Assumption of Risk
I, the undersigned, acknowledge and accept that participation in dance classes and related activities at Extensions School of Dance (“the Studio”) involves strenuous physical activity and carries inherent risks of injury, illness, or accident, with or without the negligence of others. By signing this agreement, I (and, if applicable, on behalf of my minor child) voluntarily assume all such risks as a condition of participation.
Waiver and Release
In consideration of the opportunity to participate in Studio activities, I (and, if applicable, my minor child’s parent/guardian on their behalf and on my own behalf) hereby release and forever discharge Extensions School of Dance, its owners, instructors, employees, volunteers, agents, representatives, successors, assigns, and the hosting site (collectively, “Releasees”) from any and all claims, demands, actions, costs, expenses, damages, and liabilities of any kind, known or unknown, arising out of or related to participation in Studio activities.
This release applies to injuries, illnesses, property damage, or losses resulting from participation, including but not limited to those caused in whole or in part by the negligence of any Releasee.
I further authorize Extensions School of Dance to obtain necessary emergency medical treatment for the Participant and agree to hold harmless all Releasees in the event such care is required.
This release is binding upon me, my heirs, representatives, executors, administrators, and assigns.
Indemnification
If any claim is brought against any Releasee despite this waiver, I agree to indemnify, defend, and hold harmless each Releasee from any resulting losses, damages, attorney’s fees, or costs incurred.
Participant Health
I affirm that the Participant is in good health and has no condition, physical or mental, that would prevent safe participation in Studio activities. Any allergies or current medications have been listed on Participant's registration, and I agree the Participant will bring and self-administer any required medications.
Refunds and Payments
I acknowledge that all fees paid to Extensions School of Dance are non-refundable, except in the event of program cancellation by the Studio.
Returned checks will incur a $25 fee.
Credit card chargebacks/reversals will incur an additional 2.5% fee of the original transaction.
Accounts sent to collections will be subject to penalties up to 25% of the invoice amount or the maximum permitted by law.
Future payments, once an account is in default, will only be accepted via cashier’s check or money order.
Media Release
I understand that Extensions School of Dance may photograph, film, or otherwise record classes, rehearsals, or events. By signing below, I grant the Studio and its authorized parties the unrestricted right to use my (or my minor child’s) image, likeness, voice, or performance for promotional, advertising, archival, or educational purposes, in any media now known or later developed, without compensation.
Acknowledgement
I represent that I have carefully read this Waiver and Release in its entirety, fully understand its terms, and sign it voluntarily. I acknowledge that I am waiving substantial legal rights, including the right to sue, and that this document is a binding contract between myself, the Participant, and Extensions School of Dance.
I also acknowledge that Extensions School of Dance does not guarantee that any specific event, class, or program will take place.
