dance Co. Ltd. from any claim whatsoever which may arise or may hereafter arise on account of any first aid, treatment, or service rendered in connection with Participant’s participation in Westland Dance Co. Ltd. activities or with the decision by any representative or agent of Westland Dance Co. Ltd. to exercise the power to consent to medical or dental treatment as such power may be granted and authorized herein.
4. Insurance
Participant understands that, except as otherwise agreed to by Westland Dance Co. Ltd. in writing, Westland Dance Co. Ltd. does not carry or maintain health, medical or disability insurance coverage for any participant. Participant understands that it shall be Participant’s sole responsibility to obtain his or her own medical or health insurance coverage for Participant.
5. Photographic/Audio/Print Release
Participant does hereby grant and convey unto Westland Dance Co. Ltd. all right, title and interest in any and all photographic images, video, audio recordings, and/or printed names on merchandise, made by Westland Dance Co. Ltd. during Participant’s participation of any and all Westland Dance Co. Ltd. activities, including, but not limited to, any royalties, proceeds or other benefits derived from such photographic images, video, audio recordings, and/or printed names and further consenting to use Participant’s photographic images, video, audio recordings, and/or printed names or likeness in or on any form of advertisement for Westland Dance Co. Ltd. or a Westland Dance Co. Ltd. sponsored event.
6. Choreography Ownership, Instruction & Instructors
Participants understand any choreography provided by Westland Dance Co. Ltd.'s instructors is the property of Westland Dance Co. Ltd. This choreography cannot be replicated at any time, current or future, without permission from Westland Dance Co. Ltd. This applies to all group dances, duets, solos, small groups, and any additional choreography. Westland Dance Co. Ltd. may modify choreography at their discretion and may accommodate replacement dancers as required. Permission is also hereby granted for Westland Dance Co. Ltd. to copyright such choreography in its name.
Westland Dance Co. Ltd. reserves the right to assign, replace, or substitute instructors at any time during the season without notice. Instructor schedules, class assignments, and teaching staff are subject to change based on studio needs, availability, programming requirements, or operational decisions.
Instructor assignments are not guaranteed and may change throughout the season at the discretion of Westland Dance Co. Ltd. to best support program structure, scheduling, and studio operations.
No refunds, credits, or fee adjustments will be provided as a result of instructor changes.
7. Online Sharing
Participants will not post choreography publicly online on any social media or online platform including, but not limited to Facebook, Youtube, Instagram, TikTok, Snapchat, BeReal. Etc. without the expressed permission of Westland Dance Co. Ltd.
Photos or Videos taken from watching weeks, performances, or rehearsals may NOT be posted online without the consent of the Directors/Westland Dance Co. Ltd. You may not post photographs / videos that feature Westland Dance Co. Ltd. dancers other than your own online without the proven consent of their parent/guardian. Identifying information of any featured minors - including names, ages or location - must be removed when posting on Social Media.
Westland Dance Co. Ltd. reserves the right to request the removal of any photo, video, or online content at any time. Upon such request, content must be removed immediately by the parent/guardian or participant within 24 hours unless otherwise specified. Failure to comply with removal requests may result in immediate suspension from classes, performances, competitions, or studio activities at the discretion of the Directors, without refund or credit.
8. Logo use
Participant understands they are not to use Westland Dance Co. Ltd.’s logos, name, or graphics, in part or in whole, for any personal merchandise or property at any time without written permission from Westland Dance Co. Ltd.
Participants and parents/guardians may not use “Westland Dance Co.,” “WDC,” or any variation of the studio’s name in social media handles, usernames, or account names without prior written permission from Westland Dance Co. Ltd. This includes, but is not limited to, Instagram, TikTok, Snapchat, Facebook, and YouTube.
If a violation is discovered, Westland Dance Co. Ltd. reserves the right to request that the account name be changed immediately and/or that logos be removed. Failure to comply may result in disciplinary action, up to and including removal from performances, competitions, or the studio, at the discretion of the Directors.
9. Video and Audio
Westland Dance Co. Ltd. employs the use of video and audio recording equipment within the studio premises. This system is utilized for both security and business purposes, ensuring the safety and well-being of our students, staff, and visitors, as well as enhancing the quality of our services. By entering our studio, you acknowledge and consent to the following:
Video and Audio Recording: Surveillance cameras with audio recording capabilities are in operation throughout the studio. These recordings may capture activities, conversations, and other interactions that occur within the premises.
Purpose of Recording: The primary purposes of these recordings include, but are not limited to, security monitoring, loss prevention, quality assurance, and business analysis. This helps us to maintain a safe and secure environment, improve our services, and protect our assets.
Compliance with Legal Standards: Westland Dance Co. Ltd. adheres to all applicable provincial and federal laws and regulations regarding video and audio surveillance. This includes ensuring that our recording practices meet the requirements set forth by privacy legislation and other relevant statutory guidelines.
By continuing to use the facilities at Westland Dance Co. Ltd., you consent to the recording and use of audio and video footage as outlined in this notice. If you have any concerns or questions about our surveillance practices, please contact our management team for further information.
10. Attendance
Your child’s attendance in class is very important to their peers and our teaching staff. As a
member of the team, it is a commitment for you to ensure your child attends their classes on
time each week and attends all lessons and events planned for them. Not only do absences impact the competitive, festival, and recital routines we create, it also impacts the social and confidence-building principals we work hard to foster in each age group.
All absences must be reported to the studio in advance via email.
If you know that your child will be absent due to holidays/vacations, commitments or school trips, please let us know ahead of time so the class impact is minimal. If your child is too unwell to attend class, please inform our studio as soon as you can so instructors can be informed and preparations can be made.
Unfortunately we are unable to accommodate make-up sessions for students who miss classes, but will make every endeavour to schedule a catch-up class in the unlikely event that Westland Dance Co. needs to cancel a lesson.
Students are expected to arrive on time for all scheduled classes. If a student will be absent, Westland Dance Co. Ltd. must be notified in advance with a reason provided.
After two (2) missed classes, a warning will be issued to the student and parent/guardian. Continued absences following a warning will be escalated to the Directors for review.
Westland Dance Co. Ltd. reserves the right to suspend or terminate enrollment due to repeated absences that impact class progression, at the discretion of the Directors, without refund or credit.
Westland Dance Co. Ltd. also reserves the right to remove a student or routine from performances, competitions, or events if attendance issues or lack of preparedness are affecting the integrity of the work, without refund or credit.
Mandatory Events
All scheduled performances, rehearsals, competitions, photo days, and studio events are considered mandatory for enrolled students unless otherwise specified by Westland Dance Co. Ltd.
Failure to plan for and attend mandatory events may result in removal from routines, performances, or the remainder of the season effective immediately, without refund/credit.
11. Class Cancellations & Make-Up Classes
Westland Dance Co. Ltd. reserves the right to cancel classes due to circumstances including, but not limited to, weather conditions, instructor illness, facility issues, competitions, or other unforeseen events.
Make-up classes or alternate arrangements may be offered at the discretion of the studio but are not guaranteed.
In the event that a make-up class cannot be scheduled, no refunds or credits will be issued.
Schedule changes, substitutions, or adjustments may occur throughout the season as required.
Westland Dance Co. Ltd. reserves the right to provide a substitute instructor or combine classes when necessary.
12. Payments
Auto-Pay Authorization
By registering, the account holder authorizes Westland Dance Co. Ltd. to charge the card on file for all tuition, fees, costumes, merchandise, competition fees, late fees, and any outstanding balances.
Westland Dance Co. Ltd. reserves the right to process payment on file at any time for overdue accounts. It is the account holder’s responsibility to ensure valid payment information is on file at all times.
All costume, competition, and additional fees must be paid by the deadlines provided. Failure to meet deadlines may result in the student not being included in the routine, costume order, or event.
Enrollment secures a student’s place in class. Missed classes, regardless of reason, do not result in paused tuition, tuition credits, refunds, or transferred balances.
13. Withdrawals
Withdrawal requests must be submitted prior to the 1st of the month and are subject to one (1) final billing cycle. Requests submitted after this date will result in the following month’s tuition being charged in full.
To process a withdrawal, a request must be made in writing to westlanddanceco@ gmail.com. A withdrawal form will need to be filled out. From there, Westland Dance Co. will process the withdrawal for your account once all fees have been paid.
FULL YEAR STUDENTS:
If a withdrawal is made after October 1st, there will be no refund on competition or festival fees, costume fees, or choreography fees. Any withdrawals made in the middle of the month will not receive a refund or tuition credit for unused tuition for that month.
If a costume has been ordered and the studio requires this costume for a fill-in student, Westland Dance Co. will purchase the costume off of you and a refund will be given. This is not optional if the costume is required by WDC.
If WDC needs to switch sizes with another student, priority will be given to the student still enrolled in WDC using the costume for a performance. This is not optional if the costume is required by WDC.
If a costume has been ordered, not required by WDC, and paid for, you are welcome to come pick up the costume once they have been handed out to students.
SESSION STUDENTS(Fall, Winter, Spring): Withdrawals processed within a week (7 days) or more before the beginning of the program may be eligible for an account credit at the Director’s discretion.
Withdrawals processed with less than a week (7 days) before the beginning of the program will be eligible for an account credit.
There will be no refund for withdrawals for unused tuition after a session has begun. Tuition credit for any unused classes is at the discretion of the directors.
WITHDRAWAL FEE:
Session students (Fall, Winter, Spring, Summer Camps):
Processing a withdrawal for a Session student will be required to pay a $30+gst/student Withdrawal Admin Fee. This fee is due via card saved on Auto-pay, or via etransfer, before a withdrawal is processed. WDC will process this fee once the withdrawal form is recieved.
Recreational Students-
Processing a withdrawal for a full or half year Recreational class will be required to pay a $75+gst/student Withdrawal Admin Fee. This fee is due via card saved on Auto-pay before a withdrawal is processed. WDC will process this fee once the withdrawal form is recieved. Please note, any withdrawals not processed before the 1st of the month will still be charged the Auto-pay tuition on the 1st of the month.
Festival/Competitive Students:
Processing a withdrawal for a full year Festival or Competitive class will be required to pay a $150+gst/student Withdrawal Admin Fee. This fee is due via card saved on Auto-pay before a withdrawal is processed. WDC will process this fee once the withdrawal form is recieved. Please note, any withdrawals not processed before the 1st of the month will still be charged the Auto-pay tuition on the 1st of the month.
Reblocking Fee (Competitive Programs):
Withdrawals from Festival or Competitive programs after January 1st will be subject to an additional $100+gst/student reblocking fee. This fee reflects the administrative, choreographic, and scheduling adjustments required for remaining team members and routines.
14. Refunds
There will be no refunds given on registration fees or PREF fees after registration has been submitted. There will be no refunds given on additional fees IF the fees have already been collected. There will be no refunds for any session that has already begun. Tuition fee refunds or account credits on unused classes will be at the discretion of Westland Dance Co. Ltd.’s Directors. There will be no refunds on purchased merchandise, costumes, and/or dance attire due to sizing discrepancies.
15. Unpaid Fees
Westland Dance Co. Ltd. reserves the right to suspend lessons, participation in group choreography, and participation in any additional programming including, but not limited to, solos, duets, small groups, Elite teams, travel teams, performances, competitions, and events if tuition or fees remain unpaid.
Accounts are due on the 1st of each month. Any balance not paid by the 2nd is considered overdue.
Westland Dance Co. Ltd. reserves the right to process payment on file for any outstanding balances.
Students with overdue accounts may be required to sit out of classes, rehearsals, or activities at any time until the account is brought into good standing.
A late fee will be applied to accounts that remain unpaid after fifteen (15) days.
All accounts must be paid in full prior to the 1st of the following month. Accounts with outstanding balances beyond this date will be considered delinquent and may result in immediate suspension from all studio activities, at the discretion of the Directors, without refund or credit.
Students with outstanding balances are not permitted to participate in competitions, performances, rehearsals, classes, or events until the account is current. Reinstatement of participation is at the discretion of the Directors.
No costumes, merchandise, or studio-issued items will be released with an outstanding balance on the account.
If a scheduled payment is declined, Westland Dance Co. Ltd. reserves the right to immediately reprocess the payment and/or require earlier payment of upcoming fees to maintain account standing.
Should you anticipate any payment delays, you must contact the studio in advance at westlanddanceco@gmail.com. Any payment arrangements are at the sole discretion of the Directors.
Collection Costs:
Westland Dance Co. Ltd. reserves the right to pursue outstanding balances through collections or legal means. The account holder will be responsible for any additional costs incurred, including but not limited to collection fees, legal fees, and administrative costs.
16. Late fees
Declined payments or unpaid accounts by the 15th of the month, will result in Westland Dance Co. Ltd. running the card on the account on the 15th. If the card is still declined or alternate payment has not been discussed, a $30+gst/student fee will be added to your account.
Late fees may continue to be applied to overdue accounts monthly at the discretion of Westland Dance Co. Ltd. until the balance is paid in full.
17. Questions and/or Complaints, Parent and/or Student Respect
Any questions or complaints must go through Our studio Directors, Vickie Wesolowsky and/or
Alyssa Landry, via written email, and then will be answered accordingly – parents and students are not permitted to contact Westland Dance Co. teachers via personal phone, in person, or via personal email / social networking with studio issues unless it has been approved by the studio Directors. Personal meetings with the studio owner can happily be arranged via email. The Directors may choose to handle the complaint however they see fit and do not have to disclose the results to the complainant.
In the rare case of a parent or student showing disrespect or defamation to any parent, staff
member or student, a meeting may be called immediately and dismissal may be considered at
the discretion of the studio directors. Physical, mental, emotional or cyber bullying by parents,
staff or students will not be tolerated and may result in dismissal from the studio.
18. Miscellaneous
This Release and Waiver of Liability shall be binding on the heirs, successors and personal representatives of the Participant. Participant expressly agrees that this Release and Waiver of Liability is intended to be as broad and inclusive as permitted by the laws of the Province of Alberta, and that this Release and Waiver of Liability shall be governed by and interpreted in accordance with the laws of the Province of Alberta. Participant agrees that in the event that any provision herein shall be held to be invalid by any court of competent jurisdiction, the invalidity of such provision shall not otherwise affect the remaining provisions of the Release and Waiver of Liability which shall continue to be enforceable to the full extent permitted under the law.
In the event of conflict between policies, the Directors of Westland Dance Co. Ltd. retain final authority of interpretation and enforcement.
I have read the foregoing Release and Waiver of Liability and acknowledge that the provisions are contractual and not a mere recital and I understand that I am bound by the terms hereof by placing my signature herein. I also understand and agree that these waivers and policies may change at anytime and a new signature may or may not be required.
If Participant is a minor, the parent having legal custody and/or the legal guardian of the minor hereby represents and warrants that they have the legal authority to bind the Participant and such parent or guardian executes this release on behalf of the minor and the parent or guardian, and this release is binding on the child and such parent or guardian. I understand the financial policies, the miscellaneous notes, and my responsibility as Parent or Guardian or Student. I understand that registration isn’t complete unless this form is completely filled out and signed.
I understand that my electronic signature or checked acknowledgment box holds the same legal weight as a handwritten signature in binding me to the terms of this agreement.
