LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK
The Method Conservatory LLC
In consideration of my dancer's participation in classes, rehearsals, performances, competitions, conventions, and other activities offered by The Method Conservatory LLC ("the Studio"), I, as the parent or legal guardian of the minor student named on this form, agree to the following on behalf of myself, my dancer, and our heirs, executors, and assigns:
1. Assumption of Risk. I understand that dance, partnering, lifts, tumbling, and related physical activities carry an inherent risk of injury, including but not limited to muscle strains, sprains, fractures, joint injuries, and impact injuries from equipment, props, or floor surfaces. I understand these risks also extend to travel to and from competitions, conventions, and off-site events. I voluntarily assume all such risks on behalf of my dancer.
2. RELEASE OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE, WAIVE, AND DISCHARGE THE METHOD CONSERVATORY LLC, ITS OWNERS, INSTRUCTORS, STAFF, VOLUNTEERS, AND AFFILIATES FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, OR EXPENSES ARISING FROM MY DANCER'S PARTICIPATION IN STUDIO ACTIVITIES, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
3. Parental Authority. I represent that I am the parent or legal guardian of the minor student and have full legal authority to sign this waiver on their behalf, including the release described in Section 2.
4. Medical Authorization. In the event of injury or medical emergency, I authorize Studio staff to seek emergency medical treatment for my dancer if I cannot be immediately reached, and I accept financial responsibility for any resulting costs.
5. Photo/Video Release. Unless I have separately opted out using the Studio's photo opt-out setting, I consent to my dancer being photographed or filmed during Studio activities for use in promotional materials, social media, and the Studio's website.
6. Governing Law. This agreement is governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from this agreement shall be resolved in the state or federal courts located in Fort Bend County, Texas.
7. Severability. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment. I have read this waiver in its entirety, understand its terms, and voluntarily agree to be bound by it.
