The Dance Club SC Membership Cancellation Policy

(30-Day Notice Requirement)

At The Dance Club SC, we strive to provide flexible and fair policies for our members. This Cancellation Policy applies to all monthly memberships, class packages with auto-renewal, and ongoing enrollment in dance classes, workshops, or programs.
Cancellation Procedure

To cancel your membership or enrollment, you must provide written notice at least 30 days prior to your desired cancellation date or the next billing cycle.

Verbal notifications (in-person or by phone) are not sufficient to initiate cancellation.

Effective Date and Billing

Your membership or enrollment will remain active, and you will continue to have access to classes and facilities, during the 30-day notice period.
You will be responsible for payment of any tuition, fees, or dues that accrue during the 30-day notice period, including the final monthly payment if applicable.

Cancellation will take effect at the end of the 30-day notice period, or at the end of the current billing cycle (whichever aligns with the notice provided).

No prorated refunds will be issued for partial months unless required by law.

Refunds and Credits

Prepaid fees for services not yet rendered after the effective cancellation date may be refunded or credited at the studio's discretion.
Registration fees, costume fees, recital fees, or other non-tuition charges are non-refundable.
No refunds will be provided for classes missed prior to cancellation.

Exceptions

In cases of serious injury, illness, or relocation (supported by documentation), the studio may waive or reduce the 30-day notice requirement at its sole discretion.

This policy does not affect any statutory rights to cancel under applicable South Carolina law (e.g., certain cooling-off periods for new contracts).

Automatic Renewal

Monthly memberships auto-renew until proper cancellation notice is received.
Failure to provide timely notice will result in continued billing.

By enrolling in classes or purchasing a membership at The Dance Club SC, you acknowledge and agree to this Cancellation Policy.

Liability Waiver, Release, and Assumption of Risk Agreement

By checking the box and/or typing my name below (or the name of the minor participant), I acknowledge that this constitutes my legal electronic signature and that I intend to be legally bound by this agreement.
In consideration of being permitted to participate in any dance classes, workshops, rehearsals, performances, events, or other activities (collectively, "Dance Activities") at The Dance Club SC (the "Studio"), including the use of its facilities, equipment, and premises, I (on behalf of myself and, if applicable, the minor participant named above) acknowledge, agree, and represent as follows:

1. Acknowledgment of Risks
I understand that Dance Activities involve inherent risks, including but not limited to: slips, falls, collisions with other participants or objects, strains, sprains, fractures, muscle tears, heart attacks, strokes, or other injuries, illness, or even death. These risks may arise from the physical nature of dance, the condition of the facilities or equipment, the actions of other participants, or other foreseeable and unforeseeable causes. I acknowledge that participation in Dance Activities is physically demanding and may involve hands-on instruction or spotting by instructors.
I voluntarily assume all such risks, both known and unknown, and accept full responsibility for any injury, loss, damage, or expense that may occur as a result of participation.

2. Physical Condition and Medical Authorization
I represent that I (or the minor participant) am in good physical health and have no medical conditions that would prevent safe participation in Dance Activities. I have consulted a physician if necessary and confirm that participation is appropriate.
In the event of a medical emergency, I authorize the Studio's staff, instructors, or representatives to seek and consent to emergency medical treatment on my behalf (or on behalf of the minor). I agree to be responsible for any associated costs.

3. Release of Liability and Waiver of Claims
I hereby forever release, waive, discharge, and covenant not to sue The Dance Club SC, its owners, directors, officers, employees, instructors, volunteers, agents, landlords, affiliates, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, illness, or death that may be sustained by me (or the minor participant), or to any property, whether caused by the negligence of the Released Parties or otherwise, while participating in Dance Activities or using the Studio's facilities.
This release applies to the fullest extent permitted by law and includes claims for ordinary negligence but does not apply to gross negligence or intentional misconduct.

4. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, or expenses (including attorneys' fees) brought by or on behalf of me (or the minor participant) or any third party arising from participation in Dance Activities.

5. Photo/Video Release
I grant the Studio permission to use photographs, videos, or recordings of me (or the minor participant) taken during Dance Activities for promotional purposes, without compensation.

6. Governing Law and Severability
This agreement shall be governed by the laws of the State of South Carolina. If any portion is held invalid, the remainder shall continue in full force.
I have read this agreement carefully, fully understand its terms, and agree to it freely and voluntarily without inducement.

I, as parent/legal guardian, consent to the minor's participation and agree to all terms on their behalf.
