The Terms and Conditions stated in this Agreement govern your use of Pulse Performing Arts services. Pulse Performing Arts is a legal trading name of Andrews Entertainment Pty Ltd. Before agreeing to enrolment you should carefully review the following Agreement. We provide this service to you only on the condition that you accept all of the Terms and Conditions stated in this Agreement.
This Agreement will take effect the moment your booking is made via the website, Customer Portal, membership is paid or lessons commence, whichever is earliest. This document does not need to be signed for it to take affect.
If you do not agree, you are not granted permission to access or otherwise use our Service.
All references herein to "We" or "Us" or "Our School" or “Pulse” mean Pulse Performing Arts., which operates the Service. All references herein to "Client" or "Student" or "You" or "Account Holder" refer to any user of this Service. Parents/Legal Guardians accept the Terms and Conditions on behalf of their Children. All references to "School Term" or "Term" refer to the Queensland Primary School term calendar. Specific Term dates are outlined in the current parent handbook.
1. All lessons and classes are conducted by dancers, musicians or other performing artists who have undergone tutor training. All staff have a valid QLD Positive Notice Blue Card or equivalent.
2. Unless otherwise specified by management, scheduling follows the Queensland Primary School Term Calendar. Lessons will not run on public holidays, these lessons will be offered as a catch up lesson. Lessons do run on School Student Free days
3. An enrolment fee of $40 per child will be payable upon enrolment or added to first terms invoice.
4. Tuition is posted weekly to accounts and charged on Thursdays. To cancel we require 14 days written notice and your fees will be adjusted accordingly. If your payments include other fees, payments will continue until all outstanding fees are paid off.
5. All students enrolled after Week 3 of Term 4 remain enrolled until the end of year. No enrolment cancellation is accepted after this date due to concert preparation and end of year expenses.
6. You will be required to provide credit card details which are stored by Stripe before the students first class. If a payment method is not linked you may not be able to attend that week but may still be required to pay for the missed classes.
7. Should you default on payments for two or more weeks in a row your enrolment may be paused until payment is made in full. A late fee of 10% of the remaining balance will be added to your account. If payment is not made you may be referred to debt collection for recovery action. You will be liable to pay all outstanding amounts for the entirety of the term and any fees accrued by the agency.
8. No other payment methods are accepted including cash or bank transfer.
9. Enrolment is assumed to continue term to term. To cancel for the next term you must notify us before the start of term or you will be liable to pay the first two weeks. Students in private lessons will be required to pay a non-refundable deposit at the end of the school year to hold their place for the following year.
10. Our free trials operate on a "Love it or it's free" method. If you enrol in the class you will be billed for the trialled class. If you do not enrol you will not be charged for the trialled class.
11. In the event of a teacher's absence from class, a substitute teacher will be arranged. If no teachers are available at the time you will be informed of the cancellation and a make-up class scheduled. If there is no availability for a make-up class you will be credited the amount to your account. Strictly no refunds.
12. Any staff member of Pulse reserves the right to remove students from a class based on their behaviour. Management does not tolerate any form of harassment from students, parents or any persons dealing with Pulse. In the event of threatening behaviour towards any staff or client, enrolment may be terminated with no refund given and attempts to re-enrol will be reviewed on a case by case basis.
13. It is a requirement of Pulse that all students enrolled in classes are in the appropriate attire for their class genre as specified by management. Dance uniform and shoes appropriate to the class genre are a requirement in all classes and no jiffies or socks are allowed at any time. Bare feet is acceptable in some genres and teachers will communicate when this is the case. Dance wear is an external expense from class fees and can be purchased from the boutique.
14. All students of Primary School age are to be dropped off/picked up in the waiting area by a parent, guardian or responsible person of 18 years and over. Children are only supervised during tuition. Any child waiting to be picked up at the front/back of the studio is the parents’ responsibility. Children may wait in the studio waiting area until a parent arrives to collect them. Any child who leaves the premises without permission of staff is no longer the responsibility of Pulse Performing Arts. Any repeat instances will result in enrolment terminated.
15. Belongings and valuables are not to be left unattended. It is the responsibility of the students to look after their own things and Pulse holds no liability for misplaced belongings.
16. You agree to release Pulse Performing Arts including instructors and assistants, from liability for any and all injuries which may occur while training, practicing, performing, or during any studio event or activity. You give permission for emergency medical transportation and treatment of your students at your expense should the need arise.
17. Any upfront fees will not be refunded for change of mind.
18. Weekly fees are inclusive of costume hire for concerts and performances. Any damage to costumes or staining requiring extra cleaning, repair or replacement will be charged to your account for the reasonable replacement value and up to the retail value of the item.
19. Extra fees outside of weekly tuition arise for a number of reasons including, workshops, events, exams, competitions, uniforms, shoes, stockings etc . These will be communicated before charging.
20. All students enrolled at end of Term 3 are charged the "Term 4/Concert Fee" regardless of their participation in concert.
21. Pulse Performing Arts reserves the right to change or update the terms and conditions at any time. You will be notified in this instance and will be held to the new terms of service unless notice is given in writing.
