TUITION & FEES
Autopay is required for all active Fairhope Youth Collective (hereinafter "FYC") accounts. Tuition is invoiced for the upcoming week on Friday and must be paid by Sunday before the start of the week; autopay for all unpaid invoices will be processed on Sunday at 9:00pm. Tuition not paid by 11:59pm on the Sunday of the start of the week will incur a $20 late fee. A $30 service charge will be applied for all returned checks and a $10 service charge on all failed/returned ACH and debit/credit card transactions. There is a $1 per minute surcharge for every minute you are late (after 6:00pm) to pickup your child. Any fees accrued by FYC in the process of obtaining payments from past due accounts, including but not limited to, accounting fees, collection fees, legal fees, court costs, postage fees, & hourly wages from staff, will be the responsibility of, you, the account holder and not FYC or its employees. For your convenience, payments by card are accepted. There is a 3.5% fee on all charged credit cards and 1% on all ACH transactions. ALL FEES ARE NON-REFUNDABLE.

DAMAGE LIABILITY
Parents and guardians agree to be responsible for any damage to the property, equipment, or belongings of FYC caused intentionally or through negligence by their child(ren). This includes, but is not limited to, damage to toys, furniture, fixtures, walls, windows, doors, electronics, hardware, and outdoor play equipment. FYC reserves the right to assess the cost of repair or replacement and to request reimbursement from the parent or guardian. A written notice will be provided detailing the damage, estimated cost, and deadline for payment. Failure to resolve payment for property damage may result in suspension or termination of services.

BEHAVIORAL LIABILITY
FYC is committed to providing a safe, nurturing, and respectful environment for all children and staff. To maintain this environment, appropriate behavior is expected from all enrolled children at all times. Parents and guardians acknowledge that repeated or severe behavioral issues—such as physical aggression, verbal abuse, bullying, defiance, or actions that pose a danger to the child or others—may result in disciplinary actions. These actions may include written warnings, behavior reports, temporary suspension, or permanent dismissal from the facility, depending on the nature and frequency of the behavior. FYC staff will make reasonable efforts to work with families to address behavioral challenges, including implementing strategies or behavior plans when appropriate. However, the facility reserves the right to make decisions regarding continued enrollment based on the overall safety and well-being of all children and staff. No refunds will be issued for days missed due to behavioral suspensions or dismissal. Bullying, inappropriate behavior, sexual misconduct, harassing employees, will result in immediate dismissal & banning from the FYC program with an expulsion fee of $400 charged to your account.

WAIVER OF LIABILITY
I, the undersigned parent and/or guardian have been provided the FYC Policies & Procedures and acknowledge all rules and regulations and agree to follow as set forth. I hereby acknowledge that my child will participate in various activities, both indoor and outdoor, which may include physical activity, use of play equipment, and interaction with other children and staff both on and off the campus of the Fairhope Youth Collective. I understand that by enrolling my child in FYC, I represent and warrant that my child is healthy and that I will ensure that my child's state of health is sufficient for safe participation in the activities at FYC. FYC will take reasonable precautions for safety and hygiene but cannot eliminate all risks. On behalf of my child and as her/his parent and/or legal guardian, I assume the risk and agree that Fairhope Youth Collective, Jake Walker (owner), and FYC employees/contract employees shall not be liable in any way for any injuries sustained or loss of property resulting directly or indirectly from FYC activities, any of its related functions, as a participant or an observer on or off the premises. In the event of an emergency, I authorize FYC and its staff to seek medical care for my child, including transportation to the nearest medical facility, and I accept full responsibility for any resulting medical expenses. My child will remain covered by our family health insurance. It is understood that the student's own health insurance policy will be the only source for payment for any medical services, out of pocket expenses, and pain and suffering that may be incurred or result from treatment due to any injury or condition related in any way to attendance or any participation in any activity associated with Fairhope Youth Collective, on or off campus. I acknowledge that FYC is not equipped or staffed to accommodate children who require assistance with basic daily functions, including but not limited to self-feeding, social interaction with peers, verbal communication of needs, independent restroom use, or other essential life skills. I also understand that the program involves physically demanding activities such as walking, running, and swimming, and that the facility is unable to provide transportation or physical assistance to children who require support with mobility or similar needs. Undersigned hereby agrees to indemnify, hold harmless and defend Fairhope Youth Collective LLC (FYC), Jake Walker (Owner), as well as Owner's servants, employees, officers, directors, shareholders, successors in interest, and assigns, from and for any and all actions, causes of action, costs, demands, debts, liability, damage, expense, fees (including the fees for attorneys and other professionals) or claims arising from or related in any way to the services provided hereunder. I have read this waiver of liability and fully understand its terms. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. This waiver shall remain in effect for the duration of my child’s enrollment at FYC, unless otherwise revoked in writing by the undersigned; any addendums made to the waiver by FYC will be provided to me with the understanding that all changes made are accepted by undersigned.

Fairhope Youth Collective (hereinafter “FYC”) Afterschool Program will pick up all registered children from their designated schools (either Fairhope East Elementary School, Fairhope West Elementary School, J.L. Newton Elementary School or Veritas) and bring them to the FYC facility where they will be supervised until 6:00pm. FYC follows the Baldwin County Public School (“BCPSS”) calendar including all scheduled closures for holidays, teacher work days, virtual learning days, as well as any unplanned closures due to weather, illness, natural disasters, public health emergencies, safety concerns, operational issues, security threats, or any unforeseen events. Tuition will not be reimbursed or credited due to closures, both planned & unplanned.

FINANCIAL RESPONSIBILITY
ALL FEES ARE NON-REFUNDABLE. Once registered with the Fairhope Youth Collective Afterschool Program, you are financially responsible for the full school year (August 9, 2025 – May 21, 2026). No exceptions regardless of enrollment date. Withdrawal from FYC will only be granted under the following circumstances: a serious, long-term illness confirmed by a doctor that physically prevents the child from participating, or relocation outside the program’s service area. Uncontested proof of these circumstances will need to be provided to complete withdrawal.

SUMMER CAMP
1. Assumption of Risk
I, the undersigned parent or legal guardian, understand and acknowledge that participation in the Fairhope Youth Collective Summer Camp program involves inherent risks, including but not limited to physical injury, illness, property damage, or death. Activities may include indoor and outdoor play, physical recreation, field trips, swimming and/or wading activities, and other group activities. I voluntarily assume full responsibility for any and all risks, known or unknown, associated with my child’s participation in the Summer Camp program.

2. Activities Away From the Facility
I give permission for my child to participate in activities and events that take place away from the Fairhope Youth Collective facility, including but not limited to field trips, parks, recreational centers, community venues, and other off-site locations. I understand that these activities are an integral part of the Summer Camp experience and agree that my child may participate unless I provide written notice otherwise.

3. Transportation Authorization
I authorize Fairhope Youth Collective to provide transportation for my child to and from camp-related activities and off-site locations. I understand that transportation may be provided by Fairhope Youth Collective staff and/or designated vehicles. I acknowledge that reasonable precautions will be taken for the safety of all children during transportation; however, I accept full responsibility for any risks associated with transportation to and from activities.

4. Swimming and Wading Activities
I give permission for my child to participate in swimming and/or wading activities as part of the Summer Camp program, including activities at pools, splash pads, beaches, or similar water-based locations. I understand that swimming and water activities carry inherent risks, including the risk of serious injury or drowning. I acknowledge that Fairhope Youth Collective staff will provide supervision but are not acting as certified lifeguards unless otherwise stated. I accept full responsibility for my child’s participation in these activities. I affirm that I have disclosed any medical conditions, allergies, or limitations that may affect my child’s ability to safely participate in water-related activities.

5. Non-Discrimination Policy
FYC welcomes all children and families and is committed to providing a camp environment that is respectful, safe, and inclusive. We do not discriminate on the basis of race, color, national origin, sex, religion, disability, or any other protected status under applicable law.
We believe every child deserves the opportunity to participate in camp activities to the fullest extent reasonably possible. We will consider reasonable accommodations for campers with diagnosed disabilities or special needs so they may safely and successfully participate in the program.
To help us determine whether our camp can appropriately meet a child’s needs, parents/guardians must communicate with camp administration before the child’s first day of attendance regarding any diagnosis, medical condition, behavioral concern, developmental need, allergy, mobility limitation, communication need, or other condition that may require support, supervision, or accommodation. Parents must provide complete and accurate information about the child’s needs, including any strategies, supports, or accommodations the child requires in a group setting.
Camp staff may request additional information from the parent/guardian and, when needed, supporting documentation from a qualified professional in order to evaluate reasonable accommodations and whether the camp can safely and appropriately serve the child within the structure of the program.
Reasonable accommodations will be considered on an individual basis. However, FYC is not a therapeutic program, medical program, or one-on-one care setting. The camp does not provide dedicated one-on-one aides, personal attendants, or individualized staff assigned solely to one child. If a child’s needs require individual supervision or services beyond what can reasonably be provided in a group camp setting without fundamentally altering the program or compromising the safety and well-being of the child, other campers, or staff, the camp may determine that it is unable to meet that child’s needs.
Failure to disclose a diagnosis, condition, or accommodation need prior to attendance may impact the camp’s ability to safely serve the child and may result in delayed start, removal from the program, or dismissal if appropriate supports cannot be reasonably implemented.
Our goal is to work in partnership with families in good faith to determine whether a successful and safe camp experience can be provided.

6. Custody & Parental Disputes Policy
Our summer camp strives to provide a safe and supportive environment for all campers. In situations involving custody arrangements or parental disputes, the camp will remain neutral and will not become involved in legal matters between parents or guardians.
FYC will follow the instructions of the custodial parent or legal guardian as indicated on the camper’s registration forms, unless we are provided with current, court-issued legal documentation stating otherwise. It is the responsibility of the parent or guardian to supply any custody agreements, court orders, or legal documents that outline restrictions regarding pick-up, contact, or access to the child. These documents must be submitted prior to the start of camp or as soon as they are updated.
Without official legal documentation on file, the camp cannot deny a parent or legal guardian access to their child. Camp staff are not authorized to interpret custody agreements or mediate disputes between parties.
Any concerns regarding custody or authorized pick-up must be clearly communicated in writing to camp administration. The safety of the child remains our top priority, and failure to provide appropriate legal documentation may limit the camp’s ability to enforce specific custody arrangements.

7. Release and Waiver of Liability
In consideration of my child’s participation in the Fairhope Youth Collective Summer Camp program, I hereby release, waive, discharge, and hold harmless Fairhope Youth Collective, its owners, directors, employees, volunteers, and agents from any and all claims, demands, actions, or causes of action arising out of or related to any injury, illness, damage, or loss sustained by my child or property while participating in camp activities, including transportation, off-site activities, and swimming/wading activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

8. Medical Authorization
In the event of an emergency, I authorize Fairhope Youth Collective staff to seek emergency medical treatment for my child if I cannot be reached. I understand that I am financially responsible for any medical care provided.

9. Photo & Video Release
I grant permission for Fairhope Youth Collective staff to photograph and/or record my child during camp activities. I understand that these photographs and videos may be shared within the Fairhope Youth Collective parent portal and/or used for marketing, promotional, and social media purposes, including but not limited to websites, newsletters, and advertising materials. I understand that no compensation will be provided for the use of such images or videos.

10. Program Closures, Illness & Force Majeure
I understand and agree that Fairhope Youth Collective reserves the right to close the facility, cancel camp days, modify schedules, or suspend activities due to circumstances beyond its control. These circumstances may include, but are not limited to, inclement weather, natural disasters, power outages, facility or utility issues, staff illness or shortage, communicable illness, public health concerns, government directives, or other emergencies deemed necessary to protect the health and safety of children and staff.
I acknowledge and agree that no refunds, credits, or make-up days will be issued for closures or cancellations resulting from such circumstances. I further understand that these events do not relieve me of my financial responsibility for any registered camp weeks or associated fees.

11. Financial Responsibility
I understand, acknowledge, and agree that by enrolling my child in Fairhope Youth Collective Summer Camp, I am entering into a binding financial agreement.
I agree that I am financially responsible for all summer camp weeks for which my child is registered, regardless of attendance, illness, withdrawal, schedule changes, vacations, or any other reason. No refunds, credits, or adjustments will be issued for missed days or weeks. I understand that Summer Camp registration closes on May 1. Any requests to add, remove, or modify registered weeks must be submitted on the Portal Registration Site before May 1. After May 1, all registered weeks are final and non-cancellable. I acknowledge that auto-pay enrollment is mandatory for all Summer Camp families and is a condition of participation. Camp fees will be posted to my account each Friday and automatically drafted on Sundays using the payment method on file. I agree that if any payment is declined, returned, or fails for any reason, a $20 late fee will be immediately assessed. I further understand and agree that my child will not be permitted to attend camp or participate in any Fairhope Youth Collective activities until all outstanding balances, including late fees, are paid in full. I understand that repeated failed payments may result in immediate termination of my child’s enrollment at the sole discretion of Fairhope Youth Collective, with all outstanding balances remaining due.
I further agree that I am responsible for any and all costs incurred by Fairhope Youth Collective in the collection of outstanding balances, including but not limited to collection agency fees, attorney’s fees, court costs, administrative fees, and postage or delivery costs associated with sending invoices or notices via certified mail or other tracked methods. These amounts shall be added to my outstanding balance and are due immediately upon assessment.
ALL FEES ARE NON-REFUNDABLE.

12. Acknowledgment and Agreement
I certify that I am the parent or legal guardian of the above-named child and that I have read, understand, and voluntarily agree to the terms of this Liability Waiver, Release of Claims, and Media Consent. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Alabama.
