Waiver, Release, and Agreement - Renuncia, Liberación, y Acuerdo
I understand that my class level placement and/or my child's class level placement is based on teaching standards and methods that promote correct classical ballet technique, skill attainment, and the development of artistry. set forth by Emily Finer, Owner of Keystone Ballet Academy (KBA).
I understand that I may be held back and/or my child may be held back from advancing to a higher level based on teaching standards and methods for correct classical ballet technique training, skill attainment, artistry development, and attendance requirements set forth by Emily Finer, Owner of KBA sole discretion, without prejudice and favoritism, on an individual case-by-case basis.
I understand that students aged 3 and older are evaluated during their free trial and subsequent classes for appropriate behavior and physical ability to maintain a safe and productive learning environment.
I hereby acknowledge that the Keystone Ballet Academy - aka: KBA (hereinafter referred to as "KBA" and/or "KBA's") Waivers and Policies, and Agreements are available in KBA's office and my student/parent portal account, wherein there is set forth the Waivers and Policies, and Agreements of KBA.
I agree that enrolling myself as an adult student and/or my child as a student of KBA, I am bound by the terms outlined in the KBA Waivers and Policies, and Agreements of KBA, including but not limited to the obligation for payment of all fees, charges to account, and tuition required of me as a parent of a child student and/or myself as an adult student.
I understand that the primary account holder assumes full responsibility for keeping student information up to date and for all charges on their adult student account and/or their child's student account. KBA is unable to divide costs, provide duplicate statements, or otherwise mediate between parents or other parties who may voluntarily or by court order share parental rights, legal guardianship, or other responsibilities for the student's well-being.
I agree to allow myself and/or my child to take part in any dance classes, and/or classes related to dance, all instruction, all programs, events, and/or guest teachers offered by or at KBA. (Hereinafter referred to as dance classes.)
I understand and agree that the nature of the activities I and/or my child will be taking part in involves certain health and physical risks, and that I am and/or my child is in healthy physical condition and capable of participating in the related activities, understanding that KBA is not in any way responsible for making such a determination.
I acknowledge and agree that it is my responsibility to maintain my own accident and health insurance coverage that provides adequate coverage for myself and/or my child participating in KBA dance classes, and that KBA does not provide accident or health insurance for those participating in its dance classes.
I assume all physical risks to myself and/or my child in connection with any dance classes, and further release KBA and its owners and employees from liability for negligence to the fullest extent permitted by law for any injury sustained by me and/or my child. At the same time, I am enrolled in dance classes, including all risks reasonably connected with such activity, whether foreseen or unforeseen, which may result in permanent disability or death.
I understand that the instructors and employees of KBA are not physicians or medical practitioners. With the above in mind, I hereby release and grant permission to the KBA staff and ownership to render temporary minor first aid to myself and/or my child or myself in the event of any unexpected injury or illness, and seek professional medical help, including transportation to a healthcare facility or hospital, by calling 911 for an ambulance to transport yourself and/or your child on your behalf, releasing all KBA staff and ownership of any medical expenses incurred.
I understand that any dance training program will involve the instructor touching and adjusting the student's body to help the student feel the proper placement of the head, neck, torso, arms, hands, legs, and feet. In turn, allows the student to execute steps and movements safely.
I agree as an adult student and/or parent to inform my child to follow all safety rules, KBA Policies and Waivers, Agreements, teacher instructions, and directions given by teachers and/or staff. I agree it is my responsibility to discuss the risks involved in taking dance classes at KBA so that my child is aware of and understands them. KBA will inform the parent and child through its safety procedures and teaching protocols.
I understand that KBA staff is not responsible for any child, including my child or other children under my supervision, who are left unsupervised in the communal areas and the areas surrounding the dance studio, and that KBA will only be supervising my child when he or she is participating in scheduled dance classes.
I understand that KBA is not responsible for individual property that is lost, damaged, or stolen while my child or I are at or on the KBA leased area or any other area of the CANBE BUSINESS INNOVATION BUILDING where our studio is located.
I authorize and agree to the use of photographs, videos, or likenesses of myself and/or my child by KBA as needed for its record-keeping, advertising, and/or public relations projects, and that I have no rights to the same and will not be compensated for the same.
My acknowledgment is proof of my intention to execute a complete and unconditional waiver, release, and agreement to all liability, per the terms herein and all terms and conditions set forth above.
I understand Keystone Ballet Academy legally has the right to amend as necessary its Waivers, Release, and Agreement.
(All active accounts will receive a notification of any changes via email).
I HAVE FULLY INFORMED AND UNDERSTOOD THE CONTENTS OF THIS WAIVER, RELEASE, AND AGREEMENT, AND HAVE FULLY READ ALL OF THE ABOVE.

Entiendo que mi nivel o el de mi hijo/a se basa en los estándares y métodos de enseñanza que promueven la técnica correcta del ballet clásico, el desarrollo de habilidades y la expresión artística, establecidos por Emily Finer, propietaria de la Academia de Ballet Keystone (KBA).
Asimismo, entiendo que mi hijo/a o yo podríamos no avanzar a un nivel superior según los estándares y métodos de enseñanza para la correcta formación en la técnica de ballet clásico, el desarrollo de habilidades y la expresión artística, así como los requisitos de asistencia establecidos por Emily Finer, propietaria de KBA, a su entera discreción, sin prejuicios ni favoritismos y en cada caso particular.
Entiendo que los alumnos de 3 años o más son evaluados durante su clase de prueba gratuita y en las clases posteriores para garantizar un comportamiento adecuado y una buena condición física, con el fin de mantener un entorno de aprendizaje seguro y productivo.
Por la presente, reconozco que las Exenciones de Responsabilidad, Políticas y Acuerdos de la Academia de Ballet Keystone (KBA, en adelante "KBA") están disponibles en la oficina de KBA y en mi portal de estudiante/padre, donde se detallan dichas Exenciones de Responsabilidad, Políticas y Acuerdos.
Acepto que al inscribir a mi hijo/a o a mí mismo/a como estudiante adulto/a de KBA, me comprometo a cumplir con los términos y condiciones establecidos en las Exenciones de Responsabilidad, Políticas y Acuerdos de KBA, incluyendo, entre otros, la obligación de pagar todas las cuotas, cargos a la cuenta y la matrícula que me correspondan como padre/madre de un estudiante menor de edad o como estudiante adulto/a.
Entiendo que el titular principal de la cuenta asume la responsabilidad total de mantener actualizada la información del estudiante y de todos los cargos en la cuenta de su hijo/a o de su cuenta de estudiante adulto/a. KBA no puede dividir los costos, proporcionar estados de cuenta duplicados ni mediar entre padres u otras partes que, de forma voluntaria o por orden judicial, compartan la patria potestad, la tutela legal u otros derechos. Responsabilidades para el bienestar del estudiante.
Acepto que yo y/o mi hijo/a participemos en cualquier clase de danza o en clases relacionadas con la danza, así como en toda la instrucción, programas, eventos y/o profesores invitados ofrecidos por KBA (en adelante, clases de danza).
Entiendo y acepto que la naturaleza de las actividades en las que participaré yo y/o mi hijo/a implica ciertos riesgos para la salud y el bienestar físico, y que tanto yo como mi hijo/a gozamos de buena salud y somos capaces de participar en dichas actividades, entendiendo que KBA no es responsable de determinarlo.
Reconozco y acepto que es mi responsabilidad mantener mi propio seguro de accidentes y salud que brinde la cobertura adecuada para mi participación y/o la de mi hijo/a en las clases de danza de KBA, y que KBA no proporciona seguro de accidentes ni de salud para quienes participan en sus clases de danza.
Asumo todos los riesgos físicos para mí y/o mi hijo/a relacionados con las clases de baile y eximo a KBA, a sus propietarios y empleados de toda responsabilidad por negligencia, en la máxima medida permitida por la ley, por cualquier lesión que yo y/o mi hijo/a suframos. Al mismo tiempo, me inscribo en clases de baile, asumiendo todos los riesgos razonablemente relacionados con dicha actividad, ya sean previstos o imprevistos, que puedan resultar en discapacidad permanente o en fallecimiento.
Entiendo que los instructores y empleados de KBA no son médicos ni profesionales de la salud. Por lo tanto, autorizo al personal y a los propietarios de KBA a brindarme primeros auxilios menores temporales a mí y/o a mi hijo/a en caso de cualquier lesión o enfermedad inesperada, y a buscar asistencia médica profesional, incluyendo el traslado a un centro de salud u hospital, llamando al 911 para solicitar una ambulancia que me traslade a mí y/o a mi hijo/a, eximiendo al personal y a los propietarios de KBA de cualquier gasto médico incurrido.
Entiendo que cualquier programa de entrenamiento de danza implica que el instructor toque y ajuste el cuerpo del estudiante para ayudarle a sentir la posición correcta de la cabeza, el cuello, el torso, los brazos, las manos, las piernas y los pies. Esto, a su vez, permite al estudiante ejecutar los pasos y movimientos de manera segura.
Como estudiante adulto y/o padre/madre, me comprometo a informar a mi hijo/a sobre la importancia de seguir todas las normas de seguridad, las políticas y las exenciones de responsabilidad de KBA, los acuerdos, las instrucciones del profesor y las indicaciones del personal docente y/o administrativo. Acepto que es mi responsabilidad hablar con mi hijo/a sobre los riesgos que implican tomar clases de danza en KBA para que esté al tanto y los comprenda. KBA informará al padre/madre y al niño/a a través de sus procedimientos de seguridad y protocolos de enseñanza.
Entiendo que KBA no se responsabiliza de mi hijo/a ni de otros niños bajo mi supervisión que se encuentren sin supervisión en las áreas comunes y en los alrededores del estudio de danza, y que KBA solo supervisará a mi hijo/a cuando participe en las clases de danza programadas.
Entiendo que KBA no se hace responsable de la pérdida, daño o robo de pertenencias personales mientras mi hijo/a o yo nos encontremos en el área arrendada por KBA o en cualquier otra área del Edificio de Innovación Empresarial CANBE, donde se ubica nuestro estudio.
Autorizo y acepto el uso de fotografías, videos o imágenes mías o de mi hijo/a por parte de KBA, según sea necesario, para sus registros, publicidad y/o proyectos de relaciones públicas, y que no tengo ningún derecho sobre dicho material ni recibiré compensación alguna por él.
Mi firma constituye prueba de mi intención de otorgar una renuncia, liberación y acuerdo completos e incondicionales de toda responsabilidad, de conformidad con los términos aquí estipulados y con todos los términos y condiciones establecidos anteriormente.
Entiendo que Keystone Ballet Academy tiene el derecho legal de modificar, según sea necesario, sus Exenciones de Responsabilidad, Liberación de Responsabilidad y Acuerdo. (Todas las cuentas activas recibirán una notificación por correo electrónico sobre cualquier cambio).
He sido informado/a y he comprendido plenamente el contenido de esta renuncia, liberación y acuerdo y he leído detenidamente todo lo anterior.
