PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT.
This Waiver and Release of Liability is entered into by the undersigned participant (or participant’s legal guardian if under 18) in favor of LeeLee Dance Co., its owners, agents, instructors, employees, contractors, volunteers, and all affiliated entities (hereinafter collectively referred to as "the Studio").
1. Acknowledgment and Assumption of Risk
I understand that participation in dance, fitness, and movement-based classes involves physical activity, which carries inherent risks of injury, including but not limited to sprains, strains, broken bones, head injuries, or even death. I acknowledge that these risks may arise from my own actions, inactions, the actions or inactions of others, or the condition of the premises. I voluntarily assume all such risks, known and unknown, and I take full responsibility for my participation in any and all activities at the Studio or off-site under the Studio’s supervision.
Recognition of Abuse
Staff are expected to be aware of signs of abuse or neglect, including unusual injuries, behavioral changes, or verbal disclosures.
Mandatory Reporting
Any known, alleged, or suspected abuse involving a participant will be reported to the appropriate authorities in accordance with state law.
Staff Awareness
These procedures are provided to all instructors, assistants, substitutes, and volunteers and are available upon request.
Supervision & Visibility
One-on-one situations are avoided when possible. All instruction occurs in open, observable areas with visibility to others.
Facility Supervision
Participants are supervised at all times during classes, rehearsals, and events. Access to secluded or unsupervised areas is restricted.
Appropriate Conduct
Staff maintain appropriate physical contact limited to instructional necessity. Inappropriate physical contact, verbal interaction, or electronic communication with minors is prohibited.
Private lessons are conducted in open, observable spaces. Doors remain open or visibility is maintained at all times. Parents/guardians may remain on site or observe from designated viewing areas.
2. Release and Waiver
I hereby waive, release, and discharge the Studio and all of its representatives from any and all liability, claims, demands, causes of action, damages, or losses arising out of or connected to participation in Studio-related activities. This includes, without limitation, liability for negligence or alleged negligence, injury, illness, property damage, or death. This release is binding upon me and my heirs, personal representatives, and assigns.
3. Medical Treatment Authorization
In the event of an emergency, I authorize the Studio to secure medical treatment on my behalf. I understand I am solely responsible for all costs related to such treatment.
4. Photo and Video Release (Optional)
I grant permission for the Studio to take and use photographs or video recordings of me for promotional, educational, or entertainment purposes. I understand I may opt out in writing below.
5. Compliance with Rules
I agree to comply with all Studio rules, policies, and staff directions. I understand failure to do so may result in removal from participation without refund.
6. Governing Law and Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah. If any provision is found unenforceable, the remainder shall remain in full force and effect.
7. Team Placement and Participation
I understand and acknowledge that all decisions regarding team placement, participation, and cuts are made at the sole discretion of the studio owner/instructor. These decisions are based on factors including, but not limited to, skill level, commitment, attitude, attendance, and overall team needs. I agree to respect and support the instructor’s authority in these matters and understand that such decisions are final.
8. Injury and Continued Participation
In the event a dancer is injured, I understand that the studio owner/instructor will make the final decision regarding the dancer’s continued participation on the competitive team. This decision will be made with careful consideration of medical advice, including doctors’ notes, as well as input from the dancer’s parents or guardians. The owner/instructor will prioritize the dancer’s safety and well-being, as well as the overall needs of the team. Every effort will be made to handle such situations with compassion and fairness. I also understand that if a dancer is no longer able to participate on the team, the parent or guardian will neither be charged for future team-related fees nor reimbursed for fees already paid.
Head Injury & Concussion Policy:
LeeLee Dance Co. prioritizes dancer safety. If a dancer is suspected of sustaining a head injury or concussion during class, rehearsal, or performance, the dancer will be immediately removed from participation. The dancer may not return to class until written medical clearance is provided by a licensed healthcare professional. Parents/guardians will be notified as soon as possible.
9. Injury Reporting
I agree to kindly inform the owner/instructor as soon as possible if I experience any injury while participating in Studio activities. Prompt communication helps ensure my safety and allows the Studio to provide appropriate support.
10. Personal Property
I understand and accept that the Studio cannot be held responsible for any loss, damage, or theft of personal belongings brought to the Studio or related events. I will do my best to safeguard any items brought to the Studio.
11. Health and Safety Protocols
I acknowledge that participation in the Studio activities may involve exposure to communicable illnesses. I agree to adhere to any health and safety guidelines established by the Studio to help protect myself and others.
12. Substitute Instructors and Staff
I understand that from time to time, the Studio may engage substitute instructors at will. These decisions are made in the best interest of the Studio and do not affect my agreement or participation.
