Waivers & Studio Policies

PART ONE — LIABILITY WAIVER, ASSUMPTION OF RISK, RELEASE OF CLAIMS, AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY. THIS DOCUMENT LIMITS YOUR LEGAL RIGHTS. BY SIGNING, YOU ARE AGREEING TO ASSUME RISK, RELEASE CLAIMS, AND WAIVE THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW.

1. Acknowledgment of Voluntary Participation

I, the undersigned participant, or the parent/legal guardian of the minor participant named above, acknowledge that participation in dance classes, rehearsals, performances, workshops, private lessons, auditions, conditioning, stretching, and all related activities offered by The Conservatory of Dance and Fine Arts is voluntary.

2. Assumption of Risk

I understand and acknowledge that dance activities involve inherent and other risks, including, without limitation:
• slips, trips, and falls;
• collisions with other participants, instructors, guests, or objects;
• sprains, strains, torn ligaments, fractures, dislocations, concussions, and other serious bodily injuries;
• injuries arising from jumps, turns, landings, lifts, partnering, floor work, stretching, conditioning, acrobatic movement, tumbling, or choreography; injuries caused by studio floors, mirrors, barres, props, costumes, equipment, staging, or physical conditions of the premises; and exposure to communicable illness or other health-related risks.

I further understand that such risks may arise from the participant's own actions, the actions or inactions of others, the condition of the premises, ordinary negligence, or other causes. I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, and whether arising from negligence or otherwise, to the fullest extent permitted by law.

3. Release and Waiver of Claims

In consideration for being permitted to participate, I, for myself and for my heirs, personal representatives, estate, successors, assigns, and, if applicable, the minor participant, hereby release, waive, discharge, and covenant not to sue The Conservatory of Dance and Fine Arts, its owners, members, managers, instructors, employees, independent contractors, agents, volunteers, affiliates, landlords, insurers, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of any kind, whether known or unknown, arising out of or related to participation in studio activities or presence on the premises.

This release includes claims arising from the ordinary negligence of any Released Party, including claims based on alleged failure to supervise, failure to warn, failure to maintain safe premises, failure to inspect equipment or flooring, or failure to provide emergency assistance, to the fullest extent permitted by Georgia law.

4. No Release for Gross Negligence or Other Non-Waivable Conduct

Nothing in this Agreement is intended to release liability for gross negligence, wilful or wanton misconduct, or any other liability that cannot be waived under applicable law.

5. Georgia Law; Validity and Public Policy

I understand that under Georgia law, exculpatory agreements and waivers of liability for ordinary negligence may be enforceable if clear, explicit, and not contrary to public policy. I further understand that such agreements will not protect a party from gross negligence or wilful or wanton conduct. I acknowledge that I am signing this Agreement voluntarily and with full understanding of its terms.

6. Medical Authorization

If the participant is injured or becomes ill during studio activities, I authorize The Conservatory of Dance and Fine Arts to obtain emergency medical treatment, including ambulance transport, if in its judgment such action is necessary and a parent/guardian or emergency contact cannot be reached in a timely manner. I understand and agree that I am solely responsible for all medical, ambulance, hospital, and related expenses.

7. Health and Fitness Representation

I represent that the participant is physically able to participate in the studio's activities and does not have any condition that would make participation unsafe, except as disclosed in writing to the studio. I agree to notify the studio promptly of any injury, limitation, medication, allergy, or medical condition relevant to participation.

8. Photo and Video Release

I grant The Conservatory of Dance and Fine Arts permission to photograph, record, film, and otherwise capture the participant's image, likeness, voice, and performance, and to use the same for legitimate business, promotional, educational, archival, and social media purposes, unless revoked in writing as permitted by studio policy.

9. Indemnification

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from:
• the participant's acts or omissions;
• violation of studio rules or policies by the participant or me;
• inaccurate or incomplete information provided by me; or
• claims brought by or on behalf of third parties arising from the participant's conduct.

10. Rules and Conduct

I agree that the participant will comply with all studio rules, safety instructions, dress code requirements, attendance policies, and instructor directions. I understand that failure to comply may result in removal from class or termination of participation without refund.

11. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. Any dispute arising out of or relating to this Agreement shall be brought in a court of competent jurisdiction located in Georgia, unless the parties agree otherwise in writing.

12. Severability

If any provision of this Agreement is held invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

13. Entire Agreement

This Agreement contains the entire understanding between the parties regarding the subject matter hereof and supersedes all prior or contemporaneous oral or written statements regarding the participant's assumption of risk and release of claims.

14. Acknowledgment of Understanding

I acknowledge that:
• I have carefully read this Agreement;
• I understand that I am giving up substantial legal rights, including the right to sue for ordinary negligence;
• I am signing freely and voluntarily;
• I have had the opportunity to ask questions and consult independent counsel; and
• I understand that the release is intended to be broad and to the maximum extent permitted by Georgia law.

ELECTRONIC ACKNOWLEDGMENT

By checking the acknowledgment box and providing your typed name and electronic signature through the Studio Pro Parent Portal, you certify that you are the participant (if 18 or older) or the parent/legal guardian of the minor participant, that you have read and understood this Liability Waiver, Assumption of Risk, Release of Claims, and Indemnity Agreement in full, and that you agree to be bound by its terms to the fullest extent permitted by Georgia law. Your electronic signature, name, and the date/time of acceptance are recorded by Studio Pro at the time you accept.

PART TWO — STUDIO POLICIES & CODE OF CONDUCT

Welcome to our dance studio family! To ensure a positive, safe, and productive environment for all students, we ask that every student and parent/guardian read and respect the following policies.

Attendance & Tardiness

• Consistent attendance is essential. Dance is a discipline that builds upon itself — missed classes affect individual progress and the group as a whole.
• Students should arrive at least 5–10 minutes before class to change, stretch, and mentally prepare.
• If a student will be absent, please notify the studio in advance whenever possible.
• Excessive absences (more than 3 unexcused absences per session) may result in removal from performances or recitals.
• Students who arrive more than 10 minutes late must ask the instructor to join class.
• Make-up classes may be available at the owner's discretion.

Dress Code & Studio Rules

• Appropriate dance attire is required for all classes. Specific requirements will be provided by the instructor based on the dance style if different from what is mentioned below (e.g., ballet, hip-hop, contemporary).
• All students must have a base black tank leotard, black boy shorts, clean unripped/untorn honey tights, and the appropriate dance undergarments (i.e. sports bra and dance bra).
• Black and/or tan jazz shoes (Minis and up), pink split-sole ballet shoes, paws or turners (Seniors).
• Hair must be secured away from the face for all classes.
• Demerits will be given for dress code violations.
• No street shoes on the dance floor. Proper dance shoes or bare feet (as directed) are required.
• Jewelry, gum, and food are not permitted in the studio.
• Water bottles are welcome and encouraged — please keep them capped and off the floor.
• Students are responsible for their personal belongings. The studio is not liable for lost or stolen items.
• Please treat the studio space, equipment, and property with care and respect.

Code of Conduct

• All students are expected to treat fellow dancers, instructors, and studio staff with kindness and respect at all times.
• Bullying, harassment, or disrespectful behavior of any kind will not be tolerated and may result in dismissal from the program.
• Students should come to class with a positive attitude and a willingness to learn.
• Cell phones must be silenced and put away during class time.
• Parents/guardians are asked to wait outside the studio or in the lobby during class unless invited in by the owner.

Disruptions during class time are discouraged.

• Any concerns or conflicts should be addressed respectfully and privately with the studio director — not during class.
• We celebrate every dancer's journey. Negative comments about one's own or another's ability are discouraged. We do encourage constructive criticism. We lift each other up here.
• All students are expected to keep their hands and feet to themselves.
Classes & Placement
• Placement in upper-level classes is based on audition only. A student's age or years of enrollment does not automatically qualify them for advancement.
• Competition piece participation is by audition only. Auditions are held at the discretion of the studio director and/or instructors.
• Audition decisions are final. We ask that students and parents/guardians respect the judgment of our instructors, as placements are made with each dancer's growth and success in mind.
• Students not selected for a competition piece or upper-level class are encouraged to continue developing their skills — advancement opportunities arise throughout the year.
• Audition dates and requirements will be communicated to eligible students in advance.

Tuition & Fees

• Tuition is due on the 1st of each month. A late fee of $25 will be applied after the 5th. Tuition is to be paid through automatic draft or through the online payment system unless previous arrangements have been made with the Director.
• Tuition is non-refundable. No refunds or credits will be issued for missed classes.
• Locked cards are subject to a $35 fee.
• Checks are not accepted.
• A registration fee of $65 (per student) is due at the time of enrollment and is non-refundable.
• Costumes for recitals/performances are an additional cost and will be communicated in advance.
• Tuition remains the same regardless of the number of classes in a given month (holidays, studio closures, etc.).
• Continued enrollment is considered confirmation of payment responsibility. Students with outstanding balances may be asked to sit out until the account is current.

Agreement

By enrolling in classes, students and their parents/guardians agree to abide by the policies outlined above, in addition to the Liability Waiver, Assumption of Risk, Release of Claims, and Indemnity Agreement set forth in Part One. We are grateful to have you as part of our studio community and look forward to growing together!

By checking the acknowledgment box and providing your typed name and electronic signature through the Studio Pro Parent Portal, you certify that you have read and understood these Studio Policies & Code of Conduct and agree to abide by them for as long as you or your student remain enrolled. Your electronic signature, name, and the date/time of acceptance are recorded by Studio Pro at the time you accept.

PART THREE — RECITAL & PERFORMANCE INFORMATION

Performance is an important part of dance education. We encourage all students to participate in the spring recital. Recital fees will be due in addition to tuition. There are two performances per dance season. The Conservatory will present a Holiday performance and the Annual Spring Recital.

Costume rental fee for the holiday performance is $35.00 and is due by October 20th.

The recital fee covers costume(s), 2 tickets to the recital, and recital memorabilia (such as trophy, tee shirt, etc.). 1st Payment for recital costumes is due October 15th — Final Payment is due January 15th. Payments paid after the due date will have an additional fee of $10.00 per costume. If an X-Large costume is needed, an additional fee of $10.00 will be added.

If you opt for partial payment, you will be given an agreement form to sign and return. By signing this form, you agree to pay the balance by the due date. Should your child be unable to perform for any reason, you will be expected to pay the balance. There are no refunds on recital fees for any reason.

Recital Fees

Pre-ballet students costume fee (two in one costume)- $155.00
Ballet/Tap students costume fee (two costumes)- $190.00
Students with three costumes- $255.00
Hip Hop classes (one costume)- $155.00
Tumbling classes- $155.00
Ballet/Tap with hip hop- $255.00

Recital Requirements
• All accounts must have a $0.00 balance to receive costumes.
• All recital fees must be paid in full.
• All dancers must wear hair in a high bun.
• Required tights, shoes, etc.
