READ BEFORE SIGNING

WARRANTY AND CONSENT OF SELF/PARENT/GUARDIAN
ASSUMPTION OF RISKRELEASE AND WAIVER OF LIABILITYINDEMNITY AGREEMENT
IN CONSIDERATION of allowing myself / my minor child/ward to participate in the programme, related events, and activities of Edge Centre for Dance Inc. (collectively, the “Activities”).

I WARRANT TO YOU THAT:

I am an adult / parent/guardian having full legal responsibility for decisions regarding myself / my minor child/ward, and


I am familiar with the risk of serious injury and death which any participant in the Activities must assume, and


I believe that I am / my minor child/ward is physically, emotionally, and mentally able to participate in the Activities, and that my / his/her/their equipment is mechanically fit for my / his/her/their use in the Activities, and


I understand, and will instruct my minor child/ward, that all applicable rules for participation must be followed and that, at all times, the sole responsibility for personal safety remains with myself / my minor child/ward, and


I will immediately remove myself / my minor child/ward from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I / my minor child/ward has experienced any deterioration in my / his/her/their physical, emotional, or mental fitness for continued participation in the Activities.


PHOTO/MEDIA CONSENT AND RELEASE
I FURTHER CONSENT AND AGREE, on behalf of myself / my minor child/ward, as follows:

I grant Edge Centre for Dance Inc. and its agents, representatives, employees, and assigns (collectively, the “Media Releasees”) the irrevocable and unrestricted right to take, record, use, reproduce, publish, or otherwise disseminate photographs, video recordings, or other audio/visual materials of myself / my minor child/ward taken during the Activities for any lawful purpose, including but not limited to promotional, advertising, educational, and archival purposes, in any format or media now known or later developed, and without further notice or compensation.


I understand and agree that such media may be used with or without my / my minor child’s/ward’s name or other identifying information, and I waive any right to inspect or approve the final version of such media, including any written copy or digital content that may be used in connection therewith.


I acknowledge that all such media will remain the property of Edge Centre for Dance Inc. and that I have no ownership or licensing rights in any such materials.


I release and discharge the Media Releasees from any and all claims, demands, and liabilities whatsoever in connection with the above, including any claims of defamation, invasion of privacy, or infringement of moral rights or publicity rights.


I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, MY MINOR CHILD/WARD, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

an unqualified ASSUMPTION OF ALL RISKS associated with participation in the Activities by myself / my minor child/ward, even if arising from negligence, or gross negligence, including any compounding or aggravation of injuries, including death, caused by negligent rescue operations or procedures, of the Activities organizer(s) and any persons associated therewith or participating therein, and


a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of the Activities organizer(s) and all persons and organizations associated with it and the Activities including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of the premises used to conduct the Activities, sanctioning bodies, medical or rescue personnel (the RELEASEES), of and from with the respect to all injury, disability, death or loss or damage to person or property whether arising from the negligence, or negligent rescue of or by the foregoing or otherwise, and


an AGREEMENT NOT TO SUE the RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from the participation of myself / my minor child/ward in the Activities, and


an AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fees, liability, damage, award, or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the RELEASEES or otherwise.


I HAVE READ THIS DOCUMENT THOROUGHLY.
I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY / MY MINOR CHILD'S/WARD'S PARTICIPATION IN THE ACTIVITIES.
