Fairhope Youth Collective (hereinafter “FYC”) will pick up all registered children from their designated schools (either Fairhope East Elementary School or Fairhope West Elementary School) and bring them to the FYC facility where they will be supervised until 6:00pm. FYC follows the Baldwin County Public School (“BCPSS”) calendar including all scheduled closures for holidays, teacher work days, virtual learning days, as well as any unplanned closures due to weather, illness, natural disasters, public health emergencies, safety concerns, operational issues, security threats, or any unforeseen events. Tuition will not be reimbursed or credited due to closures, both planned & unplanned.
FINANCIAL RESPONSIBILITY
Once registered with the Fairhope Youth Collective, you are financially responsible for the full school year (August 9, 2025 – May 21, 2026). No exceptions regardless of enrollment date. Withdrawal from FYC will only be granted under the following circumstances: a serious, long-term illness confirmed by a doctor that physically prevents the child from participating, or relocation outside the program’s service area. Uncontested proof of these circumstances will need to be provided to complete withdrawal.
TUITION & FEES
Autopay is required for all active FYC accounts. Tuition is invoiced for the upcoming week on Friday and must be paid by Sunday before the start of the week; autopay for all unpaid invoices will be processed on Sunday at 9:00pm. Tuition not paid by 11:59pm on the Sunday of the start of the week will incur a $20 late fee. A $30 service charge will be applied for all returned checks and a $10 service charge on all failed/returned ACH and debit/credit card transactions. There is a $1 per minute surcharge for every minute you are late (after 6:00pm) to pickup your child. Any fees accrued by FYC in the process of obtaining payments from past due accounts, including but not limited to, accounting fees, collection fees, legal fees, court costs, postage fees, & hourly wages from staff, will be the responsibility of, you, the account holder and not FYC or its employees. For your convenience, payments by card are accepted. There is a 3.5% fee on all charged credit cards and 1% on all ACH transactions.
DAMAGE LIABILITY
Parents and guardians agree to be responsible for any damage to the property, equipment, or belongings of FYC caused intentionally or through negligence by their child(ren). This includes, but is not limited to, damage to toys, furniture, fixtures, walls, windows, doors, electronics, hardware, and outdoor play equipment. FYC reserves the right to assess the cost of repair or replacement and to request reimbursement from the parent or guardian. A written notice will be provided detailing the damage, estimated cost, and deadline for payment. Failure to resolve payment for property damage may result in suspension or termination of services.
BEHAVIORAL LIABILITY
FYC is committed to providing a safe, nurturing, and respectful environment for all children and staff. To maintain this environment, appropriate behavior is expected from all enrolled children at all times. Parents and guardians acknowledge that repeated or severe behavioral issues—such as physical aggression, verbal abuse, bullying, defiance, or actions that pose a danger to the child or others—may result in disciplinary actions. These actions may include written warnings, behavior reports, temporary suspension, or permanent dismissal from the facility, depending on the nature and frequency of the behavior. FYC staff will make reasonable efforts to work with families to address behavioral challenges, including implementing strategies or behavior plans when appropriate. However, the facility reserves the right to make decisions regarding continued enrollment based on the overall safety and well-being of all children and staff. No refunds will be issued for days missed due to behavioral suspensions or dismissal. Bullying, inappropriate behavior, sexual misconduct, harassing employees, will result in immediate dismissal & banning from the FYC program with an expulsion fee of $400 charged to your account.
WAIVER OF LIABILITY
I, the undersigned parent and/or guardian have been provided the FYC Policies & Procedures and acknowledge all rules and regulations and agree to follow as set forth. I hereby acknowledge that my child will participate in various activities, both indoor and outdoor, which may include physical activity, use of play equipment, and interaction with other children and staff both on and off the campus of the Fairhope Youth Collective. I understand that by enrolling my child in FYC, I represent and warrant that my child is healthy and that I will ensure that my child's state of health is sufficient for safe participation in the activities at FYC. FYC will take reasonable precautions for safety and hygiene but cannot eliminate all risks. On behalf of my child and as her/his parent and/or legal guardian, I assume the risk and agree that Fairhope Youth Collective, Jake Walker (owner), and FYC employees/contract employees shall not be liable in any way for any injuries sustained or loss of property resulting directly or indirectly from FYC activities, any of its related functions, as a participant or an observer on or off the premises. In the event of an emergency, I authorize FYC and its staff to seek medical care for my child, including transportation to the nearest medical facility, and I accept full responsibility for any resulting medical expenses. My child will remain covered by our family health insurance. It is understood that the student's own health insurance policy will be the only source for payment for any medical services, out of pocket expenses, and pain and suffering that may be incurred or result from treatment due to any injury or condition related in any way to attendance or any participation in any activity associated with Fairhope Youth Collective, on or off campus. I acknowledge that FYC is not equipped or staffed to accommodate children who require assistance with basic daily functions, including but not limited to self-feeding, social interaction with peers, verbal communication of needs, independent restroom use, or other essential life skills. I also understand that the program involves physically demanding activities such as walking, running, and swimming, and that the facility is unable to provide transportation or physical assistance to children who require support with mobility or similar needs. Undersigned hereby agrees to indemnify, hold harmless and defend Fairhope Youth Collective LLC (FYC), Jake Walker (Owner), as well as Owner's servants, employees, officers, directors, shareholders, successors in interest, and assigns, from and for any and all actions, causes of action, costs, demands, debts, liability, damage, expense, fees (including the fees for attorneys and other professionals) or claims arising from or related in any way to the services provided hereunder. I have read this waiver of liability and fully understand its terms. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. This waiver shall remain in effect for the duration of my child’s enrollment at FYC, unless otherwise revoked in writing by the undersigned; any addendums made to the waiver by FYC will be provided to me with the understanding that all changes made are accepted by undersigned.
