West Michigan Elite Pom and Dance, LLC Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement
In consideration of dancing or participating in other activities at West Michigan Elite Pom and Dance, LLC, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or interactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releasees†named below; and that there may be others risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity.
I hereby release, discharge, and covenant not to, West Michigan Elite Pom and Dance, LLC, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of the premises on which the Activity takes place, (each considered one of the “RELEASEES†herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the “releasees†or otherwise, including negligent rescue operations and future agree that if despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damages, or cost, which any may incur as the result of such claim. By signing, I also agree to release and give permission to West Michigan Elite Pom and Dance, LLC for the participant's photo or any video productions to be used on the website, flyers, or any promotional purposes for West Michigan Elite Pom and Dance, LLC.
I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
PARENTAL CONSENT (if under 18) AND I, the minor’s parent and/or legal guardian, understand the nature of the above-referenced activities and the Minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees from all liability, claims, demands, losses or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and further agree that if despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss liability, damages, or cost any Releasee may incur as the result of any such claim.
COVID-19 I realize while enhanced safety precautions are being taken at West Michigan Elite Pom & Dance, an inherent risk of exposure to COVID-19 exists in any public place where people are present. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable. By visiting West Michigan Elite Pom & Dance and allowing my child(ren) to participate in studio activities, I voluntarily assume all risks associated with exposure to COVID-19. I understand that West Michigan Elite Pom & Dance is not responsible for pre-screening or monitoring individuals and that we encourage all adults to self-screen themselves and their child(ren) at home prior to going out in public.
PHOTO VIDEO RELEASE I release and give permission to West Michigan Elite Pom and Dance, LLC for my child's photo or any video productions to be used on the website, flyers, Facebook, Instagram, or any marketing material for promotional purposes.
POLICIES
PAYMENTS Payments are all due on the 1st of the month. If not paid manually, auto-pay will run on the 5th of the month. There is a grace period until the 10th of the month, after which a $10 late fee will be charged. If payment is not made by the end of the month, the student will not be eligible to take class.
SPLIT FAMILY POLICY In a situation where the family is split and a dancer needs to have multiple adults listed, there will be 1 mutual adult listed as the account holder who will receive statements. All other adults will receive updates via email and text, but not receive billing information.
REFUNDS AND CHARGES - West Michigan Elite Pom and Dance, LLC does not offer refunds or discounted rates for missed classes for holidays, snow days, or other missed classes. It is West Michigan Elite Pom and Dance, LLC policy to keep a credit card on file. This is for any outstanding charges. Please note, before the payment is charged, you will be notified. Late fees will be added. Your final amount will be notified to you before charging the card and a receipt will be emailed to you. All credit card/debit card payments will be given an emailed receipt.
UNFORESEEN CIRCUMSTANCES POLICIES
West Michigan Elite will follow the guidelines set forth by the CDC and the requirements of the state and federal government for any unforeseen disasters, pandemics, or other. If at any time we are forced to cancel classes, we will hold classes on Zoom again. There will be no refunds.
ATTENDANCE - West Michigan Elite Pom and Dance, LLC dancers must attend every class to get the full benefit out of their lessons. If they miss a lesson, it is not the instructor's responsibility to hold the entire class behind for one child. If your child needs a private makeup lesson, for missed time or if they started the class late, please discuss times with their instructor. Extra fees do apply. If you are going to miss class, please log the absence in your portal, or text the studio at 616-466-4408.
SNOW DAYS OR CANCELED CLASSES - West Michigan Elite Pom and Dance, LLC will email out canceled class notifications due to weather the day of, by 3:00 PM. Or for morning classes by 9:00 AM. Please visit our website, or Facebook group if you have any questions about when the class will be going on. Updates are always posted on Facebook.
SEASON COMMITMENT - West Michigan Elite Pom and Dance, LLC is a full-season commitment studio. Classes run from September -May. I understand that I am committing to a class, and the end of the year recital in May. Students who register late may have missed routine instruction, it is their responsibility to try to learn it in class or schedule a private lesson to catch up. Students who do not catch on to the dance, may not get to perform in that routine. Students who do catch on will be placed in that routine according to their knowledge and ability to perform.
CANCELLATION POLICY - If you and your child have decided to not continue with dance classes, you must notify us 30 days before the final cancellation. There is a cancellation fee if you do not notify us before 30 days, which is the full amount of your tuition payment. There are no refunds.
INJURY - If your child is injured and cannot dance for the rest of the season, there will be no charge to cancel classes. If your child is temporarily injured or sick, please bring them to class to simply watch and take notes. DO NOT BRING YOUR CHILD TO CLASS IF THEY ARE CONTAGIOUS!
ADULT OR PARENT RESPONSIBILITY - It is the responsibility of the adult or parent to be aware of all studio activities, such as recitals, performances, practices, cancellations, holiday breaks, picture day, rehearsals, etc. The studio will email all notices out, along with posting on the studio Facebook page/group. The Dropbox Folder will be updated as well. Please make any corrections through email of address, email, or phone changes.
CARE OF STUDENTS - West Michigan Elite Pom and Dance, LLC is not responsible for providing before or after class care to students. Students are not to be left at the studio for excessive time before or after class. Siblings and friends are not to be left unattended at the studio. It is not the responsibility of our instructors to look after their safety. Young students must be potty trained to attend class. If they are not, the parent must be present during class.
DRESS CODE - All Ballet, Tap, and Theater Classes must wear proper shoes, tights, and a leotard. Optional spandex shorts and a fitted top for colder months are okay. All Pom, Jazz, and Hip Hop classes must wear tight-fitted clothing such as leggings, spandex shorts, and a tight-fitted top. ALL STUDENTS MUST HAVE HAIR PULLED BACK AND OUT OF THE FACE SUCH AS A PONYTAIL OR BUN. No jewelry or gum.
CLASS BEHAVIOR AND ETIQUETTE - We want all of our students to be the best they can be and have an enjoyable and educational experience. We will treat your child with respect and we expect our students to show the same attitude toward their teachers and peers. We ask that they follow these simple rules… *Pay attention during class, don't talk out of turn, raise your hand if you have questions about dance, and ask for bathroom breaks and water breaks when needed. Socialize with friends before or after class, not during, as this is your time to learn. Drink breaks are quick and students should come quickly back to class. * Food and drinks are allowed in the dancer's den only, they must pick up after themselves, if there is a constant mess of food and wrappers in the dancer's den, we will not continue to allow food in the studio.
CONDUCT POLICY: WME strongly promotes a fun, safe, positive atmosphere where kids gain confidence. At WME we expect our students to come to class ready to learn, show respect to their peers, teachers, and parents and follow our classroom rules. We do not condone nor tolerate bullying or mean behavior and will correct any student who behaves as such. Furthermore, we hold the same expectations with all of our students and families. WME will not tolerate negative, rude, drama, or explicit behavior. If a student or family cannot align with our values, they are not a good fit for our studio and will be dismissed. We work off of a 3-strike policy, 2 warnings will be given and the third will be grounds for dismissal. Please conduct yourselves in a friendly, positive light when you are in our building.
IF THERE ARE ANY CONCERNS WITH YOUR INSTRUCTOR, PLEASE EMAIL THE STUDIO TO DISCUSS THE CONCERNS.
VIEWING - We ask that parents drop off their children and pick them up at the end of their class to help keep the lobby clear for those parents that need to stay. Parents are not permitted to sit in their child's classroom unless specifically asked by the teacher. This is to protect the class environment from distractions. If we need to contact you, we will send you a text.
REHEARSALS - Any and all recital rehearsals are mandatory. If your child misses any rehearsals for the recital they will not get to practice on stage and learn where to go. Rehearsals are for everyone's benefit.
BY SIGNING BELOW, I HAVE READ AND AGREED TO ALL THE TERMS AND POLICIES OF THIS CONTRACT. I WILL HELP MY DANCER UNDERSTAND ALL POLICIES, AND ENSURE MY DANCER FOLLOWS THROUGH WITH THEM.
