This General Liability Waiver, Release of Claims, and Indemnification Agreement (“Agreement”) is entered into by and between Paid In Full Creative Studio, including its owners, directors, officers, employees, instructors, independent contractors, volunteers, affiliates, partners, sponsors, and event hosts (collectively referred to as the “Studio”), and the undersigned participant, or the parent/legal guardian of a minor participant (collectively referred to as the “Participant”).
In consideration of being permitted to enter, use, and participate in any activities, programs, services, events, or rentals associated with Paid In Full Creative Studio, the Participant agrees to the following terms and conditions:
The Participant understands and agrees that this Agreement applies to all activities conducted at, through, or in connection with the Studio, including but not limited to dance instruction in various street and cultural dance forms, movement-based training, DJ instruction, music production workshops, open sessions, rehearsals, performances, battles, cyphers, community events, private lessons, and the rental or use of Studio space and equipment.
The Participant acknowledges that participation in such activities involves inherent risks, including but not limited to physical injury, illness, property damage, or other unforeseen circumstances. These risks may arise from physical exertion, contact with other participants, use of equipment, condition of the premises, or the actions or omissions of the Participant or others. The Participant knowingly and voluntarily assumes all such risks, whether known or unknown, and accepts full responsibility for any injury, loss, or damage sustained.
The Participant represents that they, or the minor Participant under their care, are physically and mentally capable of safely participating in Studio activities. The Participant agrees to disclose any relevant medical conditions, injuries, or limitations prior to participation and understands that it is their responsibility to monitor their own physical condition and discontinue participation if necessary.
To the fullest extent permitted by law, the Participant hereby releases, waives, discharges, and covenants not to sue the Studio from any and all claims, demands, liabilities, damages, costs, or causes of action of any kind, whether known or unknown, arising out of or related to participation in Studio activities, attendance at events, rental or use of the Studio space, or use of any equipment or facilities. This release includes any claims based on the alleged negligence of the Studio or any of its representatives.
The Participant further agrees to indemnify, defend, and hold harmless the Studio from any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or related to the Participant’s actions, participation, use of facilities or equipment, or breach of this Agreement. This indemnification obligation applies to any claims brought by or on behalf of the Participant, including those involving third parties.
The Participant agrees to use all Studio facilities and equipment, including but not limited to sound systems, DJ equipment, turntables, mixers, flooring, mirrors, and related materials, in a safe and responsible manner. The Participant accepts full financial responsibility for any damage to Studio property resulting from misuse, negligence, or failure to follow instructions. The Studio shall not be held responsible for any lost, stolen, or damaged personal property brought onto the premises
.
In the case of rentals or hosted events, the Participant assumes full responsibility for their conduct and the conduct of any guests or attendees associated with their use of the Studio. The Participant agrees to comply with all Studio policies, safety guidelines, and capacity requirements, and understands that they may be held liable for any damages, injuries, or violations that occur during the course of their rental or event.
The Participant acknowledges that the Studio may capture photographs and video recordings during classes, events, or activities. By signing this Agreement, the Participant grants the Studio permission to use such media for promotional, marketing, and documentation purposes, unless the Participant explicitly declines consent in writing.
The Participant agrees to conduct themselves in a respectful and responsible manner at all times while participating in Studio activities or using Studio facilities. The Studio reserves the right to refuse service or remove any individual who fails to comply with rules, safety standards, or community expectations, without refund.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By signing below, the Participant acknowledges that they have read this Agreement in its entirety, fully understand its terms, and voluntarily agree to be bound by it. The Participant further acknowledges that they are waiving certain legal rights, including the right to bring a claim against the Studio.
