Policies:
The full cost for the summer session are due first day of class. For an invoice or other, payment must be arranged before class.
We do not offer refunds for missed classes in the summer. Our summer session offers nine weeks of classes in the summer, however our costs are that which we would charge for eight weeks. We do this because we expect that students may miss a classs during the summer and it limits our time and resources that we would spend keeping track of refunds and absences. If you must withdraw your dancer during the summer session before July 6th you will be refunded 50% of the summer tuition. Withdrawal after that point with NOT be refunded.
Waiver (first-time enrollees of Elaia Academy will be asked to sign a physical copy of our release of liability form)
RELEASE OF LIABILITY AND ASSUMPTION OF RISK
I understand that physical exercise and training, including the use of equipment, receiving of instruction, and participation in class activities (collectively, “Ballet”), is a potentially dangerous activity and involves the risk of injury, serious injury, disability, and damage to property. I acknowledge that these risks may be amplified by the state of my personal health: hydration, diet, exercise, etc., (“health”) I furthermore acknowledge that such risks may result from or be compounded by the actions, omissions, or negligence of my teacher (the “Instructor”), the school (“Elaia Academy”) or other responsible persons. I understand that although both the Instructor and Elaia Academy will at all times endeavor to reduce the risk of injury from Ballet, they cannot guarantee that I will not be injured under any circumstance. NOTWITHSTANDING THESE RISKS, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN BALLET. I AGREE TO ASSUME ALL RISKS OF ILLNESS, PERSONAL INJURY, PSYCHOLOGICAL INJURY, PAIN, SUFFERING, DISABILITY, DEATH, PROPERTY DAMAGE, AND FINANCIAL LOSS ARISING THEREFROM, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE INSTRUCTOR OR OTHERWISE.
I waive and release all claims, now known or hereafter known, against the Releasees (“Instructor” or “Elaia Academy”) or affiliate person(s) on account of personal health, including: psychological injury, illness, pain, suffering, disability, death, property damage, or financial loss arising out of or attributable to Ballet, whether arising out of the ordinary negligence of the Instructor or otherwise. I agree not to make or bring any such claim against the Instructor or Elaia Academy, and forever release and discharge both the Instructor and Elaia Academy from liability under all such claims.
I confirm that I am in good health and proper physical condition and do not have any medical issues or other needs that would impair my ability to participate in Ballet. I will also follow all instructions, recommendations, and cautions of the Instructor at all times during Ballet to ensure my safety. If at any time I believe that I am no longer in proper physical condition to participate in Ballet, I will immediately discontinue further training.
I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during Ballet. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and evacuation. I release, forever discharge, and hold harmless the Instructor or Elaia Academy from any claim based on such treatment or other medical services rendered.
This release shall not be orally modified and constitutes the entire agreement of Elaia Academy, the Instructor, and myself with respect to the subject matter contained herein and supersedes all prior and contemporaneous agreements, both written and oral, with respect to such subject matter. If any term or provision of this release is deemed invalid, illegal, or unenforceable, all other terms or provisions shall remain in full force and effect.
