STUDENT PARTICIPATION AGREEMENT & LIABILITY WAIVER

Welcome to The Dance Center LLC. We are excited to have you and your family participate in our programs and activities. Our goal is to provide a safe, supportive, educational, and positive environment for all students. Dance instruction and participation, however, involve physical activity and movement that may carry inherent risks. Because of those risks, all participants and parents/guardians must carefully read and sign this Agreement before participating in any classes, rehearsals, performances, competitions, conventions, camps, workshops, travel activities, or other studio-related events.
For purposes of this Agreement, the term “Activities” includes all classes, rehearsals, performances, competitions, conventions, workshops, camps, conditioning, stretching, tumbling, choreography sessions, private lessons, travel, studio events, demonstrations, showcases, social events, and any other activities sponsored, organized, conducted, or associated with The Dance Center LLC on or off-site.

1. PARTICIPATION IN ACTIVITIES AND ASSUMPTION OF RISK
I understand that participation in dance and related Activities involves inherent risks that cannot be completely eliminated. These risks may include physical injury, illness, property damage, serious injury, or death arising from or related to participation in the Activities.
I acknowledge that participation in dance requires physical exertion and movement. I understand that injuries may occur despite reasonable instruction, supervision, or safety precautions.
I further understand that Activities may involve physical contact between instructors and Participants for instructional or safety purposes, including demonstrations, spotting, correction of technique, or injury prevention.
I understand that supervision levels may vary depending on the nature of the Activity and that parents or guardians remain responsible for supervising minor Participants, including before drop-off and after pick-up, unless otherwise expressly agreed in writing by The Dance Center LLC.
I understand and acknowledge that The Dance Center LLC is not responsible for lost, stolen, or damaged personal property belonging to Participants or guests.
I voluntarily choose to participate in the Activities and knowingly and freely assume and accept all risks associated with participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law. I understand that participation is voluntary and may be discontinued at any time.
2. RELEASE AND WAIVER OF LIABILITY
I, on behalf of myself and, if applicable, on behalf of my minor child or Participant for whom I am the legal guardian, release, waive, and agree not to bring or maintain any claim against The Dance Center LLC and its owners, instructors, employees, and associated personnel (collectively, the “Released Parties”) for any injuries, damages, claims, losses or causes of action arising out of or related in any way to participation in the Activities, including claims arising from the ordinary negligence of the Released Parties.
If the Participant is a minor, I represent that I am the Participant’s parent or legal guardian and have the authority to sign this Agreement on the minor Participant’s behalf. I understand and agree that this Agreement is intended to be binding upon both me and the minor Participant to the fullest extent permitted by law and includes any and all claims that may be brought by, through, on behalf of, or for the benefit of the minor Participant.
I understand and agree that this release applies to all Activities and to any injuries or damages occurring on studio premises, at off-site locations, during travel, during performances or competitions, or in connection with any studio-related event or Activity.
I understand that by signing this Agreement, I am waiving substantial legal rights, including the right to file a lawsuit for ordinary negligence. Nothing in this Agreement shall release or waive claims arising from gross negligence, reckless conduct, or intentional misconduct where prohibited by applicable law.
3. MEDICAL AUTHORIZATION AND HEALTH ACKNOWLEDGMENT
In the event of an injury, illness, accident, or medical emergency, I authorize The Dance Center LLC and its representatives to obtain or authorize emergency medical care or treatment for the Participant as deemed reasonably necessary. I understand and agree that I am solely responsible for any medical expenses or costs.
I represent and warrant that the Participant is physically capable of safely participating in the Activities and has no medical condition or impairment that would prevent safe participation except as disclosed in writing to The Dance Center LLC.
4. RULES, POLICIES, AND PARTICIPANT CONDUCT
I agree that the Participant and all parents/guardians will comply with all studio rules, policies, procedures, dress codes, attendance requirements, safety instructions, competition rules, and directions provided by The Dance Center LLC and its staff, whether communicated verbally, electronically, or in writing. I understand that unsafe, disruptive, abusive, threatening, disrespectful, or inappropriate conduct by a Participant, parent, or guest may result in suspension or removal from Activities without refund.
5. PHOTOGRAPHY, VIDEO, AND MEDIA RELEASE
Unless revoked in writing, I grant The Dance Center LLC permission to photograph, video record, livestream, or otherwise capture the Participant’s image, voice, performance, and likeness during Activities. I authorize The Dance Center LLC to use such photographs, recordings, or media for promotional, educational, advertising, marketing, social media, website, recital, competition, and other business purposes without compensation or additional approval.
I have carefully read this Agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to file certain legal claims against the Released Parties. I acknowledge that I have had the opportunity to ask questions about this Agreement, that I understand its contents, and that I am signing it freely and voluntarily with the intent that it be legally binding.
