1.1. In this release, you means the person enrolling for any program at progress dance and arts PTY LTD. By Enrolling to participate in programs at progress dna, you agree to this media release.
1.2 You consent to Progress Dance And Arts Pty Ltd (ABN 85 680 124 305) (we, us or our), or any person acting on our behalf:
(a) to take photographs, film, or other pictorial and audio recordings of the student, in any medium (Material); and
(b) to use, reproduce, publish, communicate or broadcast the Material whether altered or enhanced or in conjunction with any other images or text in any form (including in on our website, social media, third party websites or blogs, print or digital media, in a publication, poster or presentation) for advertising, marketing, publicity, promotional purposes.
1.3 You agree that as between you and us, we own the copyright and related rights in the Material and that you do not have a right to inspect or approve the finished product that may be used.
1.4 You agree that you will not be paid or receive any benefits or royalties for appearing in the Materials unless otherwise agreed between you and us.
1.5 You agree that this release is governed by the laws of New South Wales and you submit to the exclusive jurisdiction of the courts of New South Wales.
Photography/ videography:
ProgressDNA may use photos and videos taken in the studio or for studio purposes for our marketing and website purposes. This may include uses on social media.
It is understood that performances may/will be filmed and photographed for distribution to family and friends of ProgressDNA.
Any online classes are recorded purely for insurance purposes and no footage will be distributed or viewed outside of this without prior written notice.
Band App:
Band App is a studio regulated form of communication. It is a child-safe way for parents to stay up to date on whats happening at the studio and what their children are learning in class. Videos and photos of classes will be shared in private bands for your artist's classes only. Band is made for child safety! All bands will be set to Private and Child Safe mode. Admins approval will be required to join, and only the admins and co-admins can create a Band/Band chat. The Director will monitor all activity for assured safety. All staff have strict online procedures they will follow as part of ProgressDNA's Child Safe Policy and Staff Policy on use of Social Media. Photos and videos including other children are not to be shared to personal social media accounts and any breach of this will be followed with immediate action to remove the content.
It is mandatory that parents join on behalf of their children (aged under 13 years). Students over 13 years old are welcome to create their own band account with parental permission. We use Band App to communicate day to day info and reminders that are relevant to your artist! The big stuff will still come by email as well (eg: concert info and account discussions). All details are strictly protected. Please view Band Apps privacy policy for further info.
We act carefully in line with our ChildSafety Policy. Parents and students may share their own content from events but please be mindful of our other students online safety and privacy.
Refusal to consent
You may withdraw consent via email to info@progressdna.com.au - please specify your level of withdrawn consent in line with the outlined levels below:
level 1: You withdraw consent for a dancer to be featured in ads and social media posts - this means your dancer will not be featured alone/up close but may appear in group shots or the background of content. They will still be able to be involved in band posts.
level 2: You withdraw consent for your dancer to appear at all in progressdna class content - this means your dancer will not be filmed or photographed in classes at progressdna. This means they will be expressly asked to step out of photographs and videos and will not be involved in any content posted to band. They will still appear in any event content including but not limited to: eoy performances, midyear performances, special events, and camps
