HD DANCE ACADEMY
ONLINE WAIVER, RELEASE OF LIABILITY & ENROLLMENT AGREEMENT
By registering a student with HD Dance Academy, enrolling in any Studio class or program, making a payment, or allowing a student to participate in any Studio activity, the parent/guardian and/or adult student acknowledges, understands, and agrees to all terms and conditions contained in this agreement.
This agreement applies to all HD Dance Academy classes, rehearsals, performances, competitions, workshops, intensives, recitals, events, and other Studio activities.
1. ASSUMPTION OF RISK
I understand that dance and physical activities involve inherent risks. These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, collisions, fractures, dislocations, overuse injuries, joint injuries, head or neck injuries, and injuries to the feet, ankles, knees, hips, back, shoulders, arms, wrists, or other parts of the body.
Dance activities may include stretching, jumping, turning, floor work, partnering, lifting, tumbling, acrobatics, conditioning, and other physical movements that may result in injury.
I understand that injuries may occur even when proper instruction, supervision, equipment, and safety procedures are provided.
I voluntarily choose to participate in Studio activities and knowingly accept and assume the risks associated with participation.
2. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, I release and agree not to hold liable HD Dance Academy, its owners, directors, instructors, employees, independent contractors, volunteers, representatives, agents, affiliates, and facility owners or operators for claims, injuries, losses, damages, or expenses arising from participation in Studio activities, except for matters that cannot legally be waived or released.
This release applies to activities conducted at the Studio and at other locations used for Studio-related classes, rehearsals, performances, competitions, workshops, conventions, or events.
3. MEDICAL CONDITION AND FITNESS TO PARTICIPATE
I confirm that the student is physically able to participate in the classes and activities for which they are enrolled.
I agree to notify the Studio of any medical condition, injury, physical limitation, allergy, medication requirement, or other circumstance that may affect the student's ability to participate safely.
I understand that Studio instructors and staff are not medical professionals and are not responsible for diagnosing, treating, or preventing medical conditions or injuries.
The Studio may ask a student to stop participating if the Studio reasonably believes continued participation may be unsafe.
4. INJURY OR MEDICAL EMERGENCY
If a student becomes injured, ill, or unable to safely participate, the Studio may remove the student from participation and contact the parent/guardian or emergency contact information provided through the Studio's registration system.
In an emergency, I authorize Studio staff or representatives to seek reasonable emergency medical assistance for the student when I cannot be reached promptly.
I understand that I am responsible for medical, ambulance, hospital, physician, medication, and other expenses resulting from an injury or medical emergency.
5. SEASON ENROLLMENT
I understand that HD Dance Academy operates according to designated seasons, sessions, and program schedules.
Registering for a class constitutes enrollment for the applicable season/session unless otherwise stated by the Studio.
Class tuition is based on the Studio's published tuition schedule and the student's enrolled classes.
A student is responsible for tuition associated with the classes for which they are enrolled, regardless of the number of classes actually attended.
6. TUITION AND PAYMENT
Tuition must be paid according to the payment schedule selected or assigned by HD Dance Academy.
The Studio may offer full-season, installment, or monthly payment options.
A monthly payment option is a payment arrangement toward the applicable tuition obligation and does not necessarily mean that the student is enrolled on a month-to-month basis.
Parents/guardians are responsible for keeping payment information current and ensuring that all tuition and applicable fees are paid when due.
7. NON-REFUNDABLE TUITION
Tuition is non-refundable once the applicable season or session has begun, except where otherwise required by law or specifically approved by the Studio in writing.
Refunds will generally not be provided because of:
Missed classes
Vacations
School activities
Transportation issues
Schedule conflicts
Change of personal plans
Student choosing to discontinue attendance
Moving
Temporary illness
Minor injuries
Lack of interest
Failure to attend
Other personal circumstances
The Studio may consider exceptional circumstances on a case-by-case basis, but any exception is at the Studio's discretion.
8. WITHDRAWAL FROM CLASSES
Stopping attendance does not automatically cancel enrollment or tuition obligations.
Parents/guardians must follow the Studio's established withdrawal or cancellation procedure.
Unless otherwise approved in writing by the Studio, withdrawal does not create a right to a refund of tuition already paid.
Any outstanding balance that became due before withdrawal remains the responsibility of the account holder.
9. LATE PAYMENTS
Tuition and all other applicable fees must be paid by the due date established by HD Dance Academy.
A $15 late payment fee will be applied to an account when a required tuition payment is not received by the stated due date.
The $15 late fee applies per late payment and is the responsibility of the account holder.
If an account has an outstanding balance, the Studio may restrict the student's participation in classes, performances, competitions, or other Studio activities until the account is brought current.
Failure to attend classes does not waive, reduce, or postpone tuition or late-payment obligations.
Parents/guardians are responsible for ensuring that payments are made on time and that payment information remains current.
10. MISSED CLASSES AND MAKE-UP CLASSES
HD Dance Academy offers make-up classes for eligible missed classes, subject to class availability and Studio policies.
Make-up classes:
Must be scheduled with the Studio in advance.
Are subject to availability.
Must be taken in an appropriate or comparable class approved by the Studio.
Must be completed within the same season in which the missed class occurred.
Must be completed before the end of the applicable season.
Cannot be carried over to a future season.
Cannot be exchanged for cash, tuition refunds, or account credits.
Cannot be transferred to another student.
Parents/guardians are responsible for contacting the Studio and arranging make-up classes when needed.
The Studio does not guarantee availability of a specific class, instructor, or time for a make-up class.
Any unused make-up classes remaining at the end of the season will automatically expire and will not be refunded, credited, or transferred to another season.
11. STUDIO-CANCELLED CLASSES
If the Studio cancels a class because of weather, facility issues, instructor emergencies, or other circumstances, the Studio may provide a make-up class, alternative class, credit, or other solution at its discretion.
A Studio cancellation does not automatically create a right to a tuition refund.
12. HOLIDAYS AND NO-CLASS DATES
HD Dance Academy establishes its own seasonal calendar, including holidays, breaks, scheduled closures, and other no-class dates.
Tuition is based on the Studio's published seasonal schedule and is not automatically reduced because of regularly scheduled holidays or no-class dates.
13. CLASS SCHEDULE AND INSTRUCTOR CHANGES
The Studio reserves the right to make reasonable changes to class schedules, instructors, class levels, classrooms, locations, programs, and other aspects of Studio operations.
The Studio will make reasonable efforts to notify families of significant changes.
14. ATTENDANCE AND PUNCTUALITY
Regular attendance and punctuality are important for student progress.
Students should arrive on time and be ready to participate at the scheduled start time.
Students who arrive late may be required to complete an appropriate warm-up before participating fully in class.
Repeated absences or tardiness may affect a student's progress, placement, choreography, performance opportunities, or participation in Studio programs.
15. CLASS ETIQUETTE
Students are expected to:
Respect instructors, staff, and classmates.
Listen while the instructor is teaching.
Follow instructions.
Remain attentive and engaged.
Avoid disruptive behavior.
Use appropriate language.
Respect personal space.
Avoid unnecessary physical contact.
Use equipment properly.
Follow safety instructions.
Keep the classroom clean and organized.
Treat Studio property with care.
Students may be removed from class for repeated disruptive, disrespectful, or unsafe behavior.
16. RESPECTFUL CONDUCT
Bullying, harassment, intimidation, threats, fighting, inappropriate physical contact, discriminatory behavior, sexual harassment, abusive language, or other inappropriate conduct is not permitted.
The Studio reserves the right to take appropriate disciplinary action, including removal from a class, program, performance, competition team, or Studio.
17. DANCE ATTIRE AND FOOTWEAR
Students must wear appropriate attire and footwear for their enrolled class.
Students may be required to wear specific dance shoes, dancewear, athletic clothing, hair accessories, or other items designated by the instructor or Studio.
Loose clothing, jewelry, accessories, or other items that create a safety risk may not be permitted.
18. PERSONAL BELONGINGS
Students are responsible for their own belongings.
HD Dance Academy is not responsible for lost, stolen, or damaged personal property.
Students should not bring unnecessary valuables to the Studio.
19. STUDIO PROPERTY AND EQUIPMENT
Students must treat Studio property, equipment, mirrors, floors, furniture, props, and other items with care.
Intentional or negligent damage may result in disciplinary action and/or responsibility for repair or replacement costs to the extent permitted by law.
20. DROP-OFF AND PICK-UP
Parents/guardians are responsible for ensuring that students arrive safely and are picked up promptly after their scheduled activity.
Unless specifically stated otherwise, Studio supervision begins at the scheduled class/activity start time and ends when the activity ends.
The Studio does not provide childcare before or after scheduled activities.
Parents/guardians should notify the Studio if a person other than an authorized parent/guardian will pick up a minor student.
21. ILLNESS
Students should not attend class when they are too ill to safely participate or when their attendance may reasonably expose others to illness.
The Studio may ask an ill student to leave class or remain home until they are able to safely participate.
No tuition refund is guaranteed for illness-related absences.
22. MEDICATION
Parents/guardians are responsible for ensuring that students have any necessary medications and that the Studio is informed of relevant emergency medical needs.
The Studio does not guarantee medication administration unless specifically agreed upon and permitted under applicable law and Studio policy.
23. PHOTO, VIDEO, AND MEDIA RELEASE
I understand that HD Dance Academy may photograph, videotape, or otherwise record students during classes, rehearsals, performances, competitions, workshops, recitals, events, and other Studio activities.
Unless I have specifically opted out through the Studio's designated media-release process, I grant HD Dance Academy permission to use photographs, videos, recordings, and other media containing the student's image, likeness, voice, or performance for legitimate Studio purposes, including:
Studio website
Social media
Advertising
Marketing
Promotional materials
Flyers
Posters
Recital materials
Competition promotion
Studio announcements
I understand that I will not receive compensation for the use of such materials.
24. PERFORMANCES AND RECITALS
Participation in Studio performances, showcases, recitals, and other events may require additional rehearsals, costumes, tickets, fees, or other requirements.
Performance participation may require students to attend scheduled rehearsals.
Failure to attend required rehearsals may affect a student's ability to participate in a performance.
25. COMPETITION TEAM
Competition team participation may involve additional tuition, choreography fees, costumes, competition entry fees, travel expenses, workshops, rehearsals, and other costs.
Competition team members and their parents/guardians are responsible for understanding and meeting all deadlines established by the Studio.
Competition participation may require additional attendance and rehearsal commitments.
The Studio reserves the right to determine choreography, casting, competition entries, team placement, and performance participation.
Competition fees and other team-related expenses may be non-refundable once commitments have been made to competitions, vendors, choreographers, costume companies, or other third parties.
26. PARENT/GUARDIAN RESPONSIBILITIES
Parents/guardians are responsible for:
Providing accurate registration information.
Keeping contact information current.
Paying tuition and applicable fees on time.
Reviewing Studio communications.
Following Studio policies.
Ensuring students arrive prepared and on time.
Arranging transportation.
Informing the Studio of relevant medical or safety concerns.
Supervising students before and after scheduled Studio activities.
Following drop-off and pick-up procedures.
Ensuring students have required dancewear and footwear.
27. COMMUNICATION
The Studio may communicate important information through the Studio Pro parent portal, email, text messages, phone calls, announcements, or other communication methods used by the Studio.
Parents/guardians are responsible for reviewing Studio communications and maintaining current contact information.
Failure to read a Studio communication does not automatically excuse a parent/guardian from applicable deadlines, payments, policies, or requirements.
28. PARENT AND FAMILY CONDUCT
Parents, guardians, family members, and visitors are expected to treat Studio staff, instructors, students, and other families respectfully.
Aggressive, threatening, abusive, disruptive, or inappropriate behavior toward Studio staff, instructors, students, or families may result in the individual being asked to leave the premises and/or restrictions on participation.
29. FACILITY SAFETY
Students and families must follow all safety instructions provided by Studio staff and facility management.
Students may not enter restricted areas or classrooms without permission.
Running, climbing on furniture, tampering with equipment, or engaging in unsafe behavior is prohibited.
30. CHANGES TO POLICIES
HD Dance Academy reserves the right to modify Studio policies, tuition policies, schedules, procedures, and program requirements when reasonably necessary.
Updated policies may be communicated through Studio Pro, the parent portal, email, website, registration system, or other Studio communication methods.
31. ELECTRONIC AGREEMENT
I understand that this waiver and agreement is provided electronically through the Studio's registration system.
By checking the required agreement box, clicking "I Agree," electronically accepting this waiver, registering a student, making a payment, or allowing a student to participate in Studio activities, I acknowledge that I have had the opportunity to read and review this agreement and voluntarily agree to its terms.
I understand that my electronic acceptance is intended to have the same effect as my written acknowledgment to the fullest extent permitted by applicable law.
32. PARENT/GUARDIAN CONSENT FOR MINORS
If the student is under 18 years of age, I represent that I am the student's parent or legal guardian, or that I have appropriate authority to consent to the student's participation.
I consent to the student's participation in HD Dance Academy classes, rehearsals, performances, competitions, workshops, and other Studio activities.
I acknowledge and agree to the terms of this waiver and enrollment agreement on behalf of myself and, to the extent permitted by law, the participating minor.
33. SEVERABILITY
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
34. ACKNOWLEDGMENT AND CONSENT
By electronically accepting this agreement, I acknowledge that:
I have read and understood this agreement.
I understand that dance involves inherent risks.
I voluntarily accept those risks.
I understand the Studio's tuition and payment policies.
I understand that tuition is non-refundable once the applicable season/session begins, subject to applicable law and Studio-approved exceptions.
I understand the $15 late payment fee.
I understand that missed classes may be made up when eligible and that all make-up classes must be completed before the end of the same season.
I understand the attendance and make-up policies.
I agree to follow Studio rules and policies.
I understand the Studio's photo/video policy.
I understand the requirements for performances and competition programs.
I understand my responsibilities as a parent/guardian.
I consent to the student's participation in Studio activities.
I agree to be bound by this agreement and the Studio's applicable policies.
BY ELECTRONICALLY ACCEPTING THIS AGREEMENT, I CONFIRM THAT I HAVE READ, UNDERSTOOD, AND AGREE TO ALL TERMS AND CONDITIONS OF THE HD DANCE ACADEMY ONLINE WAIVER, RELEASE OF LIABILITY & ENROLLMENT AGREEMENT.
