TERMS, POLICIES AND WAIVERS
TUITION, REGISTRATION AND REFUND POLICY
Please read carefully. By registering with the School, you acknowledge and agree to the following terms, policies and waivers (the “Terms”).
When we refer to the “School” we mean any or all of Piper Rose Studios Inc. (DBA as Blakey Saskatoon School of Irish Dance), River City Irish Dance Corp., their directors, employees, instructors, agents, representatives volunteers, subcontractors, successors and/or assigns and Luanne C. Schlosser, Katie Bleakney, Nicole Nienaber. When we refer to the “Program”, we mean any dance lessons and ancillary services thereto, as provided by the School.
Non-Refundable Fees:
All registration fees, tuition fees, costume fees (if applicable), and session fees (for short-duration programs) are non-refundable once processed, regardless of attendance.
Withdrawal Prior to November 1, 2025:
If you wish to withdraw your dancer, written notice (email is acceptable) must be submitted by the 15th of the current month to avoid being charged for the following month. Withdrawals are permitted up to and including October 31, 2025, provided that proper notice is given.
No Withdrawals or Refunds After November 1, 2025:
Due to the long-term planning and financial commitments required for staffing, scheduling, choreography, and studio space, all registrations are considered final and non-cancellable as of November 1, 2025. After this date:
• No withdrawals will be accepted for the remainder of the season (through June 2026);
• No refunds will be issued; and
• The full balance of seasonal tuition remains due and payable, regardless of attendance or monthly payment status.
This policy reflects the nature of annual enrollment and the fact that tuition is calculated based on a 10-month commitment, with monthly payments offered only as a convenience to families. It is not a monthly contract or pay-per-class agreement. Should an alternative schedule and fee structure be required, you must first receive written confirmation of same from the School.
Missed Classes, Illness, and Injuries:
Missed classes for any reason, including illness or injury, are not refundable. In exceptional cases, you may submit a written request for consideration, but any refund or credit will be at the sole discretion of the School.
Instructional Time and Program Modification Policy:
The School reserves the right to modify, adjust, or amend the format, schedule, delivery method, or content of classes at its sole discretion. This includes, but is not limited to, substituting regular class time with events, workshops, performances, or other instructional experiences that align with the educational goals of the Program. Such modifications may be made to respond to unforeseen circumstances or to serve the overall benefit and development of the dancers enrolled. Any such substitution or adjustment will provide instructional value and duration equivalent to that of the originally scheduled class time. By enrolling in the Program, participants acknowledge and accept that these modifications may occur as part of the regular operation of the Program.
Class Size Adjustments:
The School reserves the right to amalgamate or adjust classes with fewer than three registered dancers.
CONFIDENTIALITY / INTELLECTUAL PROPERTY
Irish dance is a competitive discipline, and each school develops its own distinctive choreography, training methods, class structure, and fee model. All such materials, including, without limitation, routines, exercises, teaching manuals, instructor information, fee schedules, internal communications, and business documentation (collectively, the “Intellectual Property”) are the exclusive property of the School, including but not limited to Barbara Blakey and Blakey Arts Inc. This Intellectual Property is confidential and intended solely for the use of current members of the School. It may not be copied, reproduced, distributed, or shared outside the School community without our express written consent.
MEDIA RELEASE AND USAGE POLICY
Photography and Recording
By participating in the Program, dancers and their families acknowledge that the School, or authorized representatives may photograph or record classes, events, or performances for instructional, archival, or promotional purposes.
Use of Dancer Likeness
You grant the School an irrevocable, worldwide, perpetual, royalty-free license to use your (or your dancer’s) image and likeness for the above-noted purposes, in any media or format now known or later developed.
Submission of Media by Families
Any photos or videos voluntarily submitted by families that feature dancers may also be used by the School under an irrevocable, worldwide, perpetual, royalty-free license.
WAIVER, RELEASE AND INDEMNITY AGREEMENT
NOTICE: BY AGREEING TO THIS INDEMNITY AGREEMENT (the “AGREEMENT”), YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR TO CLAIM COMPENSATION FOLLOWING INJURY, ILLNESS OR DEATH. PLEASE READ CAREFULLY! WHEN WE REFER TO “I”, WE REFER TO YOU, THE PERSON REGISTERING THE PARTICIPANT (WHO, IF OVER THE AGE OF MAJORITY, IS ALSO YOU).
1. CONFIRMATION OF HEALTH
I confirm that the dancer who I am registering (the "Participant") is in good physical health. I further confirm that the Participant has no underlying medical condition which may increase the risk for more serious complications from physical activity and/or other illnesses occurring in the population including, without limitation, heart disease, lung disease, diabetes, asthma, muscle strains and sprains, or that if such illnesses and/or conditions exist, that I understand that this may increase the Participant's risk for illness, injury, loss, and/or death while participating in the Program and activities related or ancillary thereto (the "Activities").
2. ACKNOWLEDGEMENT OF PANDEMIC RISKS AND VOLUNTARY ASSUMPTION OF RISK
I understand and acknowledge that the Participant's attendance in the Activities may involve risks to the Participant that may result in injury, illness, loss, and/or death. I recall that COVID-19 was once a pandemic, where no cure existed at the time, and where similar or diverse illnesses and/or pandemics may exist in the future for which there is no cure and for which social interactions may subject to rules and regulations reducing the normal operation of many businesses and programing. In such cases, I am aware that any increased social contact during such events may pose an increased risk of transmission and illness. I am aware that, despite adherence to local laws and regulations, other persons may attend the location in which the Activities take place and that those persons may have been exposed to such an illness. I am aware of the risks, dangers and hazards associated with participating in the Activities and I (or on behalf of the Participant) freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, illness, loss or death resulting therefrom.
3. ACKNOWLEDGEMENT OF ACTIVITIES, RISK AND VOLUNTARY ASSUMPTION OF RISK
As with any physical activity, I understand and acknowledge that the Activities may involve risks to the Participant. Such risks include, without limitation, the possibility of accident or illness while traveling to and from events as well as any injury, loss, death, or property damage arising out of participation in the Activities. I am aware of the risks, dangers and hazards associated with participating in the Activities and I (or on behalf of the Participant) freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, illness, loss or death resulting therefrom.
4. WAIVER OF CLAIMS AND RELEASE OF LIABILITY
I agree to waive any and all claims that I now or in the future may have against Piper Rose Studios Inc. DBA Blakey School of Irish Dance, River City Irish Dance Corp., its directors, employees, instructors, agents, representatives, volunteers, subcontractors, successors and/or assigns (the "Released Parties"). I further agree to release the Released Parties from all liability for any injury, illness, loss or death that arises during, or results from, my participation in the Activities due to any cause whatsoever. I release and forever discharge the Released Parties from all such claims.
5. INDEMNIFICATION
I agree to hold harmless and indemnify the Released Parties from any and all claims and liability for any injury, illness, loss or death, including injury, illness, loss or death of any third party resulting from the Participant's participation in the Activities. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
I CONFIRM THAT I HAVE READ AND THAT I UNDERSTAND THIS AGREEMENT. I AM AWARE THAT, BY CONFIRMING THAT I ACCEPT THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASED PARTIES. I CONFIRM THAT I AM VOLUNTARILY AGREEING TO ABIDE AND ACCEPT THIS AGREEMENT.
COMMUNICATION AND PRIVACY POLICY; CASL WAIVER
Primary Communication Method
By accepting these Terms, you acknowledge and agree that the primary method of communication used by the School is email, and for more time-sensitive matters, the WhatsApp messaging application. You consent to receiving email communications at the addresses provided during the registration process. Similarly, you agree to participate in the School’s messaging applications, and consent to receiving phone messages when subscribing to the WhatsApp messaging application. You understand that it is your responsibility to stay apprised of relevant Program information through these channels and such other channels of communication as may be communicated from time to time.
Sharing of Personal Information
You consent to the limited sharing of your personal information, including your name, your dancer’s name, date of birth, phone number, and email address, with the School and fellow members of the School community. Under Canadian privacy law, the above details are considered “personal information.” Please note that this information may be processed or stored on servers located outside of Canada. This information will be used solely for purposes related to the Program, Irish dance activities, including (without limitation) classes, events, fundraising initiatives, and competition registration.
Third-Party Payment Processors
All payment transactions through the parent portal are handled by secure, third-party providers. These providers maintain their own privacy policies, which govern how your personal information is collected, used, and protected. We encourage you to review these policies directly if you have any concerns.
Limits on Information Sharing
Outside of the purposes outlined above, your personal information will not be shared with any third parties without your express written consent.
Withdrawal of Consent
Your consent remains valid until you choose to withdraw it. You may withdraw your consent at any time by emailing dance@yxeirish.com
ATTENDANCE POLICY
By accepting these Terms, you understand that your dancer's success is dependent upon regular attendance at class. You also understand that irregular attendance causes class disruption and hinders the success of the other students in the Program. Accordingly, by accepting these Terms, you agree and understand that if your dancer misses more than 3 classes in a 1-month period, your dancer will be obligated to book a private lesson. You further understand that you will be billed for that private lesson at a rate of $100.00 per lesson.
COSTUME RENTAL (BLAKEY)
Please be advised that a costume rental fee is applied for costume rental. By accepting these Terms, you agree to execute any further waivers required for the costume rental. You further agree and understand that in the event of misplacement or damage to any costuming, that you may be charged the full replacement value of the costume, including administration fees for procurement, shipping, duty, and all other costs related to reinstating the costume to its original form. You agree to indemnify and save harmless the School and/or rightful owner(s) for any damage or destruction to costuming and all fees incurred in repairing or purchasing a replacement costume for damage caused to the costume while in your possession.
APPLICABILITY AND AMENDMENTS OF THE HANDBOOK
The School’s handbook (the “Handbook”), as issued and updated by the School, is an integral part of these Terms and applies at all times to all dancers enrolled in the Program and their families. The Handbook sets out additional expectations, standards, procedures, and policies that govern participation in all facets of the Program. It is your responsibility to regularly review the current version of the Handbook, available at: https://www.rivercityirishdance.com/member-page. We kindly remind you that this Handbook will be updated over the summer to reflect the recent merger between the Blakey and River City Schools.
The contents of the Handbook may be amended, updated, or revised at any time, at the sole discretion of School leadership and without prior notice. By enrolling in or continuing participation in the School, you acknowledge and agree to be bound by the current version of the Handbook. If a proposed change to the Handbook would materially alter the substance of these Terms, the School will seek your express consent before the change takes effect.
