ACKNOWLEDGEMENT OF RISK AND RELEASE OF LIABILITY
Acknowledgement of Risk.
Axis Dance Center (DBA/tradename of “Cookie Harrist Dance LLC”) owns and operates a dance studio offering dance instruction and programming. The undersigned (referred to as “I” or “me”), as the participant and/or in my legal capacity as the parent/guardian of the minor participant named below, do hereby acknowledge and agree that my participation in Axis Dance Center programs is voluntary. I have full knowledge and understanding of the risks associated with participation in dance activities, including but in no way limited to: (1) slips, trips, and falls; (2) cuts or scrapes; (3) sprains, strains, fractures, and general pain, soreness, and stiffness; (4) injuries resulting from stretching, jumping, turning, lifting, or other dance movements; (5) physical collisions with other participants, studio equipment, or materials; and (6) illness, including exposure to and infection with viruses or bacteria. I further acknowledge that the preceding list is not inclusive of all possible risks associated with Axis Dance Center’s programs and that said list in no way limits the operation of this agreement.
Waiver and Release of Liability.
By signing this form, I agree that the participant (and, if the participant is a minor, I sign in my legal capacity as the parent/guardian on the minor participant’s behalf), and the participant’s heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Axis Dance Center, its members, managers, employees, agents, and volunteers from and against any and all claims, demands, causes of action, damages, losses, or liabilities for injuries, illnesses, disabilities, loss of life, or damage to person or property arising out of or related to participation in Axis Dance Center programs, to the fullest extent permitted by law.
I understand and agree that I am solely responsible for the security, care, and safeguarding of my personal property brought to, stored at, or used in connection with Axis Dance Center programs, whether at the Axis Dance Center studio or at any off-site location, including recital, performance, competition, event, or other venue, including, without limitation, phones, wallets, keys, jewelry, dance attire, bags, equipment, and other belongings. Axis Dance Center does not assume responsibility for the loss, theft, damage, or disappearance of any personal property. To the fullest extent permitted by law, I hereby release and hold harmless Axis Dance Center, its members, managers, employees, agents, and volunteers from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or relating to the loss, theft, damage, or disappearance of personal property, whether occurring before, during, or after participation in any Axis Dance Center program, whether at the Axis Dance Center studio or at any off-site location.
I certify that I have disclosed to Axis Dance Center any condition, impairment, injury, or other limitation of the participant that may affect their safe participation in programs, sessions, classes, and other activities with Axis Dance Center. Axis Dance Center will consider reasonable accommodations where appropriate, but may require medical clearance or modify or limit the participant’s participation as reasonably necessary for safety.
Emergency Medical Assistance.
In the event of an accident, injury, or medical emergency involving me or occurring during my participation with Axis Dance Center, I authorize Axis Dance Center, its members, managers, employees, agents, and volunteers to obtain or provide emergency medical assistance as they deem appropriate, including but not limited to calling 911, contacting emergency medical services, administering first aid, CPR, AED use, and taking other reasonable measures to assist until professional medical help is available, and I agree to pay the costs of any and all such medical services and expenses. I understand that Axis Dance Center is not responsible for providing medical care and does not guarantee that any such assistance will be available or effective.
I hereby release, waive, and discharge Axis Dance Center, its members, managers, employees, agents, and volunteers from any and all claims, demands, causes of action, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to the rendering of, failure to render, or decision-making regarding such emergency assistance, including the selection of medical personnel or facilities and transportation arrangements, to the fullest extent permitted by law.
I further certify that I am of lawful age (18 years or older) and legally competent to sign this agreement, and/or I have legal capacity to act as the parent/guardian of the minor participant.
