MINOR PARTICIPANT LIABILITY WAIVER AND RELEASE AGREEMENT
This Liability Waiver and Release Agreement (“Agreement”) is entered into by the undersigned parent or legal guardian (“Parent/ Guardian”) of the minor child participant (“Minor”) in favor of Illuminate Dance Academy, its owners, directors, officers, employees, instructors, contractors, agents, and volunteers (collectively, the “Academy”).
1. Acknowledgment of Risk
I, the undersigned Parent/Guardian, understand that dance, movement, fitness training, performances, rehearsals, and related activities involve physical exertion and carry inherent risks of injury, including but not limited to sprains, strains, fractures, head injuries, and other potential physical harm. I voluntarily assume these risks on behalf of my Minor.
2. Release and Waiver of Liability
To the fullest extent permitted by California law, in consideration of my Minor's participation in the Academy, I hereby waive, release, and discharge the Academy from any and all claims, demands, damages, actions, liability, expenses or causes of action of any kind ("Claims") that may arise out of or relate to my Minors’s participation in any Academy-sponsored activity, whether occurring on Academy premises or at any off-site event, including, without limitation, Claims related to negligence, bodily injury, death and property damage.
3. Medical Treatment Authorization
I authorize the Academy and its representatives to obtain emergency medical treatment for my Minor if I am not present or cannot be reached in a timely manner. I understand that I am responsible for any medical expenses incurred and that the Academy does not provide health or accident insurance for participants.
4. COVID-19 and Communicable Diseases
I understand that participation in group settings, including dance classes and events, may expose my Minor to infectious diseases such as COVID-19. I assume full responsibility for this risk and agree that the Academy shall not be liable for any resulting illness, exposure, or related damages.
5. Media Release
I grant permission for the Academy to take and use photographs, video recordings, and other media of my Minor during classes, rehearsals, or performances for promotional, advertising, and educational purposes in print or digital form. No compensation is expected or required.
6. Compliance with Policies
I acknowledge that I have reviewed the Academy’s policies and procedures and agree that my Minor and I will abide by them. I understand that failure to follow the Academy rules may result in the suspension or termination of my Minor’s enrollment in the Academy without refund.
7. Indemnification
I agree to indemnify and hold harmless Illuminate Dance Academy from any claims, demands, damages, or liabilities arising out of or related to my child’s participation in Academy activities, including those brought by third parties or other Minors. 8. Legal Capacity and Understanding
I certify that I am the legal parent or guardian of the Minor named below and that I have the legal authority to sign this Agreement. I have read and fully understand the contents of this Agreement and sign it voluntarily.
9. MISCELLANEOUS. This Agreement shall bind and inure to the benefit of the parties hereto and their successors and assigns. This Agreement shall be governed by the laws of the State of California, without reference to conflict of laws principles. The parties acknowledge that this Agreement was made in Sonoma County, California and consent to the exclusive jurisdiction and venue of such county. If any legal action is instituted in connection with this Agreement, the prevailing party or parties shall be entitled to reasonable attorney's fees in addition to all other recoverable costs and damages. This Agreement contains the entire agreement between the parties with respect to the subject matter hereof. Any failure to enforce any provision of this Agreement shall not constitute a waiver thereof or of any other provisions hereof. This Agreement may not be amended, nor any obligation waived, except by a writing signed by all parties hereof.
