1.1. In this release, you means the person enrolling for any program at progress dance and arts PTY LTD. By Enrolling to participate in programs at progress dna, you agree to this media release.

1.2 You consent to Progress Dance And Arts Pty Ltd (ABN 85 680 124 305) (we, us or our), or any person acting on our behalf:
(a) to take photographs, film, or other pictorial and audio recordings of the student, in any medium (Material); and
(b) to use, reproduce, publish, communicate or broadcast the Material whether altered or enhanced or in conjunction with any other images or text in any form (including in on our website, social media, third party websites or blogs, print or digital media, in a publication, poster or presentation) for advertising, marketing, publicity, promotional purposes.

1.3 You agree that as between you and us, we own the copyright and related rights in the Material and that you do not have a right to inspect or approve the finished product that may be used.

1.4 You agree that you will not be paid or receive any benefits or royalties for appearing in the Materials unless otherwise agreed between you and us.

1.5 You agree that this release is governed by the laws of New South Wales and you submit to the exclusive jurisdiction of the courts of New South Wales.


Photography/ videography:
ProgressDNA may use photos and videos taken in the studio or for studio purposes for our marketing and website purposes. This may include uses on social media.
It is understood that performances may/will be filmed and photographed for distribution to family and friends of ProgressDNA.
Any online classes are recorded purely for insurance purposes and no footage will be distributed or viewed outside of this without prior written notice.

Band App:
Band App is a studio regulated form of communication. It is a child-safe way for parents to stay up to date on whats happening at the studio and what their children are learning in class. Videos and photos of classes will be shared in private bands for your artist's classes only. Band is made for child safety! All bands will be set to Private and Child Safe mode. Admins approval will be required to join, and only the admins and co-admins can create a Band/Band chat. The Director will monitor all activity for assured safety. All staff have strict online procedures they will follow as part of ProgressDNA's Child Safe Policy and Staff Policy on use of Social Media. Photos and videos including other children are not to be shared to personal social media accounts and any breach of this will be followed with immediate action to remove the content.
It is mandatory that parents join on behalf of their children (aged under 13 years). Students over 13 years old are welcome to create their own band account with parental permission. We use Band App to communicate day to day info and reminders that are relevant to your artist! The big stuff will still come by email as well (eg: concert info and account discussions). All details are strictly protected. Please view Band Apps privacy policy for further info.

We act carefully in line with our ChildSafety Policy. Parents and students may share their own content from events but please be mindful of our other students online safety and privacy.

Refusal to consent
You may withdraw consent via email to info@progressdna.com.au - please specify your level of withdrawn consent in line with the outlined levels below:
level 1: You withdraw consent for a dancer to be featured in ads and social media posts - this means your dancer will not be featured alone/up close but may appear in group shots or the background of content. They will still be able to be involved in band posts.
level 2: You withdraw consent for your dancer to appear at all in progressdna class content - this means your dancer will not be filmed or photographed in classes at progressdna. This means they will be expressly asked to step out of photographs and videos and will not be involved in any content posted to band. They will still appear in any event content including but not limited to: eoy performances, midyear performances, special events, and camps

ASSUMPTION OF RISK / MEDICAL EMERGENCIES
I understand that any physical activity comes with some risk of injury. I hereby absolve ProgressDNA from any liability in the event of any injury to my child. I give ProgressDNA permission to seek medical attention at the time of accident or serious illness. I UNDERSTAND THAT I WILL BE RESPONSIBLE FOR COSTS ASSOCIATED WITH MEDICAL ATTENTION INCLUSIVE OF AMBULANCE FEES.
I take responsibility to ensure my phone number, and a secondary emergency contact is added to the Studio Pro parent portal for use in the case of illness, injury, or emergency.

RELEASE OF LIABILITY
I give permission for my child to be photographed and / or videoed whilst participating in ProgressDNA activities and I consent to these photos / videos being used for publicity purposes.
I will not hold ProgressDNA liable for any loss of property.

TRIAL CLASSES
I understand that trial classes are under progressdna’s "love it or it's free guarantee". This means that if my child trials a class/es and they don't love the class when they try it, i won't be charged for the class, however, for any classes that my child does enrol in I will be charged for the trial class week as the first week.

WALKING BUS ABSENCES
I understand that I must alert the office via text (0452289211) or email (info@progressdna.com.au) prior to 2pm on the day of classes if my child will be absent from walking bus. I understand that i may be charged a $5 admin fee if i fail to alert of absence prior to this time.

GENERAL TERMS
Enrolment is presumed for the entirety of 2026, I understand that fees will continue to be charged until ProgressDNA is notified in writing of withdrawal from classes.
To withdraw from a class, one weeks notice from scheduled class day must be provided in writing to info@progressdna.com.au. Normal class fees for the week of notice will be charged if notice given is less than one week.
Credits, refunds, and make up classes are not offered for absences. for extended absences of over 3 weeks, a 50% holding charge will apply in order to maintain students place in the class.
All classes are payable by Direct Debit on a weekly basis. All clients will be registered as a Direct Debit customer and all customers must enter payment details via the parent portal at time of registration.
if you wish to pay upfront, You can elect to pay credit onto your account at any time. The credit will be used in lieu of debits. Card details will still be required to be entered into the system and full payment will be charged to your card on file if payment is not made prior to the due date.
ProgressDNA charges an annual registration fee of $40 per student to cover insurances and licences. This is payable at time of registration for 2026.
it is mandatory for progressdna students to participate in the eoy concert. Concert costumes deposits are charged as $30 per class per term in week 1 of terms 1, 2, and 3. the Concert package is $90 and is charged in week 1 of term 4. concert and costume fees are non-refundable or creditable. costume fees are transferable between classes only until week 1, term 3.
A late fee of 10% will apply to any outstanding payments more than 7 days overdue. Students will not be able to register or participate in classes if payment details are not correct on file, upfront payment in advance is not received by the end of Week 2, or a direct debit payment fails for 2 consecutive fortnights.
Students will not be able to participate in any ProgressDNA events if account is not up to date and there are any outstanding amounts owed on account.
ProgressDNA reserves the right to pass any outstanding fees onto a Debt Collection Agency, this will incur a 20% surcharge on the balance of the account.

DIRECT DEBIT (Auto-Pay) TERMS
As a DIRECT DEBIT customer with ProgressDNA, through our payment partner stripe (via Studio Pro), I agree that:
I am responsible for entering and updating when necessary my debit/credit card details via the studio pro parent portal.
I will nominate a default payment method (if more than one payment method is entered)
Progressdna, through their payment provider stripe (via studio pro) has the authority to debit my elected debit or credit card the balance owing on my Tuition Fees in accordance with my studio pro account on weekly mondays commencing week 1 of each term.
I understand that registration fees will be due at time of registration for 2026 classes and are non-refundable.
I understand that concert and costume fees will be charged in accordance with the dates outlined in the 2026 fee structure as per the welcome hub website and are non-refundable.
I understand that I must maintain a current card on file via studio pro throughout my enrolment at progressdna.
I will send my remittance to info@progressdna.com.au upon payment if paying credit upfront or failed outstanding payments via bank transfer.
A failed payment admin fee of 10% of total amount will be added to my ProgressDNA account if my direct debit payment fails twice consecutively.
Where a direct debit payment fails in 2 consecutive payments, students will not be able to participate in classes and any ProgressDNA events until all outstanding amounts are paid in full.
I understand that a 10% late fee will be applied to any payment over 7 days overdue.

Families must opt-in for emails to receive essential communications.
