"We," "Us," or "Our" = Kay's Dance Movement
"You" = The participant, parent, or legal guardian signing this agreement
Tuition & Billing Policies
• Tuition is due on the 1st of each month.
• All families are required to maintain a valid debit or credit card on file and are automatically enrolled in AutoPay.
• The card on file may be charged for tuition, costumes, recital fees, memberships, and any other authorized studio charges.
• To avoid credit card processing fees, payments may be made by cash, check, or PayPal before the 1st of the month.
• A $35 late fee will be assessed on tuition not received by the 10th of the month.
• A $35 returned payment fee will be charged for any returned check or declined payment. Future payments may be required by cash or card only.
• The annual Family Membership Fee is $45 and is charged during your anniversary month.
• Students with outstanding balances may not participate in classes, performances, competitions, or studio events.
• Families are responsible for all reasonable collection costs, attorney fees, court costs, and other legal expenses incurred by Kay's Dance Movement in collecting unpaid balances.
Refund Policy
• All tuition, membership fees, recital fees, costume fees, competition fees, and other studio charges are non-refundable unless otherwise stated in writing by Kay's Dance Movement.
• Tuition reserves your dancer's place in class and is based on enrollment, not attendance.
• No refunds or credits will be issued for missed classes, illness, vacations, weather closures, recital non-participation, or voluntary withdrawal.
• Studio credits, when issued at the sole discretion of Kay's Dance Movement, expire one (1) year from the date issued.
Enrollment & Withdrawal
• Enrollment continues until an official withdrawal is submitted.
• If you wish to withdraw for the following month, a completed Drop Form must be submitted by the 15th of the current month.
• Verbal, text message, email, or social media messages do not constitute an official withdrawal.
• Tuition will continue until the withdrawal process has been completed.
• Kay's Dance Movement reserves the right to cancel, combine, or reschedule classes with low enrollment.
• Class schedules, instructors, tuition, and policies are subject to change when necessary.
Attendance, Absences & Weather Closures
• Planned absences should be reported through the Parent Portal.
• Tuition continues during absences.
• Missed classes due to illness may be made up in an age-appropriate class when available.
• No refunds or credits are provided for missed classes.
• Weather or emergency closures will be communicated through the Parent Portal, email, text message, website, and official KDM social media.
• No refunds will be issued for weather-related or emergency closures. Make-up classes may be offered when available.
Studio Performances
• Kay's Dance Movement offers two annual performance opportunities:
o Winter Showcase performances at community events
o Annual Spring Dance Concert held at a professional performing arts venue
• Performance information will be provided as details become available.
• Participation in performances is optional; however, recital fees, costume fees, and other performance-related charges remain non-refundable once incurred.
Communication Policy
• Families are responsible for maintaining a current email address and phone number in the Parent Portal.
• Important studio information is distributed through the Parent Portal, email, text messages, and official KDM communication channels.
• Families are responsible for reviewing studio communications and staying informed of schedules, deadlines, and studio announcements.
• By enrolling, you consent to receive studio communications via email, text message, and telephone. Standard carrier rates may apply.
Classroom Policies
• Students should arrive on time and prepared for class.
• Excessive tardiness may prevent participation for safety reasons.
• Parents and visitors are not permitted inside classrooms unless authorized by staff.
• Observation is available through designated lobby windows or monitors when applicable.
• Teachers may close blinds or observation areas if classroom distractions occur.
• No gum, food (outside designated areas), or street shoes are permitted in dance studios.
• Cell phones, smart watches, and other electronic devices must remain put away during class unless approved by an instructor.
• Students must follow the published dress code found in the Membership Guide.
Student Conduct
• Students are expected to treat instructors, classmates, staff, studio property, and equipment with respect.
• Bullying, harassment, unsafe behavior, repeated disruptions, or inappropriate conduct may result in removal from class or dismissal from the studio without refund.
Parent Conduct
• Parents, guardians, and guests are expected to treat staff, volunteers, and other studio families with courtesy and respect.
• Harassment, threatening behavior, abusive language, or repeated disruption toward staff or other families may result in dismissal from Kay's Dance Movement without refund.
• Adults are not permitted on dance equipment or inside classrooms during preschool and toddler classes unless specifically invited by an instructor.
Student Safety & Supervision
• Students in Mini classes and above must be fully potty trained and able to use the restroom independently.
• Parents of younger dancers should remain on-site during class in case restroom assistance or emergencies are needed.
• Kay's Dance Movement is not responsible for students before or after scheduled class times.
• Children may not be left unsupervised inside or outside the building.
• Siblings and guests must remain supervised and follow studio policies.
• Lost and Found items not claimed within 30 days may be donated or discarded.
Health, Medical & Safety
• A signed waiver must be completed before participation in any class or event.
• Parents are responsible for notifying the studio of any medical conditions, allergies, injuries, or activity restrictions through the Parent Portal.
• Students must report all injuries occurring both inside and outside the studio.
• Slings, casts, braces, wraps, or other medical devices require a physician's written release before participation.
• Following an injury, a physician's written release stating the student may return without restrictions is required.
• All dancers should have received a physician's examination within the previous twelve (12) months and be physically able to participate.
• Kay's Dance Movement does not administer medication except as required during emergency situations permitted by law.
Emergency Medical Authorization
• In the event of illness or injury, I authorize Kay's Dance Movement to obtain emergency medical treatment when necessary.
• I understand that I am financially responsible for all resulting medical expenses.
• I agree to keep emergency contacts and insurance information current within the Parent Portal.
Infectious Disease Policy
• Participation in dance activities involves exposure to communicable illnesses, including but not limited to COVID-19, influenza, RSV, and other infectious diseases.
• Despite reasonable cleaning and sanitation efforts, exposure cannot be eliminated.
• By participating, I voluntarily assume these risks.
• I understand instructors may provide physical assistance or spotting when necessary for instruction or safety.
Photography & Media Release
• I grant permission for Kay's Dance Movement to photograph, record, or videotape my child during classes, rehearsals, performances, competitions, and studio activities.
• Images, videos, testimonials, and quotations may be used in studio publications, advertising, social media, websites, promotional materials, and other marketing.
• Families wishing to opt out must submit a written request to info@kaysdancemovement.com before the start of the dance season.
Emergency Procedures
• Emergency drills may be conducted throughout the dance season.
• During an emergency evacuation, students will be escorted to the designated assembly area.
• Parents should not remove students until instructed by a staff member to ensure accurate attendance and accountability.
Acknowledgment of Risk & Release of Liability
• I understand that participation in dance, acrobatics, performances, competitions, camps, and related activities involves inherent risks, including serious injury, illness, permanent disability, property damage, or death.
• I voluntarily assume all risks associated with participation.
• I release, waive, and hold harmless Kay's Dance Movement, its owners, employees, instructors, volunteers, independent contractors, agents, and affiliates from any claims, liabilities, damages, or causes of action arising from participation, including those resulting from ordinary negligence to the fullest extent permitted by Oklahoma law.
• I agree to indemnify and hold harmless Kay's Dance Movement from claims arising from my family's actions or failure to comply with studio policies.
• Kay's Dance Movement shall not be liable for interruptions or cancellations caused by severe weather, natural disasters, government orders, utility failures, public health emergencies, or other events beyond its reasonable control.
• This agreement shall be governed by the laws of the State of Oklahoma. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
Credit Card Chargebacks
• Families agree to contact Kay's Dance Movement first regarding any billing concern before initiating a chargeback or payment dispute.
• Chargebacks filed on valid charges may result in immediate suspension of enrollment until resolved.
• Families remain responsible for all tuition, fees, chargeback costs, collection expenses, attorney fees, and court costs incurred by Kay's Dance Movement.
Electronic Signature & Certification
By electronically signing this agreement, I certify that:
• I have read, understand, and agree to all policies contained in this agreement.
• I am the participant or the parent/legal guardian authorized to sign on behalf of the participant.
• All medical and emergency information provided is accurate and will be updated as necessary.
• This agreement remains in effect for the duration of my family's enrollment at Kay's Dance Movement, including future dance seasons, until replaced by a newer agreement.
• My electronic agreement has the same legal force and effect as my handwritten signature.
