WJ Dance Youth Participant Waiver and Agreement

By signing this agreement, I certify that I am the parent or legal guardian of the minor participant(s) I am registering, or that I otherwise have legal authority to act on their behalf. I acknowledge that I have read, understand, and voluntarily agree to the following terms on behalf of myself and the participant(s).

1. Medical Treatment Authorization

I authorize WJ Dance LLC, dba WJ Dance (“WJ Dance”), its owners, employees, instructors, coaches, staff, agents, and representatives to act on my behalf when I am unavailable to obtain emergency medical care or treatment that is reasonably considered necessary for the participant.

I understand and agree that I am solely responsible for all expenses and costs associated with such medical treatment. I further agree to indemnify and hold WJ Dance harmless from expenses or costs it may incur in connection with obtaining such emergency care.

I understand that it is my responsibility to provide WJ Dance with accurate and current information regarding any medical conditions, allergies, medications, injuries, physical limitations, or other health concerns that may affect the participant’s safety or ability to participate.

2. Pre-Existing Injuries and Medical Conditions

I understand that it is my responsibility to inform WJ Dance of any pre-existing injury, medical condition, physical limitation, allergy, or other health concern that may affect the participant’s ability to safely participate in dance classes, rehearsals, performances, competitions, camps, workshops, or other WJ Dance activities.

By allowing the participant to participate, I represent that the participant is physically able to participate, with or without any limitations that have been disclosed to WJ Dance.

I understand and acknowledge that dance and other physical activities may aggravate, worsen, or cause the recurrence of a pre-existing injury or medical condition. I knowingly and voluntarily assume the risks associated with such aggravation, worsening, recurrence, or related injury.

To the fullest extent permitted by applicable law, I release and hold harmless WJ Dance, its owners, employees, instructors, coaches, staff, agents, and representatives from claims arising from the aggravation, recurrence, or worsening of a participant’s pre-existing injury or medical condition in connection with participation in WJ Dance activities, except to the extent liability cannot legally be waived.

I understand that WJ Dance instructors and staff are not medical professionals and are not responsible for determining whether a participant is medically fit to participate. When appropriate, it is my responsibility as the parent or legal guardian to obtain medical clearance before allowing the participant to participate.

3. Assumption of Risk

I understand and acknowledge that participation in dance classes, rehearsals, performances, competitions, camps, workshops, events, and other physical activities involves inherent and other risks.

These risks may include, but are not limited to, falls, collisions, physical contact with other participants or instructors, overexertion, muscle strains, sprains, fractures, other bodily injuries, illness, emotional distress, property damage, permanent disability, paralysis, or death.

I understand that not all risks can be anticipated, controlled, or eliminated.

I knowingly and voluntarily assume all risks associated with the participant’s involvement in WJ Dance activities, whether known or unknown, and voluntarily permit the participant to participate despite those risks.

4. Release and Waiver of Liability

In consideration for allowing the participant to participate in WJ Dance classes, rehearsals, performances, competitions, camps, workshops, events, programs, and other activities, I voluntarily release, waive, discharge, and hold harmless WJ Dance LLC, dba WJ Dance, together with its owners, officers, employees, instructors, coaches, staff, agents, representatives, contractors, affiliates, successors, and assigns, from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to the participant’s involvement in WJ Dance activities or use of WJ Dance facilities or equipment.

To the fullest extent permitted by applicable law, this release includes claims arising from ordinary negligence, acts, or omissions of WJ Dance or its employees, instructors, agents, or representatives.

I knowingly and voluntarily assume responsibility for injuries, illnesses, losses, or damages that the participant may sustain in connection with participation in WJ Dance activities, except where responsibility cannot legally be waived.

5. Indemnification

I agree, to the extent permitted by applicable law, to indemnify and hold harmless WJ Dance from claims, liabilities, damages, expenses, or costs arising from the participant’s conduct or participation in WJ Dance activities.

If WJ Dance is required to incur reasonable legal fees or costs to enforce this agreement, I agree to be responsible for such fees and costs to the extent permitted by applicable law.

6. Parent/Guardian Responsibility and Authorization

I certify that I am the participant’s parent or legal guardian, or otherwise have legal authority to enter into this agreement on the participant’s behalf.

I give the participant permission to participate in WJ Dance classes, rehearsals, performances, competitions, camps, workshops, events, and other activities for which the participant is registered or otherwise authorized to attend.

I warrant that all information I provide concerning the participant is complete and accurate to the best of my knowledge.

I understand that I am responsible for the participant’s behavior and conduct while attending WJ Dance activities.

I agree to be financially responsible for damage to WJ Dance property, facilities, or equipment caused by the participant through intentional misconduct or other conduct for which I am legally responsible.

I understand that I am responsible for ensuring timely drop-off and pick-up of the participant and for complying with WJ Dance’s current attendance, supervision, safety, and facility policies.

7. Photograph, Video, Audio, and Media Release

I understand that photographs, video recordings, and audio recordings may be taken during WJ Dance classes, rehearsals, performances, competitions, camps, workshops, events, and other activities.

I authorize WJ Dance to photograph, film, and/or record the participant and to use the participant’s image, likeness, performance, and/or voice for lawful WJ Dance business purposes, including but not limited to educational materials, promotional materials, advertising, social media, websites, digital content, printed materials, and other publications.

I understand that such photographs, videos, or recordings may be edited, reproduced, published, displayed, distributed, or otherwise used without additional approval or compensation.

I waive any right to inspect or approve the finished materials and waive any right to royalties or other compensation arising from WJ Dance’s authorized use of such materials.

This authorization has no geographic limitation and will remain valid unless revoked in writing for future use.

If I do not authorize WJ Dance to publicly use photographs or recordings of the participant, I understand that I must notify WJ Dance in writing and follow WJ Dance’s current media opt-out procedure.

8. Payment, Cancellation, and Refund Policy

I understand and agree that all purchases and payments made to WJ Dance, including but not limited to registration fees, tuition, class packages, punch cards, drop-in classes, camps, workshops, rehearsals, performances, competitions, and other programs or services, are non-refundable and non-transferable once purchased, except as otherwise expressly stated in WJ Dance’s applicable written policies or as required by applicable law.

Failure to attend, voluntary withdrawal, scheduling conflicts, changes in personal circumstances, or unused classes or services do not entitle the participant or parent/guardian to a refund.

Any class credits, account credits, make-up classes, transfers, or other accommodations offered by WJ Dance are subject to WJ Dance’s then-current cancellation, attendance, and credit policies and do not constitute or create a right to a cash refund.

If WJ Dance cancels or materially changes a class, program, or event, WJ Dance may, in accordance with its applicable policies and applicable law, provide a replacement class, make-up opportunity, account credit, transfer, or refund, as appropriate.

I acknowledge that I am responsible for reviewing the applicable pricing, payment, cancellation, credit, expiration, and attendance policies before completing a purchase.

9. Acknowledgment and Agreement

I acknowledge that I have carefully read this agreement and fully understand its terms.

I understand that this agreement includes an assumption of risk, release of liability, medical treatment authorization, media consent, and payment and refund terms.

I acknowledge that I am voluntarily giving up certain legal rights on behalf of myself and, to the extent permitted by applicable law, the minor participant.

I certify that I have authority to sign this agreement on behalf of the participant.

By providing my electronic signature, I confirm that I voluntarily agree to the terms of this agreement.
